This is one of the reasons why our City Mayor Mayor Maila Ting Que initiated and directed the City Legal Office to conduct seminar to our tricycle drivers with relevant laws particularly this โBawal Bastos Lawโ, to disseminate to them that even simple pambabastos can lead to guilty verdict. As of now, no tricycle driver is accused of violating this law. This reflects the positive impact of the seminar and its role in fostering better understanding with the laws to our tricycle drivers. | The Kidapawan City Regional Trial Court (RTC) branch 17 has convicted a tricycle driver for violating R.A. 11313 or the Safe Spaces Act, also known as the โBawal Bastos Law, for making inappropriate remarks to his passenger.
The offender reportedly harassed the passenger by making inappropriate remarks while doing sexual advances toward the victim. The passenger alleged that while they were traveling, the offender asked her if she had a boyfriend, adding, "If only I were single, I would court you," while simultaneously touching his elbow against the passenger's arm.
Signed into law on April 17, 2019, the Bawal Bastos Law, or the โSafe Spaces Act,โ penalizes gender-based sexual harassment in streets, public spaces, online, workplaces, and educational and training institutions. It includes unwanted and uninvited sexual actions or remarks against any person, regardless of the motive for committing such actions or remarks.
The person found guilty of violating the said law can face penalties ranging from community service, a fine of โฑ1,000 to 500,000, and imprisonment up to 12 years depending upon the discretion of the court and the gravity of the offense.
