TRIBUNAL VERDICT: UBA HAILS SUSWAM'S VICTORY

Peoples Democratic Party governorship candidate in the March 18 governorship election in Benue State, Rt Hon Titus Uba hails the decision of the National and State House Assembly Election Petition Tribunal which has nullified the victory of Barr. Emmanuel Udende and declared Sen Gabriel Suswan as winner of the Benue North East Senatorial election.

Engr. Uba says the restoration of Senator Suswam's mandate is a victory for democracy and effective representation.

The immediate past Speaker of the State Assembly expresses confidence in the Judiciary to dispense justice in all electoral cases pending before it, noting that the tribunal verdict in Suswam's case and many other cases won has further proven that the era of elections rigging is over.

PDP CONGRATULATES SUSWAM OVER TRIBUNAL VICTORY

The Peoples Democratic Party (PDP) in Benue State congratulates His Excellency Senator Gabriel Suswam over his victory at the National Assembly Election Petitions Tribunal earlier today.

The Tribunal sitting in Makurdi upheld the petition by Senator Suswam challenging the emergence of Emmanuel Udende as Senator for the Benue North-East Senatorial District at the 2023 elections.

PDP hails the Tribunal for delivering substantial justice in the petition based on the facts and evidence rendered before in line with extant electoral laws, guidelines and regulations, thereby boosting public confidence in the judiciary.

The party rejoices over the victory won particularly as it re-establishes its dominance in the upper chamber membership composition of the National Assembly in the state with two Senators out of three.

This victory of Senator Suswam serves to heighten the hopes that PDP will likewise reclaim the governorship of the state at the Governorship Election Petition Tribunal through the judgement being awaited.

Furthermore, the party is confident that the former Benue State Governor will deploy his wealth of experience and proven pedigree in the 9th Senate, to get back seamlessly into the business of lawmaking in the 10th Senate for the good of his constituents, the party and Nigeria at large.

GOV. ALIA AND DSS SHOULD FREE COUNCIL CHAIRMEN FROM DETENTION IMMEDIATELY

It has become necessary to call to order Benue State Governor, Hyacinth Alia, over his continuing draconian actions since he assumed office, which include, the arrest and incarceration of Executive Chairmen of 4 local government areas of the state.

On Monday, 3rd July, 2023, the Executive Chairmen of Guma, Katsina-Ala, Ushongo and Ado local government areas had honoured an invitation from the Directorate of State Service (DSS) in Makurdi, on the prompting of the governor, and since then they have been under detention there.

Today marks over 72 hours of the detention of the council chairmen by DSS without stating what their offence is or charging them to court, in the face of which it is plausible to infer that their offence could only be a refusal to surrender to the illegality of their purported suspension from office under the orders of Governor Alia.

Those lawfully elected council chairmen were invited and detained by the DSS at the request of the governor who has vowed to remove them from office by whatever means possible to him, in furtherance of his policy of vendetta and witch-hunt against the immediate past administration of Governor Samuel Ortom

And earlier today, lawyers and the bailiff of a Makurdi Magistrate Court in seeking to serve processes of the court on the DSS headquarters in Makurdi for the enforcement of the fundamental human rights of the detained council chairmen were denied access to the Directorate's premises, neither were they attended to by anyone for the purpose of their assignment there.

We call on the DSS to beware of its professional image and steer clear of Governor Alia's desire to perpetrate impunity and foist an order of lawlessness on the state.

23 Council Chairmen in Benue State were elected on the platform of the Peoples Democratic Party (PDP) at the April 30, 2022 local council elections conducted by the Benue State Independent Electoral Commission (BSIEC), and they were sworn into office on June 29, 2022 to a definite tenure of 2 years as enshrined in the Local Government Establishment Law of the state: that tenure expires on June 28, 2024.

