A LUSAKA woman has stunned the Matero Local Court after paying court fees for her rival in a divorce case, only to later secure a restraining order against the same woman.

Anastasia Njovu, 28, of Kabanana township, paid the fees for Mercy Bwacha, 35, who had failed to raise the funds in a divorce case involving her husband, James Nkole, 39.

The court dismissed the divorce petition after ruling that there was no marriage between Nkole and Bwacha because no dowry had ever been paid.

Magistrate Harriet Mulenga explained that despite the couple living together for 16 years and having three children, they were merely cohabiting.

“There was no marriage between the plaintiff and the defendant because dowry was never paid to the woman’s family,” she said.

Nkole, a businessman of Kabanana township, told the court that he had paid damages in 2009 after impregnating Bwacha, and the two later began living together as husband and wife.

However, the court maintained that without dowry, the union did not qualify as a marriage under customary law.

Friends, each day we wake up alive and in good health, we need to be thankfull. People are suffering out there. Some patients in hospitals and some people in prisons do not have any relative who can provide them with food and resources. They entirely rely in what they are given by their Warders, and you know how it can feel like. Others, elderly and vulnerable, are suffering in the villages with no food and living in houses you can not point at. There are many who are hand-caped and lame, with little or no ability to provide for themselves. We, who have the ability to help them in any way, should not keep quiet and watch them continue to suffer. They are our friends. We can do something. Even a smallest gift is highly appreciated in heaven. Let's wake up.
