Meanwhile, in today's sitting, the Supreme Court has dismissed the application for a stay of the High Court ruling and order dated 19 May 2026, and for an interim injunction restraining the respondent from enforcing or giving effect to the applicant's suspension (𝗠𝗦𝗖𝗔 𝗖𝗶𝘃𝗶𝗹 𝗔𝗽𝗽𝗹𝗶𝗰𝗮𝘁𝗶𝗼𝗻 𝗡𝗼. 𝟰𝟭 𝗼𝗳 𝟮𝟬𝟮𝟲 - 𝗧𝗵𝗲 𝗦𝘁𝗮𝘁𝗲 (𝗢𝗻 𝗮𝗻 𝗔𝗽𝗽𝗹𝗶𝗰𝗮𝘁𝗶𝗼𝗻 𝗼𝗳 𝗬𝗲𝗿𝗲𝗺𝗶𝗮𝗵 𝗖𝗵𝗶𝗵𝗮𝗻𝗮) 𝘃𝘀 𝗕𝗹𝗮𝗻𝘁𝘆𝗿𝗲 𝗪𝗮𝘁𝗲𝗿 𝗕𝗼𝗮𝗿𝗱.

The Court finds the applicant did not pursue the proper procedural course available, which was to make a fresh application for permission to apply for judicial review before the Supreme Court of Appeal, following the discharge by the High Court of the permission previously granted to the applicant to apply for judicial review and the ancillary stay. The application is therefore procedurally misconceived and has no proper foundation upon which the relief sought can be granted.

Judicial leaders from across Southern and Eastern Africa have gathered in Zanzibar for the Southern and Eastern Africa Chief Justices' Forum (SEACJF) Conference and Annual General Meeting.

His Excellency Dr Hussein Ali Mwinyi, President of Zanzibar, officially opened the conference on 5 October 2026, hailing the gathering as a sign of peace, good governance and regional cooperation.

Speaking earlier, the Chief Justice of the Republic of Malawi and Chairperson of the Forum, Hon. Rizine Mzikamanda SC, gave background to the formation of the Forum in the early 2000s and outlined a number of achievements which signify the growth of the Forum.

The Conference and Annual General Meeting is being held under the Theme: Transforming Justice Delivery: Innovation, Efficiency and Court Administration Reform and will be held until 8 October 2026.

In which the Anti-Corruption Bureau appealed against the Magistrates Court’s refusal to renew restriction notices under section 23 of the Corrupt Practices Act (CPA) in respect of certain bank accounts of Yusuf Investments Limited (YIL), related to the purchase of Amaryllis Hotel by the Public Service Pension Trust Fund. The ACB obtained an interim order from the High Court preserving the operation of the restriction notices pending determination of the appeal. The Financial Intelligence Authority (FIA) issued fresh freezing directives over the same funds, and YIL challenged both the fresh FIA freezing directives and the interim order.

The court has maintained and made final for three months the interim order sustaining the ACB restriction notices.

The Honourable Chief Justice Rizine Robert Mzikamanda, SC, has called on magistrates to uphold the highest standards of integrity, accountability and independence as they discharge their constitutional responsibility of administering justice to the people of Malawi.

The Chief Justice made the call today when he officially opened the 2026 Annual General Meeting (AGM) and Elective Conference of the Association for Magistrates of Malawi (AMA) at Mponela in Dowa District.

In his keynote address, the Chief Justice reminded magistrates that their office carries a responsibility to serve the people with fidelity to the Constitution, loyalty to the law, independence of mind, humility of service and an unwavering commitment to justice.