Following a suit brought by the council chairmen before the National Industrial Court holden at Makurdi, praying the same court to guarantee their tenure of office against unlawful dissolution by the state government, Hon. Justice (Dr.) I. J. Essien, the Presiding Judge of the Court, had on June 15, 2023 given a judgement which held severally and in the final paragraph that:

"AN ORDER OF PERPETUAL INJUNCTION is hereby made restraining the defendants (Benue State Government), by themselves, agents, successors or privies, from dissolving the claimants' elected councils or suspending the claimants (23 elected local from office before the expiration of their tenures, or from interfering with the functions, operations, rights, privileges or entitlements of the claimants' councils in the manner complained of in the suit".

This judgement of the court which had competency in jurisdiction was not appealed against by the Benue State Government or any of its agents, therefore, the judgement has binding force which is above any authority existing under the law of the Federal Republic of Nigeria, meaning, therefore, that under the protective umbrella of the court judgement, the 23 elected council administrations in Benue State are validly in office with a recognized mandate which subsists until the stipulated date of expiry.

Not paying heed to this order of court, Governor Alia had moved in total disregard for law and due process and gotten the state Assembly which leadership he personally sat in the chambers of the Assembly and handpicked, to constitute a kangaroo committee of 3 members which needed less than 24 hours to purport completion of an investigation into the affairs of the 23 local councils, following which same committee recommended and at the same time ordered the suspension of the 23 council chairmen and the entire councils including the legislative arms from office indefinitely.

The council chairmen through their learned counsel had proceeded and commenced contempt of court proceedings against the government of Hyacinth Alia and his "Partners in Impunity" at the Benue State House of Assembly, serving on them variously and separately Notice of Consequence of Contempt Proceedings, on 27th June, 2023, which hearing is scheduled to hold in a few days.

Those Chairmen had also through their learned counsel approached the High Court of Benue State seeking through an ex parte application and a substantive suit to have the Benue State Government restrained from interfering with their lawfully vested mandate and tenure of office, both of which were earlier this morning entertained before the Chief Judge of Benue State, Justice Maurice Ikpambese.

It is in the face of the obvious tide of legality flowing in the favour of the council chairmen that the Benue State Governor has panicked and resorted to the draconian arm-twisting tactic of having them arrested and incarcerated unlawfully by the DSS.

Governor Alia has shown himself a man inclined to lawlessness and duplicity both by his words and action, and within less than two months of his being in power he can be seen to have his sights and mindset not on governance but on vengeance against his enemies whom he has designated as anything that is related directly or remotely to the Ortom administration.

And in many instances this governor is known to proceed with his mouth before his brain as he recently even said he was not aware of the judgement of the National Industrial Court in a matter the government he heads was the defendant and had legal representation.

Governor Alia has shown himself willing to go to such low levels as are embarrassing to the status of his office, such as when a few days back he personally led a team of security men to break down the doors to the government quarters being occupied by the erstwhile Chief Detail to immediate past Governor, Ortom, not heeding counsel from his Aides that the DSS officer was billed to move out of the residence in just a couple of days, and that his continued stay in the quarters was in line with the statutory grace period available to him to find accomodation to relocate to with his family.

The governor is consumed by a bitterness and vengefulness against Ortom and PDP in a manner as depict him as lacking in the grace and character depth of one fit to occupy the office of Governor, and the signs are already showing that he and his supporters are inclined to adopting extra judicial methods to settle accounts with his perceived opponents.

Only a day before the DSS invitation and detention of the four council chairmen, men suspected to be thugs loyal to the government had invaded the Makurdi residence of the Executive Chairman of Gboko local government area, Hon. Isaac Mtom, who was away, but the invaders had molested his wife and young children subjecting them to both physical and verbal assault, telling the chairman's wife to warn her husband against being disobedient to the governor.

Hon. Mtom had reported the incident to the Benue State Police Command which says it is still investigating it.

PDP calls on DSS to release with immediate effect the 4 council chairmen in their custody, among whom is a woman in her 80s, the Ushongo Council Chairman, whose only offence has been to answer the call to duty to serve her people in her old age, service she has been rendering with uncommon competence, and the other chairmen of Guma, Katsina-Ala and Ado, who likewise have committed no crime.

We suspect that part of the plot being hatched by Governor Alia through the DSS might be to get the council chairmen to withdraw all court processes they have initiated to safeguard themselves and their offices, but we warn the governor, his cronies and the DSS that such antics are not only low but won't see the light of day, as we will initiate more legal action against the governor and his agents should they continue on this path of lawlessness and vengeance.

