VICTORY! US District Court Judge has ordered the City of Asheville to pay $81,540 in legal fees to plaintiffs' attorneys in wrongful discrimination case involving race-based appointments to the Human Relations Council. It is disappointing that today the US Supreme Court lifted a restraining order which prevented law enforcement from detaining people by using solely race as probable cause. This decision does not end the litigation, but let us hope that race is not allowed to be used as a reason to stop and detain persons. Did we not learn this lesson 80 years ago with the despicable internment of US Citizens of Japanese decent?

A magistrate judge agrees that a lawsuit should proceed against the City of Asheville after the City denied applicants a position on a civic board due to skin color.

A federal magistrate judge recommends that plaintiffs be allowed to proceed with a lawsuit challenging Asheville’s rules for selecting its Human Relations Commission. The suit contends that the city violated constitutional bans on racial discrimination.
