QUESTION NO. 992 - PAANO MAG-APPLY NG TITULO KUNG TAX DECLARATION LANG ANG MERON KA?

1: ALAMIN ANG KLASIPIKASYON NG LUPA

Humingi ng sertipikasyon mula sa DENR-CENRO/PENRO kung ang lupa ay Alienable and Disposable (A&D) land. Kung hindi A&D ang lupa, hindi ito maaaring matituluhan bilang pribadong lupa.

2: MAGPASURVEY NG LUPA

Magpagawa ng survey plan at technical description sa isang lisensyadong geodetic engineer at ipaapruba ito sa DENR kung kinakailangan.

3: TIPUNIN ANG MGA DOKUMENTO

Karaniwang kailangan ang:

Tax Declaration;
Real Property Tax Receipts;
Survey Plan at Technical Description;
Valid IDs;
Mga dokumentong nagpapatunay ng possession o pagmamay-ari (hal. deed of sale, affidavit, extrajudicial settlement, at iba pa kung mayroon).

4: TUKUYIN ANG TAMANG URI NG PAGPAPATITULO

A. Kung kwalipikado para sa Free Patent

Maghain ng aplikasyon sa DENR alinsunod sa:

Republic Act No. 10023 (Residential Free Patent); o
Mga probisyon ng Commonwealth Act No. 141 (Public Land Act), gaya ng binago ng mga sumunod na batas.

Magsasagawa ang DENR ng beripikasyon at publication/posting kung kinakailangan.

B. Kung hindi kwalipikado para sa Free Patent

Maaaring magsampa ng application for original registration of title sa Regional Trial Court (land registration court) sa ilalim ng Presidential Decree No. 1529 (Property Registration Decree).

5: PAGLABAS NG PATENT O DESISYON NG HUKUMAN

Kapag naaprubahan ang Free Patent o naging pinal ang desisyon ng korte, ipapadala o irerehistro ang dokumento sa Registry of Deeds.

6: PAG-ISYU NG TITULO

Pagkatapos ng rehistrasyon sa Registry of Deeds, mag-iisyu ng Original Certificate of Title (OCT) sa pangalan ng aplikante.
