اين سي سي آءِ اي جي سوالن جو مدلل، قانوني ۽ آئيني جواب

مان، اياز لطيف پليجو، ايڊووڪيٽ سپريم ڪورٽ آف پاڪستان، آئيني قانون جو ماهر ۽ صدر قومي عوامي تحريڪ، اين سي سي آءِ اي ڪراچي جي ٿاڻي ۾ داخل انڪوائري نمبر 1399/2026 جي سلسلي ۾ اوهان جي سوالنامي جو هي جواب پيش ڪريان ٿو.
شروعات ۾ رڪارڊ تي آڻڻ چاهيان ٿو ته مان 10-08-2026 تي منجهند جو 3 وڳي گلستانِ جوهر، ڪراچي ۾ NCCIA جي جاچ اداري آڏو حاضر ٿيو هئس، جيڪو اوهان جي ڪال اپ نوٽيس نمبر NCCIA/KHI/ENQ-1399/2026/11162، مورخہ 07-08-2026 جي تعميل ۾ هو. مان آئين ۽ قانون مطابق هر جائز تعاون ڪرڻ لاءِ تيار آهيان.
بهرحال، سوالنامي ۾ مبينا شڪايت يا ڏوهه جا بنيادي تفصيل موجود ناهن، جن ۾:
مبينا تقرير جي تاريخ ۽ وقت؛
تقرير جي جاءِ يا هنڌ؛
اهو موقعو، تقريب يا پسمنظر جنهن ۾ تقرير ڪئي وئي؛
مڪمل تقرير يا ان جو ٽرانسڪرپٽ؛
اهي مخصوص لفظ جيڪي مبينا طور ڏوهه بڻجن ٿا؛
اداري وٽ موجود وڊيو يا آڊيو رڪارڊنگ؛
اهو سوشل ميڊيا اڪائونٽ يا پليٽ فارم جتان مواد حاصل ڪيو ويو؛
لاڳاپيل URL، لنڪ يا پوسٽ؛
مبينا مواد اپلوڊ ٿيڻ جي تاريخ؛
جيڪڏهن ڪو شڪايت ڪندڙ آهي ته ان جي سڃاڻپ؛
مبينا ڏوهه جا صحيح قانوني جزا.
ان جي بدران سوالنامي ۾ مبهم انداز اختيار ڪندي بار بار ”مٿي ڄاڻايل سوشل ميڊيا ڳالهه“، ”اوهان جي تقرير“، ”اوهان جو بيان“ ۽ ”رڪارڊ ٿيل تقرير“ جهڙا لفظ استعمال ڪيا ويا آهن، پر اها وضاحت ناهي ڪئي وئي ته ڪهڙي مخصوص تقرير جي جاچ ٿي رهي آهي.
اهڙين حالتن ۾ مون کان اها اميد رکڻ مناسب ناهي ته مان ڪنهن اڻڄاتل تقرير يا بيان جي سڃاڻپ ڪريان يا اندازو لڳايان، خاص طور تي ان ڪري ته منهنجي ڊگهي سياسي ۽ عوامي زندگي دوران مون ڪيتريون ئي سياسي تقريرون ۽ خطاب ڪيا آهن.
معزز سپريم ڪورٽ آف پاڪستان Ammad Yousaf v. The State, 2024 PLD 273 SC ۾ قرار ڏنو آهي ته شهرين کي سياسي ۽ سماجي انصاف ۽ اظهارِ راءِ ۽ سوچ جي آزادي جو حق حاصل آهي. سپريم ڪورٽ خاص طور تي مشاهدو ڪيو ته بنا مضبوط بنياد جي ڪنهن سوچ کي ”رياست مخالف“ قرار ڏيڻ ۽ شهرين خلاف بدنظميءَ تي ٻڌل يا بي بنياد ڪارروائي ڪرڻ بنيادي حقن کي نقصان پهچائي ٿو.
سپريم ڪورٽ اهو به تسليم ڪيو آهي ته اظهارِ راءِ جي آزادي ۾ اهڙو اظهار به شامل آهي جيڪو رياست يا سماج جي ڪنهن حصي کي ناگوار، ڇرڪائيندڙ يا پريشان ڪندڙ محسوس ٿي سگهي ٿو.
تنهن ڪري سياسي تنقيد، حڪومتي پاليسين سان اختلاف، سنڌ ۽ پاڪستان بابت تاريخي يا آئيني سوالن تي بحث، پاڪستان ۽ سنڌ جي عوام جي بنيادي، آئيني ۽ سياسي حقن لاءِ آواز اٿارڻ يا سياسي ۽ جمهوري سڌارن جي ڳالهه کي صرف ”رياست مخالف“ قرار ڏئي فوجداري ڏوهه ۾ تبديل نٿو ڪري سگهجي.