With his government approaching the 2 month mark without even the remotest semblance of seriousness to show, it is time Governor Alia braced up to the reality that he has a mandate to the people of Benue State which derives from the loquacious promises he made during the campaigns to turn the state into "Heaven on Earth", and begin the business of governance.

INEPTITUDE: ALIA LEAVES GOVERNANCE IN THE HANDS OF CHIEF OF STAFF

It is now clear that governor Hyacinth Alia of Benue state does not have any idea of what to do with the mandate given to him by the people of the state and has left the wheel of governance in the hands of his chief of staff Paul Biam who is showing his dictatorial tendencies.

Remember the day that the governor proclaimed the Benue State House of Assembly, chief of staff Paul Biam was on video exchanging bitter words with the state chairman of APC Austin Agada. Such a thing has never been heard of before! One month has passed since then and not even a caution or query has been issued to the iron man Biam.

The chief of staff has taken over the running of Alia’s government and the governor is clueless and inept. Insiders say that Alia loves what Biam is doing! The governor spurs him on whenever he takes a punitive action against anyone. After Biam assaulted chairman Agada, governor Alia was later heard giving him thumbs up and telling him “orne that was a great job”.

Strong man Paul Biam has taken over the duties of secretary to the state government (SSG) too and has told the man who is fresh from the classroom as a university teacher that on no account should he bypass him to reach the governor directly. The SSG who has no experience in government is like an errand boy to the iron man Paul. Did you see how some sack letters sent to heads of government agencies by the SSG were later withdrawn and those agency heads asked to resume their duties? That was iron man Paul Biam in action.

The chief of staff has warned appointees of the governor including the principal private secretary that nothing must get to the attention of the governor without his permission. He has already drawn a battle line ahead of the appointment of commissioners. He said when the commissioners come in, none of them will be allowed to see the governor until he is present in such a meeting.

To crown his supremacy, Biam now calls the Alia administration “my government” meaning that he Paul is the one governing the state. Those who attended the burial of the wife of Dr Laha Dzever yesterday in Buruku can confirm this. The chief of staff repeatedly referred to the administration as “my government”. He spoke at the funeral like an emperor. Biam justified every decision the government has so far taken and said more of such punitive decisions will come.

Alia has proven those who criticized his candidacy right. He has no vision and does not have good intentions. To allow Biam to be harassing top party officials while he nods in approval shows that the man himself is not a good person. The group they hate to see most is the camp of SGF Senator Akume. Anyone from Akume’s camp who goes to see the governor is blocked and not given the opportunity to see him.

The “Yes Father” chorus has died down even before the 2nd month of the government. Those who worked very hard for the victory of Alia have been neglected. The man has found new friends. He picks only the phone calls of his new friends.

Alia has boasted with APC members that he can leave their party to join a small party and still win election. He said he did the party a favour by joining them so no one should bother him with requests.

As the saying goes, “many can attend a healing mass but not everyone is allowed to partake in holy communion”.

Professor Hagher @ 74: A Tribute

In his now oft-quoted aphorism, William Barclay, the Scottish author, church minister, and Professor of Divinity and Biblical Criticism at the University of Glasgow once says, “There are two great days in a person’s life—the day we are born and the day we discover why.” Barclay’s assertion appears to define the birth, life, and career of our birthday celebrant, the Distinguished Professor Iyorwuese Hagher, who is best known as an erudite scholar, shrewd politician, consummate diplomat, prolific writer, modern poet, and accomplished playwright. Hagher’s seventy-fourth birthday is, indeed, a success story of a man who comes from a humble background, discovers at a very young age the value of education, and does everything possible to give his life purpose and direction in all his endeavors serving humanity.

