THE STATE MUST ANSWER.
A court hearing has been scheduled in the lawsuit challenging the legality of New Mexico’s Universal Child Care launch.
The central question is not whether child care should exist.
The question is whether the Executive Branch had the legal authority to implement a major expansion of benefits through administrative rule before legislative authorization and appropriation.
The Court previously issued an Alternative Writ of Mandamus and ordered the State to show cause.
That hearing will take place on:
📅 June 11, 2026
🕜 1:30 p.m.
📍 Second Judicial District Court
Albuquerque, New Mexico
At stake is more than child care policy.
At stake is whether government follows the law when creating major public programs.
Public policy.
Legislative authority.
Rule of law.