1. مهرباني ڪري پنهنجو مڪمل نالو، ڄمڻ جي تاريخ، شناختي ڪارڊ نمبر، رابطي جو نمبر، پتا، عهدو ۽ موجوده وابستگي ٻڌايو.

2. ڇا اوهان ڪنهن سياسي، قومپرست، سماجي يا ٻي تنظيم سان وابسته آهيو؟
ها. مان قومي عوامي تحريڪ جو صدر آهيان، جيڪا سنڌ ۽ پاڪستان جي عوام جي سياسي، سماجي، معاشي، ثقافتي ۽ آئيني حقن لاءِ جدوجهد ڪري ٿي.
قومي عوامي تحريڪ جمهوريت، آئين جي بالادستي، قانون جي حڪمراني، صوبائي خودمختياري، سماجي انصاف، برابري، امن، انصاف، عورتن، نوجوانن، اقليتن، هارين، مزدورن ۽ ٻارن جي حقن، ۽ سنڌي ٻولي ۽ ثقافت سميت پاڪستان جي سمورين ٻولين ۽ ثقافتن جي تحفظ تي زور ڏئي ٿي.
قومي عوامي تحريڪ سياسي ۽ جمهوري سرگرمين، عوامي گڏجاڻين، ريليون، آگاهي مهمن، چونڊن ۽ سنڌ ۽ پاڪستان سان لاڳاپيل مسئلن بابت تحريڪن ۾ حصو وٺندي آهي.
اسان جا مسئلا صرف سنڌين تائين محدود ناهن، پر سمورن پاڪستانين سان لاڳاپيل آهن، جن ۾ عورتن جا حق، ٻهراڙيءَ جي عوام لاءِ بنيادي سهولتن جي کوٽ، سنڌ ۾ ڪرپشن ۽ آمرانه طرزِ عمل، هر ڪنڊ ۾ تعليم، صاف ۽ پيئڻ جو پاڻي ۽ بهتر صحت جو نظام شامل آهن.
منهنجي سياسي وابستگي پاڪستان جي آئين جي آرٽيڪل 16 ۽ 17 ۽ لاڳو قانونن مطابق قانوني ۽ جائز آهي.
3. مٿي ڄاڻايل سوشل ميڊيا ڳالهه جو مقصد ۽ موضوع ڇا هو؟
مون کي اڃا تائين اهو نه ٻڌايو ويو آهي ته ڪهڙي مخصوص سوشل ميڊيا ڳالهه هن انڪوائري جو موضوع آهي.
اوهان مخصوص ڳالهه جي تاريخ، هنڌ، پليٽ فارم، URL، رڪارڊنگ يا ٽرانسڪرپٽ فراهم ناهي ڪيو. تنهن ڪري اوهان طرفان گهربل مواد فراهم ڪرڻ کان سواءِ مان ذميواري سان اهو نٿو ٻڌائي سگهان ته سوال ۾ ڪهڙي تقرير ڏانهن اشارو آهي.
4. ڇا اوهان جي تقرير جو مقصد سنڌ جي ڪنهن خاص گروهه يا برادري ۾ خوف، بدامني، دشمني يا تڪرار پيدا ڪرڻ هو؟
اوهان جي آفيس مون کي اڃا تائين اها مخصوص تقرير ۽ ان جي تاريخ نه ٻڌائي آهي، جنهن جي بنياد تي هي انڪوائري شروع ڪئي وئي آهي.
بهرحال، واضح طور چوان ٿو ته منهنجي ڪنهن به تقرير جو مقصد ڪنهن مخصوص گروهه ۾ خوف، بدامني، دشمني يا تڪرار پيدا ڪرڻ ناهي.
منهنجون تقريرون ۽ ميڊيا ڳالهيون هميشه سنڌ ۽ پاڪستان جي شاگردن، هارين، عورتن ۽ پورهيت طبقي کي همٿائڻ ۽ متحرڪ ڪرڻ لاءِ رهيون آهن.
هڪ قانون پسند ۽ امن پسند پاڪستاني شهري طور منهنجي تقريرن جو مقصد سنڌ ۽ پاڪستان جي عوام ۾ اميد پيدا ڪرڻ، انهن کي بهتر مستقبل لاءِ جدوجهد جي ترغيب ڏيڻ، انهن کي سندن آئيني حقن کان آگاهه ڪرڻ ۽ اتحاد، تعليم ۽ شعور کي هٿي ڏيڻ آهي.
