𝙈𝙀𝙍𝙍𝙔 𝘾𝙃𝙍𝙄𝙎𝙏𝙈𝘼𝙎!

As the bells ring and the lights of the parol brighten our streets, the Sangguniang Kabataan Council sends our warmest and most heartfelt greetings to every home in our community. Merry Christmas!

The heart of this season lies in the humble manger of Bethlehem—the moment God chose to enter our world not as a powerful ruler, but as a vulnerable child. This sacred birth reminds us that true greatness is found in humility and that hope can begin in the most unexpected and modest of places. For us as young leaders, it serves as a powerful lesson: we do not need titles or immense wealth to bring light to our community; we only need a heart that is willing to be present for others.

𝗢𝗙𝗙𝗜𝗖𝗜𝗔𝗟 𝗦𝗧𝗔𝗧𝗘𝗠𝗘𝗡𝗧
𝗖𝗮𝗻𝗰𝗲𝗹𝗹𝗮𝘁𝗶𝗼𝗻 𝗼𝗳 𝗖𝗵𝗿𝗶𝘀𝘁𝗺𝗮𝘀 𝗟𝗲𝗮𝗴𝘂𝗲 𝟮𝟬𝟮𝟱

We would like to inform everyone, especially the youth of Barangay Zone 5, that our upcoming Christmas League will be cancelled due to the lack of participants.

The SK Officials waited for 1 hour and 15 minutes for the youth to participate in the KK Assembly, which serves as the primary basis for inclusion in the said event. Unfortunately, only 22 youth arrived far below the required quorum, and not even half of the expected number.

In the past years, we have continuously extended our understanding despite recurring issues of low attendance and the consistent failure to meet required numbers. We patiently accommodated these shortcomings and pushed through activities for the sake of the youth. However, this year, such behavior is no longer acceptable. We believe that active participation is essential for the success of any youth program, and we cannot proceed without the collective commitment of our community.

We hope for everyone’s understanding and encourage all youth to be more responsive and involved in future SK activities and assemblies.

The 𝘌𝘯 𝘉𝘢𝘯𝘤, during its session today, November 11, 2025, acted on the consolidated petitions in G.R. No. E-02002 (𝘔𝘢𝘤𝘢𝘭𝘪𝘯𝘵𝘢𝘭 𝘷. 𝘚𝘦𝘯𝘢𝘵𝘦); G.R. No. E-02010 (𝘛𝘢𝘺𝘢𝘮 𝘷. 𝘊𝘖𝘔𝘌𝘓𝘌𝘊); G.R. No. E-02142 (𝘍𝘶𝘫𝘪𝘪 𝘷. 𝘖𝘧𝘧𝘪𝘤𝘦 𝘰𝘧 𝘵𝘩𝘦 𝘗𝘳𝘦𝘴𝘪𝘥𝘦𝘯𝘵); and G.R. No. E-02276 (𝘏𝘪𝘥𝘢𝘭𝘨𝘰 𝘷. 𝘌𝘹𝘦𝘤𝘶𝘵𝘪𝘷𝘦 𝘚𝘦𝘤𝘳𝘦𝘵𝘢𝘳𝘺) by denying the consolidated petitions questioning the constitutionality of Republic Act No. 12232, which sets the term of office of barangay officials and members of the Sangguniang Kabataan (BSK) to four years.

Under the law, the next BSK elections will be held on the first Monday of November 2026 and every four years thereafter.

Accordingly, the elections set for December 1, 2025, have been rescheduled to November 2026. Incumbent officials shall remain in office until their successors are elected.

The petitions, filed by Romulo B. Macalintal 𝘦𝘵 𝘢𝘭., argued that the law is invalid for failing to comply with the guidelines in postponing elections set in the 2023 case of 𝘔𝘢𝘤𝘢𝘭𝘪𝘯𝘵𝘢𝘭 𝘷. 𝘊𝘖𝘔𝘌𝘓𝘌𝘊. The petitions also claimed that the law violates the public’s right to vote and unduly favors BSK officials.

In upholding the law, the SC, through the 𝘱𝘰𝘯𝘦𝘯𝘤𝘪𝘢 of Associate Justice Jhosep Y. Lopez, ruled that Article X, Section 8 of the Constitution grants Congress the authority to set the term duration of barangay officials, who are not bound by the general three-year term limit that applies to other elective local officials. This legislative power is not merely permissive; it makes Congress the sole body empowered to define the term of office of barangay officials.

The SC clarified that RA 12232 is fundamentally a term-setting law for BSK officials, establishing a four-year term and prohibiting consecutive terms for the Sangguniang Kabataan officials. It is not a law postponing elections; the rescheduling of the elections is merely incidental.

Therefore, the Macalintal guidelines, which set out the parameters Congress must follow in postponing elections, do not apply to RA 12232.

The SC also ruled that the law does not violate the public’s right to vote, as it neither abolishes nor indefinitely suspends the BSK elections. It simply changes the interval from three to four years.

Finally, the SC held that the RA 12232 is not discriminatory, in that a law treating barangay officials differently does not amount to undue favor or discrimination when such treatment is expressly allowed by the Constitution.

LOOK | COVERAGE OF THE SANGGUNIANG KABATAAN OFFICIAL ELIGIBILITY (SKOE)

Under Section 3 of Civil Service Commission Resolution Number 2500752, “the grant of the SKOE shall be available to the following SKOs in good standing, whether elected or appointed, who were in office upon the effectivity of Republic Act 11768, and to those elective and appointive SKOs who subsequently assumed their positions:

1. SK Members elected by the registered voters of the Katipunan ng Kabataan (KK); and
2. SK Secretary and Treasurer appointed by the SK Chairperson from among the members of the KK, with the concurrence of the majority of all the SK members.

Only the elective and appointive SKOs mentioned above may access the SKOE. Therefore, it is clarified that eligibility for the SK Chairperson (whether elected or succeeding) will only be granted the Barangay Official Eligibility (BOE) in accordance with Section 94 (d) of BP Blg. 3337, as amended by Section 393 (b)(5) of RA No. 7160, provided that the conditions and requirements specified in the grant of BOE under CSC MC No. 13, s. 2021, Policies on Service Requirement for Grant of Barangay Official Eligibility, and other related matters are satisfied.

Considering that RA No. 11768 took effect on 1 June 2022, the SKOs in good standing who were incumbents during the term 2018 to 2022, and those who will be elected and/or appointed as SKOs thereafter, shall be entitled to the grant of SKOE under these rules, subject to the rule on completion of term of office.
