It has been observed that certain institutions continue to raise questions regarding the applicability of the regulatory framework of the Higher Education Regulatory Authority (HERA), particularly in matters where professional councils are also involved.
In this regard, it is reiterated that HERA is the statutory provincial regulatory authority mandated to ensure registration, governance oversight, and compliance of all private higher education institutions operating within Khyber Pakhtunkhwa, in accordance with the relevant laws and ordinances in force.
While professional councils may regulate curriculum standards, licensing, and professional accreditation within their respective domains, such oversight does not exempt institutions from obtaining mandatory registration and fulfilling statutory requirements under the provincial regulatory framework.
It is also important to note that the Higher Education Commission (HEC), being the apex federal body in the higher education sector, issues policy directions and standing instructions which are binding and carry institutional authority across the country. Compliance with both federal standards and provincial regulatory requirements ensures institutional legitimacy and protects students’ academic interests.
The recent legal proceedings initiated by certain nursing colleges have already clarified the position under law. Repeated resort to litigation on settled matters not only diverts valuable institutional resources but also disrupts academic focus. Institutions are therefore advised to avoid unnecessary legal proceedings and instead concentrate their efforts on strengthening governance, academic quality, student welfare, and professional excellence.

You are encouraged to ensure full compliance with applicable rules and regulations in letter and spirit, so that the collective objective of providing quality education to our students may be achieved without avoidable complications.
