The Department of the Interior and Local Government (DILG) reaffirmed the vital role of Municipal Local Government Operations Officers (MLGOOs) in upholding the rule of law and ensuring that the Katarungang Pambarangay system functions effectively and fairly.

Within the Katarungang Pambarangay system, MLGOOs guide barangay officials in observing proper procedures for mediation and conciliation, including the issuance of summons, the conduct of hearings, and adherence to due process under Republic Act No. 7160.

The Department clarified that while the Lupon or Pangkat does not possess coercive power to physically compel attendance, the law provides clear consequences for unjustified non-appearance. Under Section 515 of the Local Government Code, refusal or willful failure to appear despite a valid summons may give rise to indirect contempt proceedings upon proper application before the court and may also affect the ability of parties to pursue claims or counterclaims.

The DILG underscored that the absence of direct coercive authority is distinct from the existence of legal repercussions for disobedience, which are enforced through the courts.

โ€œAng papel ng MLGOO ay tiyakin na ang proseso ay tama, malinaw, at naaayon sa batas. Sa ganitong paraan, napapanatili ang tiwala ng mamamayan sa ating mga institusyon,โ€ the Department said.

The DILG also expressed concern over the treatment of MLGOO Dexter Castro Narrido during a recent television interview, where he was subjected to undue humiliation while correctly discussing the application of the law. While scrutiny and debate are part of public service, these must be exercised with fairness, respect, and a shared commitment to clarity and understanding.

In light of Proclamation No. 107, dated November 6, 2025, which declares a State of National Calamity, all elective and appointive local government officials and employees are reminded that all applications for Foreign Travel Authority (FTA)โ€”whether for official or unofficial travelโ€”must be approved by the Secretary of the Interior and Local Government (SILG), consistent with Office of the President Administrative Order No. 6, s. 2001.

In line with this, strict compliance with the procedures and requirements under DILG Memorandum Circular No. 2025-023 is required. LGU officials and employees are strongly encouraged to plan ahead, submit applications within the prescribed period, and ensure that all documentary requirements are complete to avoid delays in approval.

TANONG NG BAYAN | Anong proyekto o programa ang maaaring ipatupad gamit ang 20% Development Fund (DF)?

Alinsunod sa Seksyon 287 ng Local Government Code of 1991, ang bawat yunit ng lokal na pamahalaan ay dapat maglaan sa kanilang taunang badyet ng hindi bababa sa dalawampung porsyento (20%) ng kanilang taunang National Tax Allotment (NTA) para sa mga development projects o mga proyektong pampaunlad.

Ang mga LGU ay inaatasan na sundin ang mga sumusunod na patakaran at alituntunin sa paglalaan at paggamit ng 20% DF:
1. Ito ay dapat gamitin upang pondohan ang mga prayoridad na proyektong pampaunlad ng LGU, gaya ng nakasaad sa kanilang mga aprubadong local development plans, at medium-term at annual investment programs, na dapat ay tumutugma naman sa Regional at Philippine Development Plan.
2. Mga proyektong pampaunlad na kinakailangan, angkop, o mahalaga para sa mahusay at epektibong lokal na pamamahala, at ang mga esensyal sa pagtataguyod ng pangkalahatang kapakanan ng mga mamamayan.
3. Maaaring humingi ng teknikal na tulong mula sa mga Pambansang Ahensya ng Pamahalaan (NGAs), gaya ng (ngunit hindi limitado sa) Kagawaran ng Agrikultura, DBM, DepEd, DENR, DOF, DOH, DILG, DPWH, DSWD, at NEDA, upang matukoy ang mga mas makabuluhan at tumutugon na proyektong pampaunlad na maaaring isama sa 20% DF. Ito rin ay upang matiyak ang pagsunod sa mga pamantayang itinakda ng mga nasabing ahensya.

Ang layunin ng pondong ito ay siguruhing may long-term benefit ang bawat sentimo sa ating mga mamamayan!

โ€œEpalโ€™ complaints against local officials down to the barangay constitute administrative cases and preventive suspension, and must be filed in the proper forum according to Department of the Interior and Local Government (DILG) Secretary Jonvic Remulla.

Remulla recently urged the public to step forward with their complaints against โ€˜epalโ€™ local leaders who use government-funded projects for their own good. โ€œMay mga administrative cases na puwedeng i-file sa kanila at maaring mapatawan from preventive suspension to suspension.โ€

The DILG said the complaints against erring and โ€˜epalโ€™ elected and appointed officials of the barangays should be filed in the proper forum as prescribed by Republic Act No. 7160, or the Local Government Code (LGC) of 1991, instituting the protocol in filing complaints for all local government officials, including barangay leaders.

In an interview, DILG-National Barangay Operations Office Director Dennis Villaseรฑor explained that for elected barangay officials, such as the punong barangay, sangguniang barangay members,and sangguniang kabataan chair, residents are welcome to file their complaints in higher level of governance within the locality.

Section 61 (c) of the Code states that a complaint against any elective barangay official shall be filed before the sangguniang panlungsod or sangguniang bayan concerned. It also underscored that the decision on the complaint shall be final and executory.

The Code also says that if the evidence of guilt is strong, a single preventive suspension can be imposed against the barangay official which can be extended to 60 days.

Villasenor likewise said that possible complaints against barangay officials may be lodged in the Office of the Ombudsman. Section 21 of Republic Act No. 6770 prescribes that the Office of the Ombudsman has disciplinary authority over all elective and appointive officials of the government and its subdivisions, instrumentalities, and agencies, which includes all barangays.

He underscored, though, that complaints against a barangay official must not be filed in both the higher sanggunian and the Office of the Ombudsman, as this may result in the dismissal of the complaint. โ€œKung nai-file ninyo po sa parehong forum, sa aming pananaw, baka madi-dismiss lang po iyan dahil magiging โ€˜forum โ€˜shoppingโ€™.โ€

He added that for the complaint to progress, relevant documentation must be presented to the receiving authority, such as a formal complaint that is substantiated and supported by relevant pieces of evidence.

Guidance on Forced Evacuation and Handling of Residents Refusing to Leave High-Risk Areas

The DILG and PNP remind all local government units and police personnel that saving lives is the top priority. During preemptive or forced evacuations, local officials must lead with both firmness and compassion.

All means of persuasion must be used to convince residents to move to safer ground. Explain clearly that evacuation is a measure to protect lives, not to take away their rights or property.

If residents still refuse despite repeated warnings and imminent danger, LGUs and the PNP are authorized to enforce mandatory evacuation in accordance with Republic Act No. 10121 and the Local Government Code. Actions must be done peacefully, respectfully, and with proper documentation.

Ensure that transportation, shelter, food, and medical aid are ready for evacuees, with priority for the elderly, children, and persons with disabilities.

The DILG and PNP call on all local leaders to act quickly and humanely. Protect every Filipino life. No one should be left behind.
