As of September 4, 2026, Senator Rodante Marcoleta remains in law enforcement custody while facing legal proceedings before the Sandiganbayan. He is currently facing a non-bailable ₱75-million plunder charge and three related bailable offenses.

The critical updates regarding his legal and health status include:

© Bail on Minor Charges: On September 3, 2026, Marcoleta posted a total of ₱90,000 bail (₱30,000 for each of the three counts) before the First, Fourth, and Sixth Divisions of the Sandiganbayan. These charges stem from alleged violations of Presidential Decree No. 46, which bans public officials from receiving gifts.

© Plunder Case Detention: Because his primary case—a ₱75-million plunder charge tied to an undeclared campaign donation—is non-bailable, he remains detained. The Sandiganbayan Third Division previously ordered his commitment to the New Quezon City Jail in Barangay Payatas.

© Medical Furlough Granted: The Sandiganbayan Third Division approved a one-day medical furlough for September 7, 2026. This will allow Marcoleta to leave jail temporarily to undergo medical testing and seek specialized care at the Philippine General Hospital (PGH) for hypertension, dyslipidemia, and prostate enlargement. He must return to the Payatas facility within the same day.

Jurisdiction Dispute: During recent court hearings, Marcoleta’s defense team argued that the ₱75-million sum was a legitimate campaign contribution, meaning the case should fall under the jurisdiction of the Commission on Elections (Comelec) rather than the anti-graft court. The Sandiganbayan has submitted his motions to dismiss and his request to block a 90-day senate suspension for resolution.
