Immigration Bureau Investigates Allegations of Foreign Nationals Occupying Koh Phangan and Operating Nominee Businesses
Following media reports alleging that a large number of foreign nationals have been residing in Thailand and may be covertly engaging in employment or operating businesses through nominee arrangements, as well as operating schools for foreign students without proper authorization — particularly in the area of Koh Phangan, Surat Thani Province, since early May — the Immigration Bureau has coordinated with relevant government agencies in Surat Thani Province to discuss and verify the facts surrounding the matter.
The investigation found that there are currently 2,641 non-tourist foreign nationals in Koh Phangan District, Surat Thani Province, who have been granted temporary stay extensions in the Kingdom for more than 30 days and whose permissions remain valid. These include 369 Israeli nationals, 335 Russian nationals, 291 British nationals, 283 French nationals, 210 German nationals, and 1,153 nationals of other countries.
Regarding criminal cases involving foreign nationals in the jurisdiction of Koh Phangan Police Station since 1 January 2026, a total of 141 foreign nationals have been prosecuted. The breakdown includes 47 Myanmar nationals, 16 Israeli nationals, 13 Russian nationals, 8 American nationals, 7 German nationals, and 50 nationals of other countries. The offenses include traffic violations, narcotics-related offenses, and violations of the Foreign Workers Management Act. Furthermore, from 2024 to the present, authorities have prosecuted 23 cases involving Thai nationals acting as nominees on behalf of foreign businesses. These cases involved companies with shareholders from Israel (9 cases), Russia (3 cases), France (3 cases), the United States (2 cases), and other nationalities (6 cases).
The Immigration Bureau also joined forces with local authorities on Koh Phangan, including Koh Phangan Police Station, the Investigation Division of Surat Thani Provincial Police, Koh Phangan District Administrative Officials, and military officers from the Internal Security Operations Command Region 4, to inspect several childcare centers and private educational institutions. These included Chayut Childcare Center, World Abundance Co., Ltd., and Kiddy World Property Co., Ltd., where no violations were found.
Authorities also inspected ARKI KIDS Childcare Center and ARKI KIDS LANGUAGE SCHOOL, an unlicensed private language school operated by Arki Kids Co., Ltd. The institution accepted children aged 3–12 years and offered classes in drawing, singing, children’s activities, and physical exercise. A total of 144 children were enrolled, including 122 Israeli nationals, 2 German nationals, 2 French nationals, and 18 children of other nationalities.
Violations were discovered, including employing foreign nationals without valid work permits, failure by the employer to notify the registrar of foreign employees within 15 days from the date of employment, failure by the childcare center owner to comply with the Child Protection Act B.E. 2546 (2003), and operating an unlicensed private educational institution. Authorities arrested three individuals — one Thai national, Mrs. Pratumthip (surname withheld), and two Iranian nationals, MR. AIDIN and MS. NEGAR, who are company directors — for legal proceedings in accordance with relevant laws.