مان هميشه اتحاد جو پيغام ڏنو آهي. مان پاڪستان جي سمورين قومن، طبقن، برادرين ۽ گروهن کي پنهنجا ساٿي شهري، ڀائر ۽ ڀينر سمجهان ٿو ۽ هميشه چيو آهي ته نسلي، لساني يا ثقافتي اختلافن کي اسان جي وطن جو امن ۽ هم آهنگي تباهه ڪرڻ نه ڏجي.
5. اوهان جي تقرير ۾ چيو ويو ته ”هو شيون ساڙڻ چاهي ٿو.“ ان مان اوهان جي ڇا مراد هئي؟
جيڪڏهن ادارو اهڙن لفظن تي ڀاڙي ٿو ته مهرباني ڪري مڪمل ۽ غير ايڊٽ ٿيل آڊيو/وڊيو رڪارڊنگ ۽ ٽرانسڪرپٽ فراهم ڪيو وڃي، جنهن ۾ مبينا جملي کان اڳ ۽ پوءِ جا جملا پڻ شامل هجن.
10-08-2026 تي جڏهن مان اوهان جي سيڪشن 160 CrPC تحت جاري ڪيل نوٽيس جي جواب ۾ اوهان جي آفيس ۾ حاضر ٿيس، تڏهن مون بار بار درخواست ڪئي ته مبينا تقرير يا ميڊيا ڳالهه مون کي ڏيکاري وڃي، پر منهنجون درخواستون رد ڪيون ويون.
مان واضح طور چوان ٿو ته منهنجي ڪنهن به سياسي بيان جو مقصد تشدد، باهه لڳائڻ يا ڪنهن ٻئي غيرقانوني سرگرمي جي حوصلا افزائي ڪرڻ نه هو.
اهي الزام بي بنياد، فضول ۽ من گهڙت آهن ۽ سنڌين ۽ پاڪستانين جي آئيني طور ضمانت ڏنل بنيادي حقن جي ڀڃڪڙين خلاف منهنجي مضبوط موقف کي خاموش ڪرائڻ جي ڪوشش آهن.
6. اوهان الزام لڳايو ته 1947ع کان اڄ تائين سنڌ سان فراڊ ٿيو آهي. اوهان ڪهڙن واقعن ڏانهن اشارو ڪري رهيا هئا؟
جيئن ته اوهان جي آفيس مون کي ان تقرير يا ميڊيا ڳالهه جا تفصيل فراهم ناهن ڪيا، تنهن ڪري مان هن سوال جو جواب نٿو ڏئي سگهان.
مخصوص تقرير ڄاڻڻ کان سواءِ مان ڪيئن ٻڌائي سگهان ٿو ته مون ڇا چيو هو ۽ ان جو پسمنظر ڇا هو؟
تنهن ڪري ٻيهر درخواست آهي ته هن انڪوائري ۾ جنهن تقرير يا ميڊيا ڳالهه کي بنياد بڻايو ويو آهي، ان جا مڪمل تفصيل فراهم ڪيا وڃن.
بهرحال، مان اهو ضرور چوندس ته جمهوريت ۾ حڪومت، حڪمران پارٽين ۽ ووٽرن/عام عوام وچ ۾ هڪ سماجي معاهدو هوندو آهي.
پاڪستان امن، برابري ۽ انصاف جي خواب کي ساڀيان ڪرڻ لاءِ وجود ۾ آيو. سنڌ پاڪستان جي باني صوبن مان آهي.
شروعات کان وٺي سنڌ، بلوچستان، پنجاب ۽ خيبرپختونخواهه جي محروم عوام کي ترقي، صوبائي خودمختياري، انصاف، برابري، امن ۽ باعزت روزگار کان محروم رکيو ويو آهي.
گذريل ٽن چئن ڏهاڪن کان سنڌ جي نوجوانن کي ميرٽ کان محروم رکيو ويو آهي، نوڪريون وڪامڻ جا الزام آهن، زراعت تباهه ٿي رهي آهي، عورتون ڏکي زندگي گذاري رهيون آهن، مٿين سنڌ جا ڪيترائي ضلعا بدامني، غربت ۽ ڏوهن کي منهن ڏئي رهيا آهن.