A former Nigerian senator, two-time minister, and a high commissioner to Canada, after his duty tour as ambassador to Mexico with concurrent accreditation to Panama, Costa Rica, and Guatemala. Professor Hagher received his early primary school education at Zaki-Biam and attended WM Bristow Secondary School Gboko, Benue State, Nigeria, He attended Kuru Government Secondary School, near Jos where in 1970, he took the Cambridge University Matriculation exam that gave him direct entry at the Ahmadu Bello University, Zaria. At ABU, he obtained a Bachelor of Arts honors degree in the English Language in 1974, a Master’s degree in Drama, and Doctor of Philosophy degrees (1977 and 1981 respectively). He taught Drama and conducted research on African indigenous cultures at the Ahmadu Bello University, Zaria, and the University of Jos. Through a career of hard work and profound erudition, Hagher rose to become a Professor of Theatre and Drama for Development in 1990. All these academic attainment and experience in research, teaching, university management, and administration had set the stage for his forays into national politics, global leadership, and a life of community service.

Hagher has an admirable career as a playwright. His long list of plays, among others, include, Aishatu— an advocacy play against the use of drugs by teen commissioned by the Lion’s Club of Jos, written in 1985, and performed on 14th August 1985 as directed by Saint Gbilekaa; Mulkin Mata—written and directed by Hagher and was premiered on 14th October 1986; Anti People—written and directed by Hagher on 26th February 1987 at the Open Air Theatre, University of Jos; We Protest—written by Hagher and directed by Musa Dauda on 2nd March 1988; Camps of Segbwema—inspired by Fuente Ovejuna and Lope De Vega, written in 1989 by Hagher and premiered at the University of Jos on 18th November 1989; Comrade and Voltage—written by Hagher in 1996 and was directed at the premiere at the University of Lagos by Dr. Hope Eghagha; The Lamp of Peace—written by Hagher, directed by Mrs. Bose Tsevende and premiered at the Open Air Theatre of the University of Jos, Nigeria on 15th March 1998; The Trial of James Skott—written by Hagher in 1999. It was produced at Vere Street, West End London, and directed by Zara Jeffreys. His other plays include Lifetimes—written by Hagher, from workshops of the Theatre for Development on HIV-AIDS, sponsored by UNICEF in 1998 at Iseyin Oyo State Nigeria; The Story and Play—written by Hagher and directed by Dapo Adelugba and Femi Osofisan; The Professor and the Cathedral—written by Hagher in 2001 and premiered at the University of Abuja Open Air Theatre as directed by Dr. Emmanuel Sani Dandaura; The Masquerade and the Elephant—written by Hagher in 2002 and premiered at the Ahmadu Bello University Zaria between 22 – 24 May 2002 as directed by Dr. Samuel Ayedime Kafewo; Global Home—written in 2005 by Hagher, and premiered at the Leadership Theatre in Jos, Nigeria on 29th November 2006 as directed by Mrs. Bose Tsevende; 2008 Global Home and other plays—written by Hagher and published by Spectrum Books Ibadan’ and some other collected Plays which can be accessed on the web, among others. Yet, his critical works, such as Leadership and Governance in Nigeria (2001), Leading Africa out of Chaos (2002), Beyond Hate and Violence (2003), and Weapons of Mass Instruction (2004), are prized globally for their incisive analysis of Nigeria’s national question. His book The Coming Revolution in Nigeria was published the year Hagher was a presidential aspirant in the SDP in 1999. There is not a single copy left in the market and it is being revised for the second edition at the moment. A Day in Mexico (2009) is a collection of Hagher’s poetry establishing Hagher as a pan-Africanist, and defender of Africa as a public intellectual. Hagher has worked across the genres successfully. In 2020, Hagher, then 71 years old wrote his first novel, The Conquest of Azenga (2020) which won an ANA award, and global critical acclaim as the first novelist anywhere to have successfully countered Western racism in literature by psycho-analyzing Western society and the evil called colonialism. His writings deeply disturb the status quo and his heroes are the common people which Hagher has pitched camp against the mendacity and oppression of the elite, the new slave masters. It is to Hagher ’s credit that despite his robust erudition, his fierce penmanship, and his multidimensionality of talent, he exudes extraordinary humility and puts Nigeria, others, and his family ahead of himself. Hagher is well known among his friends and colleagues for legendary generosity. He gives and gives his substance and exudes a boyish charm and charisma, and walks with a bounce and glee in his eyes, despite advancing age. His close friends and mentees refer to him playfully as the Rabbi of the Hagher School of Leadership, which teaches; service, love, sacrifice, and duty.

