A RESOLUTION REVISING RESOLUTION NO. 3 S.Y. 2014-2015
WHEREAS, Sec. 6, Article X-C of the CSG Constitution mandates that it shall be the duty of the ELECOM to have the exclusive charge of the formulation, enforcement and administration of the rules and regulations relative to the conduct of elections……;
WHEREAS, in the interest of a clean and fair elections, the ELECOM sought it necessary to provide rules to be followed by the parties and/or independent candidates during the whole duration of the campaign period;
NOW, THEREFORE, the Commission resolves, as it is hereby resolved to adopt guidelines for the campaign materials, the display and distribution thereof and the conduct of any other forms of campaign activities.
REVISED GUIDELINES FOR THE CAMPAIGN MATERIALS, THE DISPLAY AND DISTRIBUTION THEREOF AND THE CONDUCT OF ANY OTHER FORMS OF CAMPAIGN ACTIVITIES
The following shall serve guidelines for the campaign materials, the display and distribution thereof and other forms of campaign activities:
A. Campaign Materials
1. Unless otherwise provided by the ELECOM, campaign materials per candidate or per political party shall be limited to the following:
a. Leaflets- one-fourth (1/4) or half (1/2) size of an 8.5” x 11” or 8.5” x 13” bondpaper;
b. Posters- not to exceed the size of a cartolina;
c. Tarpaulin- not to exceed 1 meter x 2 meters; and
d. Streamers- not to exceed 1 meter x 2 meters.
2. Unless otherwise provided by the ELECOM, campaign materials shall contain the following information:
a. Political party;
b. Candidate/s;
c. Qualifications of candidate/s;
d. Platform of government; and
e. Picture/s of candidate/s.
3. Other forms of campaign or political paraphernalia such as but not limited to ribbons, pins, bookmarks shall bear the approval of the ELECOM.
B. Campaigning
Public or private soliciting of votes for a particular candidate or slate of candidates shall only be in the period and manner allowed by the CSG Constitution or by the ELECOM.
Campaigning through the use of social media may be allowed provided that it won’t contravene paragraph D, section 41, Article VII of the Omnibus Election Code and shall not be in a form of a smear campaign, mudslinging or statements that will tend to becloud the reputation of a party or a candidate.
Campaigning and distribution of campaign paraphernalia shall be done only during the campaign period.
C. Designated Area for the Display of Campaign Materials
The CSG-ELECOM shall determine the area within the university campuses where a student candidate and/or his/her political party can put up campaign materials.
1. Campaign displays shall be limited to the assigned areas only; and
2. Unless otherwise provided by ELECOM, the following shall be designated as areas for campaign display:
a. High School Gym (National Only);
b. Student Lounges;
c. Scanlon Entrance (third floor);
d. Freinademetz & Scanlon Lobby (Forth Floor); and
e. Scanlon Building (first floor)
3. Only one standee shall be used by each political party to each designated area and that standee must be maximized for both national and local candidates of the said political party. Another standee is also allowed for independent candidate/s.
4. Materials to be displayed will be limited to the following contents only:
a) Political party;
b) Candidate/s;
c) Qualifications of candidate/s;
d) Platform of government; and
e) Picture/s of candidate/s.
5. The ELECOM will not tolerate any form of smear campaign, mudslinging or any kind of character defamation.
6. All campaign materials to be displayed must be approved by the ELECOM prior to posting and must bear the ELECOM seal.
7. Candidates are required to submit a sample leaflets, sample ballots, and others for the approval prior to the distribution.
8. Campaign materials shall not be posted, appended, or hung anywhere within or outside the campus other than those areas specified and authorized by the ELECOM.
9. All student candidates elected or not elected and their respective parties shall be responsible for the clean-up of the displayed materials after Election Day.
D. Room-to-Room Campaign
ELECOM will facilitate in the conduct of a room-to-room campaign for a specified number of school days.
a. Student candidate, party chairperson or independent candidate must first secure an approval from the ELECOM to conduct a room-to-room campaign.
b. Only ELECOM can authorize a student candidate to conduct room-to-room campaigns. ELECOM will provide the authorization letter duly approved by the proper authority/authorities of this institution.
c. A party or an independent candidate will be allowed a maximum of 15 minutes per class to conduct a classroom campaign provided however that the class instructor/instructress has given prior permission.
d. Speeches shall be limited only to the candidates’ qualifications and platform of government. ELECOM will not tolerate any form of smear campaign, mudslinging or any defamatory acts or statements that will tend to becloud the reputation of a party or a candidate.
E. Boarding House Campaign
ELECOM will allow campaign outside the school premises provided that such is done lawfully with decency and respect.
a. ELECOM will authorize a student-candidate to visit Boarding houses, Dormitories and the like provided that permission from proper authorities shall be availed of. Unless otherwise provided, permission from the Students’ Affairs Office must be granted. Furthermore, written permission duly signed by the owner or person in-charge of the boarding house or dormitory must be secured.
b. The above-mentioned permits must be presented to the ELECOM prior to the conduct of a boarding house campaign.
c. Campaign shall be limited only to the candidates’ qualifications and platform of government. ELECOM will not tolerate any form of smear campaign, mudslinging or any defamatory acts or statements that will tend to becloud the reputation of a party or a candidate.
F. Miting de Avance
ELECOM will provide the final venue wherein candidates will be given one last opportunity to lay before the electorates their platform of government and convince students to vote for them. Such will be conducted in a form of a general assembly calling students to a Meeting de Avance.
Guidelines for the conduct of a Meeting de Avance shall be formulated by the Commission.
G. Disciplinary Measures
In order for the ELECOM to enforce the above guidelines successfully and to ensure an orderly and proper conduct of the CSG elections, the following disciplinary measures are provided. Such measures cover only activities pertaining and related to the CSG elections.
1. Any violation of the foregoing guidelines will receive the following sanctions:
a. Minor Offenses:
A fine of P500.00 and/or confiscation of posted or displayed campaign materials of the erring candidate as determined by the ELECOM sitting in division of 3;
b. Major Offenses:
A fine of P1000.00 and/or suspension of the campaign activity to the erring candidate for a period to be determined by the ELECOM sitting in division of 5;
c. Repeated violations of the guidelines may result to the cancellation of the certificate of candidacy as determined by the ELECOM sitting en banc.
2. The ELECOM will act on violations pertaining the above-mentioned guidelines on the following:
a. Actual witness by ELECOM members/deputies of the violation made by the candidate/candidates;
b. A formal complaint filed by a witness/complainant but not limited to the following information:
b.1. name the complainant
b.2. name or identity of the respondents
b.3. specific place, date and time of the commission of the act complained of
b.4. brief description of the violation
b.5. at least two witnesses attesting to the act complained of
H. The ELECOM shall determine the merit of the case and shall deliberate on the filed complaint after the respondent/s shall have been ordered to file an answer. Failure to file an answer within two (2) days after the receipt of the complaint shall render the respondent/s at fault and thus shall be sanctioned accordingly.
I. In the absence of a Student Supreme Court or any appeal thereto within one (1) day after receipt of decision, ELECOM’s decision shall be final and executor.