هيٺين سنڌ ۾ پاڻي جي کوٽ، ڏڪار ۽ شديد غربت جا مسئلا آهن. ڪراچي، حيدرآباد، لاڙڪاڻو، ميرپورخاص ۽ سکر جهڙا شهر شهري سهولتن، بجلي، صاف پيئڻ جي پاڻي، نيڪال ۽ روزگار جي موقعن کان محروم آهن.
شهرن ۽ علائقن ۾ نسلي ۽ لساني بنيادن تي تڪرار ۽ سنڌ جي ورهاڱي جي منصوبن سبب بدامني پيدا ٿيڻ جا خدشا موجود آهن.
وفاقي ۽ صوبائي حڪومتن جي مختلف کاتن جا بجيٽ وڏيرن، سردارن، پيرن، بيوروڪريٽن، ناظمن، وزيرن، ايم پي ايز، ايم اين ايز ۽ سينيٽرن طرفان هڙپ ڪرڻ جا الزام لڳندا رهيا آهن.
آزاد ۽ منصفاڻي چونڊن جو حق متاثر ٿيو آهي ۽ مڪاني حڪومتن ۽ پوليس کي بااختيار نه بڻايو ويو آهي.
هڪ مهذب جمهوري دنيا ۾ مٿيان عمل شهرين/ووٽرن ۽ حڪمران حڪومتن وچ ۾ سماجي معاهدي جي ڀڃڪڙي تصور ڪيا وڃن ها.
7. تقريب ڪنهن منعقد ڪئي ۽ اوهان کي خطاب لاءِ ڪنهن دعوت ڏني؟
مخصوص تقرير يا ميڊيا ڳالهه جي سڃاڻپ کان سواءِ اهو ٻڌائڻ ممڪن ناهي ته اها تقريب ڪڏهن ۽ ڪنهن منعقد ڪئي هئي.
هڪ سياسي اڳواڻ ۽ موٽيويشنل اسپيڪر طور مون کي سڄي سال سوين تقريبن ۾ شاگردن جي حوصلا افزائي ۽ انساني ۽ بنيادي حقن بابت ڳالهائڻ لاءِ دعوتون ملنديون آهن.
تنهن ڪري اوهان جي مخصوص تقريب جي سڃاڻپ کان سواءِ جواب ڏيڻ ائين هوندو جيئن گاهه جي ڍير ۾ سئي ڳولڻ.
8. ڇا اوهان تقرير پاڻ تيار ڪئي هئي؟
مخصوص تقرير يا ميڊيا ڳالهه ۽ ان جي تاريخ کان بي خبر هجڻ سبب هن وقت صحيح جواب ڏيڻ ممڪن ناهي.
مان آئيني قانون جو وڪيل، سياسي اڳواڻ ۽ عوامي مقرر آهيان. مون کي سياسي گڏجاڻين، تعليمي ڪانفرنسن، انساني حقن جي ڪانفرنسن ۽ ادبي ڪانفرنسن سميت سوين مختلف تقريبن ۾ دعوت ڏني ويندي آهي، جن جا موضوع هڪ ٻئي کان مختلف هوندا آهن.
تنهن ڪري درخواست آهي ته اوهان جنهن تقرير يا سوشل ميڊيا ڳالهه جو حوالو ڏئي رهيا آهيو، ان جا مڪمل تفصيل فراهم ڪريو.
9. ڇا اوهان رڪارڊ ٿيل تقرير ۾ اهي بيان ڏنا هئا؟
10-08-2026 تي اوهان جي آفيس ۾ بار بار درخواست ڪرڻ باوجود مون کي ڪا رڪارڊ ٿيل تقرير نه ڏيکاري وئي.
تنهن ڪري مان هن سوال جو جواب نٿو ڏئي سگهان.
مهرباني ڪري اداري وٽ موجود اصل مڪمل رڪارڊنگ، ان جو ذريعو، تاريخ، پليٽ فارم ۽ ٻيا لاڳاپيل تفصيل فراهم ڪيا وڃن، جنهن کان پوءِ مان مناسب جواب ڏيندس.
10. ڇا اوهان تصديق ڪريو ٿا ته وڊيو/آڊيو رڪارڊنگ بغير ڪنهن تبديلي جي اوهان جي تقرير جي صحيح نمائندگي ڪري ٿي؟
اهڙي رڪارڊنگ جيڪا مون کي فراهم ئي نه ڪئي وئي هجي، ان جي صداقت، مڪمل هجڻ يا ان ۾ تبديلي نه ٿيڻ بابت ذميواري سان ڪو نتيجو نٿو ڏئي سگهجي.