MEDIA TRIAL OF ORTOM AIMED AT DIVERTING ATTENTION FROM ALIA’S EARLY MISSTEPS

Since Governor Hyacinth Alia of Benue State assumed office, he has subjected his predecessor, His Excellency Samuel Ortom to all forms of persecution. If he is not accusing the former Governor of looting the state’s treasury and assets, he is blaming him for providing employment to Benue youths.

Since May 29, 2023, Governor Alia and his team have been intent on tarnishing Ortom's hard-earned reputation by putting him on trial in the media. Their latest move was the inauguration of the "Assets Recovery Committee", where they once again accused the former Governor of looting government assets in collusion with members of his former cabinet.

Governor Alia has become a judge in his own case. He has convicted the immediate past Governor even before the committee on assets recovery would commence its assignment, thereby violating the principle of audi alterem partem which upholds fair hearing.

Despite the motive behind the probe, it is important to note that due process was followed by the Ortom administration in all its actions, including the allocation of vehicles to outgoing government officials and the auction of some public property.

As previously mentioned, the Benue State Executive Council made the decision to grant waivers to government officials, including the Governor and his Deputy, to allow them to retain their official vehicles. The Council also approved the auction of certain assets that were no longer of value to the government.

Our advice to Governor Alia remains the same: focus on governance and deliver on the numerous promises he made to the people during the campaigns. Blaming Chief Ortom for the government's lack of progress in addressing development issues does not lend credibility to the current administration.

WE DO NOT RECOGNIZE THE PURPORTED DIRECTIVE ISSUED FROM THE BENUE STATE HOUSE OF ASSEMBLY AND THE BUREAU OF LOCAL GOVERNMENT AND CHIEFTAINCY AFFAIRS THAT WE AND THE ENTIRE ELECTED LEGISLATIVE COUNCILS OF OUR RESPECTIVE AREAS HAVE BEEN SUSPENDED FROM OFFICE, AND WILL NOT COMPLY WITH ANY INSTRUCTION THERETO

Gentlemen of the press

We address you here this day, 24th June, 2023 as elected chairmen of the 23 local government councils in Benue State over the lingering matter of our purported suspension from office.

Our suspension is by now an issue which you the press are aware of and have even reported widely in your various mediums, as was purported by the Benue State House of Assembly on 21st June, 2023, and only yesterday, 23rd June, 2023, by a correspondence from the office of the Permanent Secretary in the Bureau of Local Government and Chieftaincy Affairs.

We state without the slightest modicum of ambiguity or prevarication that we do not recognize such purporting of our suspension from office from such quarters as are purporting it, neither do we consider ourselves under any obligation to give heed to same or comply with any directive as emanates from it.

Our position derives a fundamental base from the incontrovertible fact of our offices being a creation of law as guaranteed under the supreme umbrella of the Constitution of the Federal Republic of Nigeria (As Amended in 1999) which recognizes the tier of government we function at as the third in a tripod made up of the Federal, State and Local.

We were elected as council chairmen on 30th April, 2022 in the local council elections conducted by the Benue State Independent Electoral Commission (BSIEC) and sworn into office on 29th June, 2022.

We, in line with the provision of extant law proclaimed the legislative councils in our various areas which were also duly elected and thereafter forwarded to them our nominations for the offices of Supervisors whom we swore into the various statutorily designated offices, together with Special Advisers to our offices.

We were not appointed into office but were elected by the electorate of Benue State and vested with a mandate which is guaranteed under law, with the procedure for the administration of the councils under our leadership clearly provided for under the Local Government Establishment Law of Benue State.

It is, therefore, not known to us under such law, that we and the entirety of the government at our tier of it can be sacked in the manner as purported by the state Assembly and the Bureau for Local Government and Chieftaincy Affairs.

We equally defer to the judgement of the National Industrial Court holden in Makurdi which barred the government of Benue State at all levels from taking any action as seeks to temper with our lawfully recognized mandate as elected council chairmen.

