Federal Antimonopoly Service of the Russian Federation Welcome to the official FAS's account for public news! National history of competition authorities coincides with formation of the New Russia.

In times of change and country’s transition to the market economy the first antimonopoly authority was established. Since then, antimonopoly authorities were changing their structure and names, however, their goal remained the same - protection of competition. Therefore, each of these authorities greatly contributed to a more sustainable economy in Russia. In 2004, the Federal Antimonopoly Service

was established. At present, alongside the traditional functions of antimonopoly authority it has other additional powers, such as control over observing competition rules by the public authorities, control over public procurement, including the sphere of defense and security, control over foreign investments and advertising law compliance. The development of antimonopoly regulation contributed to a constant improvement of legislation, gaining experience, unification of enforcement. This 25 years of huge work resulted in changes in production relations in the entire sectors of the economy and recognition of the Russian antimonopoly policy as compliant with the high global standards. We still have a lot of work to do, many interesting and important challenges in competition development related matters. I wish all of us achieving of stated objectives and power for effective work to the benefit of Russia!

The purpose of the document is to streamline BRICS efforts towards developing and strengthening cooperation in competition law and policy between the parties through information and experience exchange.

On 19 May 2016, at the VI Petersburg International Legal Forum representatives of the antimonopoly bodies of the Russian Federation and the People’s Republic of China signed a Joint Statement.

It coincides with the 20th anniversary of signing the Agreement between the Government of the People’s Republic of China and the Government of the Russian Federation on Cooperation in the Field of Countering Unfair Competition and Antimonopoly Policy, ratified on 25 April 1996 in Beijing. On behalf of the Federal Antimonopoly Service (FAS Russia) the Declaration was signed by the Head of FAS Igor Artemiev, On behalf of China’s State Administration of Industry and Commerce (SAIC) – Vice Minister, Wang Jiangping.

On 17 May 2016 in St. Petersburg there was a Round Table: “The “forth antimonopoly package” in action: the regulator’s position and business questions”. The Round Table focused on the issues facing the antimonopoly authority and lawyers in applying the law and possible avenues for developing a new practice.

Deputy Head of the Federal Antimonopoly Service (FAS Russia), Sergey Puzyrevsky attended the event.

He outlined the new rules for investigating antimonopoly cases, unfair competition and expanding the mechanisms of preventing antimonopoly violations.

The final event of the Annual Competition Conference of the International Competition Network (ICN) in Singapore on 26 - 29 April 2016 was a plenary session where a FAS delegation lead by Deputy Head of FAS Andrey Tsyganov took part.

In the concluding remarks the President of ICN and the Head of Germany’s competition authority, Andreas Mundt, emphasized a colossal ICM progress in 15 years since ICN was created in both the number of the national antimonopoly bodies – ICN members that increased from 20 to 133, and the content of work and the quality of the results.

On 27 April 2016, the programme of the Annual Conference of the International Competition Network (ICN) in Singapore included a session of the Cartel Working Group that focused on strengthening cooperation between competition authorities. FAS experience in this field was presented by a member of the Non-Profit Partnership for Competition Support, Deputy Head of the Competition Law Department at Moscow State Law University, Denis Gavrilov.

He pointed out that FAS has accumulated significant experience of cooperation with foreign competition authorities in cartel investigations. Within the Eurasian Economic Union, to which Russia is a member, there are two levels of cooperation: directly between the competition authorities of the EAEU member-states, and between the competition authorities through the Eurasian Economic Commission. The competition authorities and EEC have possibilities to exchange confidential information, carry out joint investigations, which are an especially important and efficient tool to suppress cartels, including cross-border cartels.

Deputy Head of FAS Anatoly Golomolzin had a meeting with representatives of Chinese business and mass media led by the Editor-in-Chief of the “Energy News” newspaper, Se Shuts Zyan.

The parties emphasized the importance of productive cooperation between Russia and China in the field of antimonopoly cooperation. The competition authorities of Russia and China have a long history of both bilateral cooperation and under the frame of BRICS events.

On 19 April 2016, Deputy Head of FAS Andrey Kashevarov and representatives of FAS Department for Control over Advertising and Unfair Competition took part in the Round Table organized by the Corporate Counsel Association to discuss parallel import in Russia and EAEU, effects upon localization and new approaches to unfair competition.

Discussion concerned the list of goods for which FAS finds it necessary to introduce an international principle of exhausting rights: first of all, medicinal drugs and products and spare parts for cars.
