From 1 May 2026, new Rule 3A of the Health Information Privacy Code requires a health agency that collects health information about an individual, from someone other than that individual, to take reasonable steps to ensure the individual is aware of that collection.
This has particular relevance for private anaesthetists. In routine practice, anaesthetists may receive clinical information before having direct contact with the patient.
