O Tráfico de Seres Humanos consiste no recrutamento e movimentação de pessoas entre diferentes países ou dentro de um mesmo país.
O crime é praticado através da violência, engano, abuso da vulnerabilidade da vítima, com o objetivo de a sujeitar a diversos tipos de exploração obtendo o/a criminoso/a um benefício económico com a exploração da vítima.
O crime de Tráfico de Pessoas, previsto no artigo 160º Código Penal português, é constituído por três elementos que o caracterizam: a ação, o meio e o fim, como vemos na tabela. No caso de a vítima ser menor, não é necessário a presença do “meio”.
O consentimento da(s) vítima(s) é irrelevante, uma vez que o/a agressor/a obtém o seu consentimento através da coação. Para que exista este crime não é necessário que se chegue mesmo a explorar a vítima, sendo suficiente a existência da intenção de o fazer, por parte do/a agressor/a. Comete também este crime quem utilizar os serviços de uma vítima tendo conhecimento da situação.

Human Trafficking consists of recruiting and moving people between different countries or within the same country.
The crime is committed through violence, deception, abuse of the victim's vulnerability, with the ultimate objective of subjecting them to various types of exploitation, obtaining the criminal an economic benefit from the exploitation.
The crime of Human Trafficking, forseen in article 160 of the Portuguese Penal Code, it’s made up of three elements that characterize it: the action, the means and the end, as we see in the table. If the victim is a minor, the presence of the means isn’t necessary.
The consent of the victim(s) is irrelevant, as the perpetrator obtains their consent through coercion. For there to be a crime, it’s not necessary to even exploit the victim, the existence of the intention to do so on the part of the aggressor being sufficient. Anyone who uses the services of a victim when aware of the situation also commits this crime.
