OMBUDSMAN UNPACKS ROLE OF HOSPITAL OMBUDSMAN MECHANISM IN PROMOTING GOOD PUBLIC HEALTH SERVICES

The Ombudsman, Honourable Grace Tikambenji Malera, this week appeared before the Parliamentary Committee on Health, where she unpacked the role of the Hospital Ombudsman (HO) Mechanism in promoting good public health services in the country.

The Ombudsman appeared before parliament as part of its ongoing enquiry into reports of rampant challenges rocking public health services including corruption.

In her presentation, Honourable Malera indicated that the custodian of the Hospital Ombudsman Mechanism is the Ministry of Health as its own internal grievance redress mechanism and that the Office of the Ombudsman only provides capacity and technical support.

Honourable Malera said the Mechanism has continuously received and resolved increased number of Complaints such as delayed opening of health facilities, discourtesy of health workers, favouritism and demands of informal payments since its inception in 2019.

“I believe that the increased number of complaints is due to increased public awareness of the platform through a number of platforms such as the Mobile Accountability Clinics where we take the whole Office to your constituencies especially the hard to reach areas and empower the communities with information of good public services delivery including the Hospital Ombudsman Mechanism,” she said.

Honourable Malera however said there is need for more public awareness of the mechanism and urged the parliament to provide the Office with adequate resources to conduct such activities regularly.

Honourable Malera conceded that the current arrangement of the Mechanism which designates already serving members of staff in the health facilities as Hospital Ombudsmen, could sometimes create limitations on the effectiveness of mechanism and lobbied the Committee to strengthen it by providing a separate budget and recruitment of independent Hospital Ombudsmen.

In his remarks the Chairperson of the Committee, Honourable Anthony Masamba, MP recognized the importance of the Hospital Ombudsman Mechanism. Moving forward he expressed a commitment to continue collaborating closely with the Office in the upcoming activities for improved public health service delivery.

OMBUDSMAN ENGAGES WITH PUBLIC APPOINTMENTS COMMITTEE ON 2025 ANNUAL PERFORMANCE REPORT

The Honourable Ombudsman, Grace Tikambenji Malera today appeared before the Public Appointments Committee of Parliament (PAC) to submit and present her office's 2025 Annual Report. The submission of the Annual Report to parliament fulfills a Constitutional obligation under Section 127 of the Constitution of the Republic of Malawi and Section 9(2) of the Ombudsman Act.

During her presentation, the Honourable Ombudsman provided an overview of the Office's 2025 operations, highlighting, key milestones, challenges and strategic projections for 2026.

Notably, the Office handled 4,889 Complaints from individual grievances to broad systemic issues and received an additional 14,971 Complaints through the Hospital Ombudsman mechanism.

Honourable Malera commended her team’s efforts in expediting these cases and deliver justice despite significant operational challenges.

The report also revealed persistent administrative challenges including public service delays, late disbursement of terminal benefits, outstanding payments, and procedural failures within public institutions.

Looking forward to 2026, she reported that the Office has adopted strategic approaches to ensure quick resolutions to Complaints.

The Ombudsman also lobbied PAC for enhanced support, specifically requesting a review of the Office's budget ceiling and increased funding to enable operationalization of new offices in Karonga, Mangochi, Nkhotakota and Nsanje Districts.

In his remarks, PAC Vice Chairperson Honourable Joshua Malango, MP commended the Office of the Ombudsman for its outstanding work in 2025 and assured the Office of continued engagements with the committee.

The Office of the Ombudsman has been taking part in a three- day training of Customary Land Tribunals in Ntchisi District.

Customary Land Tribunals are committees at Traditional Authority or Senior Chief level which are mandated to handle customary land-related disputes.

The Tribunals have been established as a way to ease pressure on the justice sector players such as the Malawi Judiciary, Office of the Ombudsman - Malawi, Malawi Legal Aid Bureau and the Malawi Human Rights Commission.

The Office of the Ombudsman's Principal Civic Education Officer Mr. Jameson Chauluka took advantage of the training to sensitize the tribunals, Mandate and functions of the Office and how it will be working with them in customary land-related disputes.

OoO participated in the training with support from the European Union in Malawi through the Chilungamo Programme II.

MAN RECEIVES COMPENSATION AFTER SUFFERING WHILST ON DUTY

A widowed mother, Mrs. Tamara Mwaulambya’s life shifted an unexpected turn when her son, Robin got involved in a fateful accident while on duty. Robin worked for the Electricity Supply Corporation of Malawi (ESCOM), as a General Worker. Through this job he helped his mother with the family’s responsibilities including taking care of his younger siblings.

One day as he was working at a site in Jenda, Mzimba, an electric pole fell and hit Robin’s head whilst on duty. Due to this injury, he began to experience physical and mental challenges that affected his day-to-day life and productivity.

Upon seeing Robin’s condition, his mother was forced to sell the family’s piece of land to carter for his medical treatments and the family’s needs. As the situation became unbearable, she tried to engage with his employer, ESCOM, requesting compensation to assist with Robin’s condition. However, the employer’s assistance was to no avail.

In 2020, Robin’s mother decided to seek a remedy with the Office of the Ombudsman(OoO) and lodged a complaint against ESCOM as the respondent. The OoO commenced with the investigation and established the facts of the matter.

It was noted that ESCOM’s negligence and failure to assist Robin’s condition was an act of maladministration considering that he was one of their employees.

The Office engaged with ESCOM to give an account on the matter. In their response they reported that they had engaged NICO Insurance to look into and assist on the matter. Upon a full investigation and after several engagements with the respondent, the Ombudsman issued directives to ESCOM to pay compensation that would assist with Robin’s condition.

ESCOM complied with Ombudsman’s determination and proceeded with the right administrative action. The resolution brought relief to Robin as well as his mother.