At present, the Immigration Bureau continues to intensify investigations, suppression operations, and preventive measures against foreign nationals exhibiting inappropriate behavior while residing in Thailand or engaging in all forms of illegal activities that threaten public peace, safety of life and property, and damage the country’s image. Authorities are also continuing efforts to crack down on offenders and deport them from the Kingdom without delay.
สตม. ลงพื้นที่ตรวจสอบข้อเท็จจริงกรณีชาวต่างชาติยึดพื้นที่เกาะพะงันทำธุรกิจนอมินี
จากกรณีที่มีนำเสนอข่าวว่าชาวต่างชาติเข้ามาอาศัยอยู่ในประเทศไทยเป็นจำนวนมาก โดยอาจจะแอบแฝงประกอบอาชีพ หรือทำธุรกิจในลักษณะนอมินี ตลอดจนมีการเปิดโรงเรียนสอนนักเรียนต่างชาติโดยไม่ได้รับอนุญาต โดยเฉพาะในพื้นที่เกาะพะงัน จ.สุราษฎร์ธานี ตั้งแต่เมื่อช่วงต้นเดือน พ.ค. ที่ผ่านมา
สตม. ได้ร่วมกับหน่วยงานภาครัฐในพื้นที่ จ.สุราษฎร์ธานี ประชุม หารือ เพื่อดำเนินการตรวจสอบข้อเท็จจริงดังกล่าว พบว่า สถิติบุคคลต่างด้าวที่มิใช่นักท่องเที่ยว ซึ่งได้ขออยู่ต่อในราชอาณาจักรชั่วคราวโดยมีการอนุญาตมากกว่า 30 วัน และการอนุญาตยังไม่สิ้นสุดในพื้นที่ อ.เกาะพะงัน จว.สุราษฎร์ธานี มีจำนวน 2,641 ราย แบ่งเป็นสัญชาติอิสราเอล จำนวน 369 คน, รัสเซีย จำนวน 335 คน, บริติช จำนวน 291 คน, ฝรั่งเศส จำนวน 283 คน, เยอรมัน จำนวน 210 คน และสัญชาติอื่น ๆ จำนวน 1,153 คน
ส่วนของสถิติการดำเนินคดีกับคนต่างด้าวในพื้นที่ สภ.เกาะพะงัน จว.สุราษฎร์ธานี ตั้งแต่วันที่ 1 ม.ค.69 เป็นต้นมา มีจำนวนทั้งหมด 141 คน แบ่งเป็นสัญชาติเมียนมา จำนวน 47 คน, อิสราเอล จำนวน 16 คน, รัสเซีย จำนวน 13 คน, อเมริกา จำนวน 8 คน, เยอรมัน จำนวน 7 คน และสัญชาติอื่น ๆ จำนวน 50 คน ซึ่งเป็นคดีจราจร คดีเกี่ยวกับ พ.ร.บ.ยาเสพติด พ.ร.บ.การทำงานของคนต่างด้าว เป็นต้น โดยพบว่า ตั้งแต่ ปี 2567 ถึงปัจจุบัน มีการดำเนินคดีกับคนไทยที่เป็นตัวแทน (นอมินี) ไปทั้งสิ้น จำนวน 23 คดี ได้แก่ บริษัทที่มีผู้ถือหุ้นเป็นบุคคลสัญชาติอิสราเอล จำนวน 9 คดี, รัสเซีย จำนวน 3 คดี, ฝรั่งเศส จำนวน 3 คดี, อเมริกา จำนวน 2 คดี และสัญชาติอื่น ๆ จำนวน 6 คดี
สตม. ยังได้ร่วมกับเจ้าหน้าที่หน่วยงานภาครัฐในพื้นที่เกาะพะงัน ประกอบด้วย สภ.เกาะพะงัน, กก.สส.ภ.จว.สุราษฎร์ธานี, ฝ่ายปกครองอำเภอเกาะพะงัน และเจ้าหน้าที่ทหาร กอ.รมน.ภาค 4 ตรวจสอบสถานประกอบการที่มีการดำเนินกิจการเป็นสถานรับเลี้ยงเด็ก และโรงเรียนเอกชนหลายแห่ง อาทิ สถานรับเลี้ยงเด็ก ชยุต, บริษัท เวิลด์ อาบันแดนซ์ และ บริษัท คิดดี้ เวิร์ล พร็อพเพอร์ตี้ ไม่พบการกระทำความผิด
สถานรับเลี้ยงเด็ก ARKI KIDS และเป็นโรงเรียนเอกชนสอนภาษานอกระบบ ARKI KIDS LANGUAGE SCHOOL โดยบริษัท อาร์กิ คิดส์ จำกัด ซึ่งเปิดรับเด็กตั้งแต่อายุ 3 – 12 ปี มีการสอนวาดภาพ ร้องเพลง ทำกิจกรรมเด็กเล็ก และออกกำลังกาย มีเด็กที่เข้ามาเรียน จำนวน 144 คน แบ่งเป็นสัญชาติอิสราเอล จำนวน 122 คน, เยอรมัน จำนวน 2 คน, ฝรั่งเศส จำนวน 2 คน, และสัญชาติอื่น ๆ จำนวน 18 คน พบการกระทำความผิดในข้อหาเป็นนายจ้างรับคนต่างด้าวเข้ามาทำงานโดยที่คนต่างด้าวไม่มีใบอนุญาต, เป็นนายจ้างไม่แจ้งคนต่างด้าวเข้าทำงานให้นายทะเบียนทราบภายใน 15 วัน นับแต่วันที่จ้าง, เป็นเจ้าของสถานรับเลี้ยงเด็ก ไม่ปฏิบัติตาม พ.ร.บ.คุ้มครองเด็ก พ.ศ.2546 และจัดตั้งโรงเรียนเอกชนนอกระบบโดยไม่ได้รับอนุญาต โดยจับกุมคนไทย และคนต่างด้าว 3 ราย ได้แก่ นางประทุมทิพย์ (สงวนนามสกุล), MR.AIDIN และ MS.NEGAR สัญชาติอิหร่าน กรรมการบริษัท ส่งดำเนินคดีตามกฎหมายที่เกี่ยวข้อง
ปัจจุบัน สตม. ยังคงเดินหน้าสืบสวน ปราบปราม สกัดกั้นมิให้คนต่างด้าวที่มีพฤติกรรมไม่เหมาะสมในขณะที่พำนักอาศัยอยู่ในประเทศไทย หรือเข้ามากระทำผิดกฎหมายทุกรูปแบบ ก่อเหตุอันตรายต่อความสงบสุขและความปลอดภัยในชีวิตและทรัพย์สินของประชาชน ทำให้เกิดความเสียหายต่อภาพลักษณ์ของประเทศ พร้อมกวาดล้างและผลักดันออกนอกประเทศทันที