11. ڇا اوهان کي انهن سوشل ميڊيا اڪائونٽن تائين رسائي ۽ ڪنٽرول حاصل آهي؟
مون کي اڃا تائين اهو نه ٻڌايو ويو آهي ته اوهان ڪهڙن سوشل ميڊيا اڪائونٽن ڏانهن اشارو ڪري رهيا آهيو.
مون ڪيترائي ڀيرا اوهان جي آفيس کان پڇيو، پر هن انڪوائري سان لاڳاپيل ڪو ثبوت فراهم نه ڪيو ويو.
تنهن ڪري NCCIA کان درخواست آهي ته لاڳاپيل اڪائونٽ، پليٽ فارم، اڪائونٽ جو نالو، URL ۽ اهو مخصوص مواد ٻڌايو وڃي جنهن تي ڀروسو ڪيو ويو آهي.
12. مواد ڪڏهن ۽ ڪهڙي ڊوائيس/هنڌ تان اپلوڊ ڪيو ويو؟
مخصوص تقرير، ان جي تاريخ ۽ لاڳاپيل مواد جي سڃاڻپ کان سواءِ هن سوال جو جواب ڏيڻ ممڪن ناهي.
مون کي ڪو اهڙو اليڪٽرانڪ رڪارڊ يا فارنزڪ مواد فراهم نه ڪيو ويو آهي، جنهن مان مبينا مواد اپلوڊ ٿيڻ جي تاريخ، وقت، ڊوائيس يا هنڌ ثابت ٿئي.
13. ڇا اوهان پوءِ اهو مواد ڪنهن ٻئي اڪائونٽ يا پليٽ فارم ذريعي شيئر، ري پوسٽ، فارورڊ يا پروموٽ ڪيو؟
جيستائين اوهان اهو واضح نه ڪندا ته ڪهڙي مخصوص تقرير يا ميڊيا ڳالهه ۽ ڪهڙي تاريخ جي مواد جو حوالو ڏنو پيو وڃي، مان هن سوال جو جواب نٿو ڏئي سگهان.
14. ڇا اوهان مواد اپلوڊ يا شيئر ڪرڻ وقت ڪيپشن، هيش ٽيگ، ڪمينٽ يا ٻيو متن شامل ڪيو؟
NCCIA طرفان مخصوص مواد، اڪائونٽ ۽ اپلوڊ جي سڃاڻپ نه ڪرائي وئي آهي، تنهن ڪري صحيح جواب ڏيڻ ممڪن ناهي.
بهرحال، منهنجي طرفان پوسٽ ڪيل وڊيوز تي عام طور صرف هڪ هيش ٽيگ هوندو آهي:
15. ڇا اوهان جو مقصد تقرير ذريعي ڪنهن خاص سرگرمي جي حوصلا افزائي، حمايت، اشتعال يا اثراندازي ڪرڻ هو؟
منهنجو مقصد ڪنهن به غيرقانوني يا پرتشدد سرگرمي جي حوصلا افزائي، حمايت يا اشتعال پيدا ڪرڻ نه هو.
منهنجون سياسي ۽ عوامي تقريرون سنڌ جي عام ماڻهن، عورتن، هارين، مزدورن، وچولي طبقي ۽ نوجوانن کي سندن انساني، آئيني، بنيادي، سياسي ۽ قومي حقن، تعليمي موقعن ۽ اجتماعي حقن لاءِ پرامن جدوجهد جي حوصلا افزائي ڪرڻ لاءِ هونديون آهن.
جيڪڏهن اوهان جي اداري جو الزام ان جي ابتڙ آهي ته مهرباني ڪري اهي مخصوص لفظ، پسمنظر ۽ ثبوت ٻڌايا وڃن جن جي بنياد تي اهو الزام لڳايو ويو آهي.
16. ڇا اوهان کي ڪنهن ٻئي شخص يا تنظيم طرفان تقرير جي مواد بابت هدايتون مليون هيون؟
مان هڪ قانون پسند ۽ امن پسند پاڪستاني شهري، ڪارڪن، استاد، سياسي اڳواڻ، ليکڪ، سپريم ڪورٽ جو وڪيل، آئيني ۽ انساني حقن جو قانوندان ۽ عوامي مقرر آهيان.
مون کي سڄي سال شاگردن، وڪيلن، هارين، عورتن ۽ عام ماڻهن جي حوصلا افزائي لاءِ سوين تقريبن ۾ دعوتون ملنديون آهن.
