Albany Community Police Review Board The Albany Community Police Review Board (CPRB) is an independent, all-community-led oversight board.

The mission of the CPRB is to review and investigate complaints of alleged misconduct committed by officers of the Albany Police Department (APD). The Albany Community Police Review Board is an independent police oversight agency dedicated to overseeing the conduct of the Albany Police Department (APD), whose mission is to review and investigate alleged misconduct by APD officers. By doing so, the

y aim to foster stronger bonds between the APD and the public while reinforcing police accountability and trust within the communities served by the APD. In the year 2000, the Albany Community Police Review Board was established by the Common Council of the City of Albany through the addition of Part 33 to Chapter 42 of the City Code. This legislation formed a nine-member independent body, comprised of community members from the City of Albany, appointed jointly by the Common Council and the Mayor. Its primary function is to examine citizen complaints against the Albany Police Department members regarding alleged misconduct. In a unique arrangement, the Government Law Center at Albany Law School provides administrative services to assist the Board in its duties and day-to-day responsibilities. For nearly two decades, the Citizens Police Review Board (later renamed the Community Police Review Board) operated under a restricted review model, lacking the authority to conduct independent investigations or compel the production of witnesses or documents independently of the Common Council through subpoenas. This early iteration of the CPRB was primarily focused on reviewing and monitoring the Albany Police Department's Office of Professional Standards (OPS) investigations into alleged misconduct. The turning point came in 2020, following the tragic murder of George Floyd by a Minneapolis police officer, which triggered a public outcry for reform in the City of Albany. The CPRB also actively advocated for more robust police oversight by communicating with the Common Council. In 2021, Local Law J (Prop 7) was unanimously passed by the Common Council, enhancing the CPRB's effectiveness and authority through increased independent civilian oversight of the APD. This ballot referendum received the approval of 70% of voters. Enacted in 2022, Local Law J unequivocally affirms the CPRB's authority to conduct independent investigations with subpoena power. This significant expansion of powers enables the CPRB to independently investigate allegations of misconduct by APD members, irrespective of whether a civilian complaint is filed. To date, the CPRB has voted to conduct independent investigations into two incidents and six complaints, encompassing issues such as the use of force, the police department's handling of investigations, police conduct at protests, and officer-involved shooting incidents.

Mayor Kathy Sheehan, a third-term Democrat, is proposing a $221 million spending plan in which the Police Review Board receives about $683,000, a roughly 15% decrease. Its current budget is $804,000. Board Chair Nairobi Vives:

"What we learned during the presentation from the budget director is that that decrease was just some rough math they did in considering that we would no longer be contracting with the law school," said Vives. "What it's important for the community to know, and what we shared to the Common Council, is that we are in a process where we're losing the support of an entity that we've had for over two decades now. We had, historically, one full time staff member, and more recently, the help of consultants to make this transition efficient and effective. We'll need to continue to rely on those consultants that we have and try to build up staff to replace some of the support that we have from the law school. So this is not the time to be decreasing our budget."

Vives says keeping the funding level will maintain the board’s effectiveness, transparency and maintain its standard of professionalism.

CPRB Investigative Chair John Levendosky says the request is justified. "The amount that we do with what we have is, in my opinion, pretty good value for money. I'm going to the city. We're hoping to expand that. Once they see the necessity of what we do and the efficiency in which we do it, I think they'll better understand what we're asking for with regards to our budget, and the relationship, the fiscal relationship with, will evolve to a point where they kind of understand, better understand where this money is going to and how it's being used, and the actual cost of the necessity of things," Levendosky said.

The CPRB’s work enhances police accountability and helps people understand the law, their rights, and the legal parameters of law enforcement while helping build APD's credibility among Albany’s diverse communities.

The CPRB requests that the City budget dedicate the same amount of funding to the CPRB in Fiscal Year 2025 (FY2025) as it did in 2024 ($804,000). The CPRB intends to continue our work of providing robust police oversight while transitioning into the City and growing our internal capacity with no changes to our bottom line.

Tonight, the CPRB will present its annual budget proposal to the City of Albany Common Council Finance, Assessment and Taxation Committee. The CPRB requests that the FY2025 City Budget dedicate the same amount of funding to the CPRB as it did in FY2024 ($804,000).

The CPRB's work improves the relationship between APD and the public by enhancing police accountability, helping people understand the law, their rights, and the legal parameters of law enforcement while helping build APD's credibility among Albany’s most disenfranchised and marginalized communities.
