NOW THAT BABA BUHARI DECLARES!!!

President Muhammadu Buhari’s declaration of intent to contest the 2019 presidential
election election has varying implications, both good and bad, for different people.
One of those who will see it as bad news is Aisha Alhassan, Minister of Women Affairs,
popularly known as ‘Mama Taraba’.

In September 2017, ‘Mama Taraba’ swore “to Allah” to resign as minister in the
event that Buhari decides to seek reelection, since she had clearly expressed her
loyalty to former Vice-President Atiku Abubakar and his perennial presidential
ambition.
“Atiku has been my godfather even before I joined politics. And again, Baba Buhari
did not tell us that he is going to run in 2019,” Aisha explained to BBC Hausa radio.

“Let me tell you today that if Baba says he is going to contest in 2019, I swear to
Allah, I will go before him and kneel and tell him that ‘Baba I am grateful for the
opportunity you gave me to serve your government as a Minister but Baba just like
you know I will support only Atiku because he is my godfather… if Atiku says he is
going to contest.”

She also mentioned that she would not mind getting sacked for her daring statement.

“If because of what I said, I am sacked, it will not bother me because I believe in
Allah, that my time has elapsed; that is why,” she said.

“Baba is not a mad man like those calling for my sack. They have been sending it and
spreading that if Baba sees this I will be sacked.”

According to Bolaji Abdullahi, National Publicity Secretary of the All Progressive
Congress, she later apologised “if she had put the party in any difficult position” and for going public with the statement. She has, however, not publicly retracted her statement.

Now that President Buhari has officially declared intention to seek reelection, it
remains unclear if Alhassan will abide by her words and quit the cabinet or if she like her boss who said in 2015 that at 72, he was already limited by age but is now
seeking a second time

As the Court of Appeal sitting in Abuja is set to deliver judgment tomorrow 31/12/2015 on the appeal filed by Arch. Darius Dickson Ishaku of PDP against the judgement of the lower Tribunal that sacked him for having not been validly nominated and sponsored by PDP and declared Haj.Aisha Alhassan as the duly elected Governor of Taraba State and ordered for her immediate swearing in, who do you wish the judgment to favour for the overall interest of Taraba State?

JUSTICE ABDUL ABOKI AND THE JUDGMENT ON TARABA ELECTION APPEAL BEFORE HIM

As Tarabans await the judgment of the Appeal Court on the appeal file by Arch. Darius Dickson Ishaku against the judgement of Taraba Election Petition Tribunal that disqualified him in the governorship election of the state on the basis that he Arch.Darius Dickson Ishaku of PDP was at the time of the election not qualified to contest the election having not validly nominated and sponsored by his political party and declared Sen. Aisha Alhasan of APC as the duly elected Governor of Taraba State. Arch. Darius Dickson Ishaku hold a contrary view and challenged the judgment before Justice Abdul Aboki led Appeal Court panel and averred that the issue of qualification to contest and election is a pre election matter within the exclusive jurisdiction of High Court not a Election Petition Tribunal.

Similar issue was decided by the same Justice Abdul Aboki in ALL PROGRESSIVES CONGRESS v. PEOPLES DEMOCRATIC PARTY & ORS (2015) LPELR-24349(CA) In The Court of Appeal (Ekiti Judicial Division) Delivered On Monday, the 16th day of February, 2015 Suit No: CA/EK/EPT/GOV/1/2015 Presided over by Justice Abdul Aboki on Whether the issue of qualification or disqualification to contest an Election can be raised in an Election Petition.

The judge has this to say ''..the issue of qualification or disqualification to contest an Election being a pre-Election and post Election matter, can be raised in an Election Petition.'' Per In the case of DANGANA VS USMAN AT 89-90; It was specifically stated: "That the qualification/disqualification to contest a matter is both pre-election and on election matter" Also in WAMBAI VS DONATUS & ORS (2014) 14 NWLR (PT.1427) 223 AT 252 the Court held thus; "It is therefore not a correct Statement of the law that in all cases a pre-election matter must be instituted and heard and determined by the high Court as that principle admits of exceptions one of which is where the pre-Election matter is filed after the Conduct and conclusion of an Election, it is the relevant Election Tribunal that has the jurisdiction to hear and determine it." See also: SALIM V. CPC & ANOR (2013) 30 WRN 1 AT 20-21.'' Per ABOKI, J.C.A (Pp. 47-48, paras. D-B).

What do you think Hon. Justice Abdul Aboki will do when deciding the same matter before him on the rightful place to challenge the issue of qualification being a pre election matter this this time around?
a) Uphold his earlier position on the issue and affirm the judgement of the lower Tribunal or
b) Depart with his earlier position and set aside the judgment of the lower Tribunal

A) Do you think Taraba State Government judiciously utilized the N9.4 Billion bailout fund allocated by CBN to the purpose in which the fund was initially applied for?

B) Or can it be right to say that the diversion of the fund to another purpose was in flagrant disregard to the wishes, expectations, plights and deplorable conditions of the people for which the money was expressly applied on their name?

C) Can the diversion of the fund be regaded as a deliberate act of deceiving the duo of Pensioners, Civil Servants, former Political Office Holders, Taraba State House of Assembly, State Executive Council, Federal Government, Debt Management Office and CBN to secure the fund and divert it to another purpose unknown to the terms in which the fund is applied and secured for?