مختلف تقريبن جا موضوع به مختلف هوندا آهن، تنهن ڪري مخصوص تقرير ۽ مبينا مواد جي سڃاڻپ کان سواءِ بامعنيٰ جواب ڏيڻ ممڪن ناهي.
17. ڇا ڪنهن اوهان جي وڊيو رڪارڊ ڪرڻ، ايڊٽ ڪرڻ، اپلوڊ ڪرڻ يا ڦهلائڻ ۾ مدد ڪئي؟
هڪ سياسي اڳواڻ، سپريم ڪورٽ جو وڪيل، آئيني قانوندان ۽ عوامي مقرر هجڻ جي حيثيت سان مون کي مختلف شاگرد تنظيمن، تعليمي ادارن، مزدور تنظيمن، بار ايسوسيئيشنن، سياسي ڪانفرنسن ۽ انساني حقن جي ڪانفرنسن ۾ دعوتون ملنديون آهن.
منهنجي سياسي پارٽي قومي عوامي تحريڪ پڻ جلسا، ريليون ۽ مختلف پروگرام منعقد ڪندي آهي.
انهن تقريبن ۾ منتظمين جون پنهنجون ميڊيا ٽيمون هونديون آهن، جيڪي وڊيو رڪارڊ ۽ ايڊٽ ڪنديون آهن.
تنهن ڪري مخصوص تقرير جي تاريخ ۽ وقت ڄاڻڻ کان سواءِ صحيح جواب ڏيڻ ممڪن ناهي.
18. تقرير، ان جي اشاعت يا سوشل ميڊيا تي ڦهلاءَ بابت اوهان ٻيو ڪجهه چوڻ چاهيو ٿا؟
مان ٻيهر واضح ڪريان ٿو ته مان پاڪستان جو قانون پسند ۽ امن پسند شهري، سپريم ڪورٽ آف پاڪستان جو ايڊووڪيٽ، انساني حقن جو قانوندان ۽ سياسي اڳواڻ آهيان.
مان متحد ۽ مضبوط سنڌ ۽ پاڪستان تي يقين رکان ٿو.
مان ڪرپشن، خراب حڪمراني، انساني حقن جي ڀڃڪڙي، امتياز، بدامني، قدرتي وسيلن جي ڦرلٽ ۽ سنڌ کي ورهائڻ جي منصوبن خلاف آهيان.
منهنجون سياسي سرگرميون ۽ عوامي تقريرون پاڪستان جي آئين جي آرٽيڪل 19 تحت حاصل آئيني ۽ بنيادي حقن ۽ ذميوارين جي استعمال ۾ ڪيون وينديون آهن.

Statement/ Response by Ayaz Latif Palijo to NCCIA.
I, Ayaz Latif Palijo, Advocate Supreme Court of Pakistan, Constitutional Lawyer and President of Qomi Awami Tehreek, submit this response to your questionnaire in connection to Enquiry No. 1399/2026 of P.S National Cyber Crime Investigation Agency, (NCCIA) Karachi.
At the outset, I would like to bring it on record that I have appeared before the investigation Agency, NCCIA, Gulistan-e-Johar, Karachi on 10-08-2026 at 3 pm in compliance with the Call Up Notice No. NCCIA/KHI/ENQ- 1399/2026/11162 dated 07-08-2026 and am willing to extend every lawful cooperation in accordance with the Constitution and law.
However, it is stated that the questionnaire does not disclose the basic particulars of the alleged complaint/offence, including:
I. the date and time of the alleged speech.
II. the place/venue where it was delivered.
III. the occasion/event/context at which it was delivered.
IV. the complete speech or transcript.
V. the specific words alleged to constitute an offence.
VI. the video/audio recording relied upon by the Agency.
VII. the social-media account/platform from which the material was allegedly obtained.
VIII. the URL/link or post in question.
IX. the date on which the alleged content was uploaded.
X. the identity of the complainant, if any.
XI. the precise ingredients of the alleged offence.
That the questionnaire instead opts for a vague approach and repeatedly refers to "the said social media talk", "your speech", "your statement" and "the recorded speech", without identifying which particular speech is under enquiry.
In these circumstances, I cannot reasonably be expected to identify or speculate about an unidentified speech or statement, particularly when I have delivered numerous political speeches and addresses over a long period of public and political life.
The Honorable Supreme Court of Pakistan in Ammad Yousaf v. The State, 2024 PLD 273 SC has observed that citizens have the right of political and social justice and freedom of speech and thought. The Honorable Supreme Court specifically observed that describing thoughts as "anti-State" without substantive basis and subjecting citizens to malicious or frivolous prosecution undermines fundamental rights.