That judgement of court is still subsisting and we are not even aware that government appealed against it.

We expect the government of Benue State to lead the way on the quest for strengthening an order of law and respect for due process in Benue, rather than promoting impunity and the sort of anarchy we are seeing in the actions of the state Assembly and the local government bureau.

We as Chief Security Officers of the 23 local government areas of Benue State are critical stakeholders and leaders in the state and will at all times be willing to tow the path of peace, law and order, and this we have been doing since being sworn into office in our various councils.

However, we will not surrender to illegality and impunity as is being contrived against us.

If we surrender to the unlawful purported suspension preferred against us, we will be doing a disservice to Benue State.

In resisting the impunity, we are doing a duty to the state in line with our sworn oath to discharge the functions vested to our office for the good of the people.

We reiterate that we do not recognize the purported suspension of our councils together with the legislative arms of our councils, and as such will not comply with it.

BENUE ASSEMBLY LACKS POWER TO SUSPEND ELECTED LOCAL GOVT CHAIRMEN

Benue State House of Assembly has suspended the Chairmen in order to allow for investigation on allegation of insubordination levelled against them.

However, in this legal piece, there shall be a consideration of whether the House of Assembly can legally suspend or sack democratically ‘elected’ local government political office holders, for any reason whatsoever.

Pursuant to Section 7(1) of the 1999 Constitution, 2011 as amended, the Local Government Council is established as the third tier of government. The section provides thus: “The system of local government by democratically elected local government councils is under this Constitution GUARANTEED; and accordingly, the Government of every State shall, subject to section 8 of this Constitution, ensure their existence under a Law which provides for the establishment, structure, composition, finance and functions of such councils.”

From the foregoing, it can be easily deduced that the Constitution has freely given the State Government powers to be directly in care of the Local Government Councils, to see to the establishment of new councils in accordance with the law, finance and structure them. It also provides clearly that the state shall ensure their existence and functioning. Does this provision, however, empower the state government to enact law which empowers the governor or the House of Assembly to suspend or remove the democratically elected officials of local government, for any reason whatsoever?

Our courts have made bold attempts to give answers to these posers.

In GOVERNOR OF EKITI & ORS V. PRINCE SANMI OLUBUNMO (2017) 3 NWLR (Part1551), where the Supreme Court held that the provisions of the state law relied upon was in violation of Section 7(1) of the 1999 Constitution and cannot stand by virtue of Section 1(3); meaning that the removal was illegal and unconstitutional.

In driving home the point, the Supreme Court painstakingly explained that the system of local government by democratically elected local government council conferred sacrosanctity on the election of such officials whose electoral mandates steamed from the will of the people — and cannot be arbitrarily taken away by the Governor or state machineries. The court further held that “the election of such officials into their offices and their tenures are clothed with constitutional force. They cannot therefore be abridged without breaching the Constitution”. See also Eze v Governor of Abia State. 4 (2014) NWLR (PT 1426) 192

The conclusion drawn from the judicial precedents above is that democratically elected Local Government officials cannot be arbitrarily removed under any guise by state machineries the same way members of the National Assembly or the President cannot validly remove the Governors.

Even if the Constitution has empowered the State to ensure the existence of local government councils, it does not extend to removing a people democratically chosen by the electorates. Indiscriminately removing elected officials, usually for selfish political reasons, is nothing other than abuse of power, a show of dictatorship and governmental recklessness. Local government officials voted in by the people cannot be forced away from office through removal by either the Governor or the legislature before the expiration of their tenures. They lack the vires to do so.

The motive of the lawmakers is suspicious and must be put to serious legal check. The lawmakers should be careful of setting a dangerous precedent that might consume our democracy.

As a passionate Nigerian from Benue State, we shall not fold our hands to allow the state government (as the House of Assembly is part of the government), to encroach on the Constitution and disrespect the rule of law.

In the final analysis, it is advocated that in the interest of justice and the rule of law, the suspension must be lifted as it cannot stand the test of legality. For no matter how fine the policies of an administration is, the failure to respect the law will befall disaster and retrogression on the government.
