Real Estate Terms na Madalas Hindi Alam ng Buyers (At Nagiging Sanhi ng Problema)

1. Annotation sa Title
• Mga notes na nakalagay sa likod ng titulo.
• Pwedeng may kaso, utang, o claim ang ibang tao sa lupa.
• Kapag hindi ito na-check, maaaring may kasabay kang “problema” na nabili.

2. Lis Pendens
• Ibig sabihin may ongoing na kaso tungkol sa property.
• Kahit mabili mo ang lupa, posibleng maapektuhan ka kapag natalo ang seller sa kaso.

3. Adverse Claim
• May ibang tao na nagke-claim na may karapatan sila sa property.
• Warning ito na may dispute sa lupa.

4. Technical Description
• Detalyadong sukat at boundary ng lupa.
• Kapag hindi ito tumugma sa actual na lupa, pwedeng magkaproblema sa transfer ng title.

5. Survey Plan
• Official na sukat at mapa ng lupa.
• Kung walang maayos na survey, posible na mali ang sukat na ibinebenta.

6. Extrajudicial Settlement
• Proseso kapag namatay na ang may-ari ng lupa at hahatiin sa mga heirs.
• Kung hindi ito ginawa, hindi pa legally pwedeng ibenta ang property.

7. Transfer Certificate of Title (TCT)
• Ito ang titulo na nakapangalan na sa current owner.
• Importante siguraduhin na ang seller ang nakapangalan dito.

8. Capital Gains Tax (CGT)
• Tax na binabayaran kapag nagbebenta ng property.
• Karaniwang responsibility ng seller, pero minsan napagkakasunduan na buyer ang magbabayad.

9. Documentary Stamp Tax (DST)
• Tax sa legal documents sa property transfer.
• Isa ito sa major expenses sa title transfer.

10. Transfer Tax
• Tax na binabayaran sa local government bago mailipat ang titulo sa bagong owner.