That the Honorable Supreme Court has further recognized that freedom of expression extends to expression which may offend, shock or disturb the State or sections of society.
Accordingly, political criticism, disagreement with governmental policies, discussion of historical or constitutional questions concerning Sindh and Pakistan, or advocacy for basic fundamental and political rights and necessities for the people of Pakistan and Sindh, political and democratic reforms cannot be converted into a criminal offence by merely terming them as “Anti-State”.

Yes, I am the President of Qomi Awami Tahreek, which advocates for the political, social, economic, cultural, and constitutional rights of the people of Sindh and Pakistan. The platform of QAT emphasizes democracy, constitutional supremacy, rule of law, provincial autonomy, social justice, equality, peace, justice, rights of women, youth, minorities, farmer, labor and children, and the protection of Sindhi language and culture and all other languages and cultures. QAT participates in political and democratic activities, including public gatherings, rallies, advocacy campaigns, elections, and movements concerning issues affecting Sindh and Pakistan. We focus on problems that affect not just Sindhis, but Pakistanis as a whole, from women rights to lack of basic facilities for people in rural areas, corrupt and totalitarian practices across Sindh, the need for education in every corner of Pakistan, Clean and drinkable water, and a good healthcare system. My political association is lawful and is exercised in accordance with the Constitution of Pakistan (Art 16 & 17) and the applicable laws of Pakistan.
3. WHAT WAS THE PURPOSE AND SUBJECT OF THE SAID SOCIAL MEDIA TALK?
I have not yet been informed which exact social media talk is the center of this enquiry initiated against me. You have not yet identified the particular talk by its date, venue, platform, URL, recording or transcript therefore I cannot responsibly identify the particular speech to which the question refers without being supplied the material relied upon by the Agency.
4. DID YOU INTEND YOUR SPEECH TO CREATE FEAR, UNREST, HOSTILITY, OR CONFLICT AMONG ANY PARTICULAR GROUPS OR COMMUNITIES IN SINDH? IF YES, PLEASE EXPLAIN.
Your office has not informed me regarding the exact speech and date of the speech which has given rise to this enquiry but needless to say none of my speeches are intended to cause any fear, unrest, hostility or conflict among any particular group. My speeches/ media talks have always encouraged and motivated the students, peasants, women of Sindh and working-class people of Sindh and Pakistan. Being a law abiding and peace-loving citizen of Pakistan, the purpose of all my speeches is the same, to instill hope in the people of Sindh and Pakistan, to ask them to hope for a better tomorrow by making them aware of the fact that these miseries shouldn't be normalized, to promote Unity, Education, and awareness of their constitutional rights. I have always strived and sent a message of unity, I consider all nations, classes, communities and groups in Pakistan to be my fellow citizens, brothers and sisters, and have always insisted to not let any ethnic, language or cultural differences destroy the harmony of our motherland. I further submit that the question itself does not identify the particular statement, speech or material upon which this allegation is based.
5. IN YOUR SPEECH, YOU STATED HE WANTS TO SET THINGS ON FIRE. WHAT DID YOU MEAN BY THIS STATEMENT, WHOM WERE YOU REFERRING TO, AND WHAT SPECIFIC CIRCUMSTANCES OR INFORMATION LED YOU TO MAKE THIS STATEMENT?
If the Agency relies upon such words, it is requested to provide the complete unedited audio/video recording and transcript, including the sentences immediately preceding and following the alleged statement. Your office has not informed me regarding the speech/talk or the contents of such speech/talk despite the fact that I repeatedly requested your office to show me the said speech/media talk when I visited your office on 10-08-2026 in response to the call up notice issued by your office to me u/s 160 CrPC, but my requests were denied. I categorically state that I did not intend by any political statement to encourage the commission of violence, arson or any other criminal activity. That these allegations are baseless, frivolous and concocted entirely to silence my firm stand on the violation of fundamental rights of Sindhis and Pakistanis which have been guaranteed to them by the Constitution of Pakistan.

As your office has not provided me with any details of the speech/media talk that this enquiry is referring to I am unable to answer this question. That without first knowing which speech your office is refereeing to, how would I know what I had said and what was the context of such talk. Your office is thereby once again requested to share the details of the speech/media talk that is the focus point of this inquiry. But despite that I would like to add that In fact in a democracy there's a social contract between govt/ruling parties and the voters/general public. Pakistan was created to realize a dream of peace equality and justice. Sindh is the founder of Pakistan. From the very start, the oppressed people of Sindh, Balochistan, Punjab and Pakhtunkhwa have been denied development, provincial autonomy, justice, equality, peace, respectable livelihood and merit. For the last 3-4 decades the youth of Sindh has been denied merit, jobs are being sold, agriculture is being destroyed, women are living a miserable life, several districts of upper Sindh are facing lawlessness, poverty and crime, lower Sindh is facing an acute shortage of water, famine and extreme poverty due to denial of due share of Sindh's water, cities like Karachi, Hyderabad, Larkana, Mirpurkhas and Sukkur are denied civic facilities, amenities, electricity, clean drinking water, drainage and job opportunities, violent urban based ethnic/racist groups are allowed to create unrest, conflicts and chaos by promoting the nefarious plans of division of Sindh. The budget of all provincial and federal Government departments is being usurped by Feudals, Waderas, Sardars, Peers, Bureaucrats, Nazims, Ministers, MPAs, MNAs and Senators. Right to free and fair election has been denied, local governments and police are not empowered. In a civilised democratic world all above acts would have been considered as violation of social contract between citizens of Pakistan/voters and ruling governments.
7. WHO ORGANIZED THE EVENT AND INVITED YOU TO ADDRESS THE GATHERING?
Without knowing exactly which speech/media talk your office is referring to, it is impossible for me to ascertain when the event was organized and who organized it. Being a political leader and a motivational speaker, I am invited to hundreds of events throughout the year to motivate students and advocate for human and fundamental rights of the general public hence ascertaining which exact event your office has in mind will be like finding a needle in a haystack.

I did not intend to encourage, support or provoke any unlawful or violent activity. My political and public speeches are intended to only encourage the common people, women, farmers, laborers, middle class and the youth of Sindh to pursue their human, constitutional, fundamental, political and national rights, educational opportunities and to advocate for the collective rights of people of Sindh. If your Agency has alleged otherwise, it is requested to identify the precise words, context and evidence upon which such allegation is based upon.
16. DID YOU RECEIVE ANY INSTRUCTIONS FROM ANOTHER PERSON OR ORGANIZATION REGARDING THE CONTENTS OF THE SPEECH?
Being a law abiding and peace loving citizen of Pakistan, an activist, a teacher, a political leader, writer, an advocate of Supreme Court, constitutional and human rights lawyer and a public speaker, I am invited to hundreds of events throughout the year to inspire and motivate students, lawyers, peasants, women and the general public and the topics of discussion vary from event to event and without identification of the particular speech and the alleged material, I cannot provide a meaningful response.
17. DID ANYONE ASSIST YOU IN RECORDING, EDITING, UPLOADING, OR DISSEMINATING THE VIDEO?
Being a political leader, Advocate of Supreme Court, constitutional lawyer and a public speaker, I am invited to hundreds of events which are organized by various student and education foundations/organizations including educational institutes, labor organizations and bars and I am also invited to political conferences and human rights conferences and my political party Qomi Awami Tahreek also organizes jalsas, rallies and events. All events are of a varying nature and are organized by various different organizations and in such events the organizers have their own media team which records and edits videos. Therefore, without first knowing the exact date and time of the speech/media talk in question, I am unable to answer this question with accuracy.

I reiterate that I am a law abiding and peace-loving citizen of Pakistan, an Advocate of the Supreme Court of Pakistan, a human rights lawyer and a political leader. I believe in a united and strong Sindh and Pakistan. I am against corruption, bad governance, violation of human rights, discrimination, lawlessness, plunder of natural resources and division plans of Sindh. My political activities and public speeches are undertaken in exercise of my constitutional and fundamental rights and responsibilities as envisaged in Article 19 of the Constitution of Pakistan. I have always advocated my political views through democratic, legal, constitutional and peaceful means and I have never encouraged or supported any act of violence.
Furthermore, being an Advocate of Supreme Court of Pakistan, I strongly believe that this inquiry is an attempt to harass and silence me and an attempt to hamper my efforts to encourage and motivate the youth and masses of Sindh and to advocate for the human, constitutional, political and fundamental rights of the people of Sindh. That if such practices of harassment and illegal pressure continue, the national and international media and world forums will start viewing our country as a totalitarian and autocratic country which will not only affect the country’s economics, but will also affect the overall opinion of Pakistanis across the world. We are currently being viewed as peacemakers due to our country’s recent global efforts during the recent war and only through democracy, peace, protection of national, fundamental and constitutional rights, justice and equality among citizens regardless of their province, belief or language, will we as a country continue to prosper.
