أسباب معارضة الانتخابات؟

نعارض الانتخابات البرلمانية القادمة لأنها غير دستورية، فهي تستند إلى قانون انتخابي قضت المحكمة الاتحادية بعدم دستوريته في الدعوى (73 اتحادية / 2023).
كما تُجرى بوجود أحزاب تمتلك فصائل مسلحة تشارك في العمل السياسي بشكل مخالف للدستور والقانون.

ما بُني على باطل يبقى باطلاً،
وكل ما سينتج عن انتخابات غير دستورية غير قانوني وغير ملزم للشعب.

نحن لا نقاطع من أجل المقاطعة
بل نعارض من أجل استعادة الدولة.





Why Do We Oppose the Elections?

We oppose the upcoming parliamentary elections because they are unconstitutional. They are based on an electoral law that the Federal Supreme Court ruled unconstitutional in case (73 Federal / 2023).
Furthermore, these elections are being held while political parties that possess armed factions are allowed to participate, in direct violation of the constitution and the law.

What is built on illegality remains illegitimate,
and everything resulting from unconstitutional elections is invalid and not binding on the people.

We are not boycotting for the sake of boycotting,
we are opposing in order to restore the state.

هل غيّر أحدٌ شيئاً من داخل المنظومة في العراق خلال 22 سنة؟
كل من دخلها إمّا أصبح جزءاً من الفساد أو خرج مكسوراً.
فالمنظومة صُممت لتُثري من يخدمها، وتبتلع من يعارضها.
كيف نطلب من منظومة تحمي السلاح والفساد أن تُصلح نفسها؟

التغيير يبدأ من خارجها.





Has anyone changed anything from within the system in Iraq over the past 22 years?
Everyone who entered it either became part of the corruption, or left defeated.
This system is designed to enrich those who serve it, and crush those who challenge it.
So how can we expect a system that protects weapons and corruption to reform itself?

Real change begins from outside the system.

لماذا يفشل التغيير من داخل المنظومة؟
منظومة الحكم في العراق لا يمكن تغييرها من داخلها لأنها مبنية على حماية نفسها لا إصلاح ذاتها.
كل من يدخلها إمّا يُعاد تشكيله وفق قواعدها أو يُقصى خارجها.
لذلك انتظار التغيير من داخلها هو تأجيل للأزمة لا حلّ لها.

التغيير يبدأ عندما نكسر الإطار لا عندما نتكيّف معه.





Why Does Change Fail from Within the System?
The governing system in Iraq does not transform from within, because it is built to protect itself, not to reform itself.
Anyone who enters it is either reshaped according to its rules, or pushed out entirely.
Therefore, expecting change to come from within is a postponement of the crisis, not a solution to it.

True change begins when we break the frame, not when we adapt to it.

هل يمكن إصلاح منظومة فاسدة من داخلها؟

في العراق، تُطرح دائمًا فكرة "الإصلاح من داخل المنظومة" كخطابٍ مكرر لإيهام الناس بإمكانية التغيير.
لكن الحقيقة أنّ المنظومة التي بُنيت على الفساد والسلاح لا تسمح بإصلاح نفسها، لأنها تستمد قوتها من استمرار الخراب لا إنهائه.





Can a Corrupt System Be Reformed from Within?

In Iraq the idea of “reform from within the system” is constantly presented as a repeated narrative to give people the illusion that change is possible.
But the truth is that a system built on corruption and weapons does not allow itself to be reformed, as it derives its strength from the continuation of destruction, not its end.

وهم التغيير من داخل المنظومة

في العراق، تُسوّق الطبقة الحاكمة لفكرة "الإصلاح من الداخل" كأملٍ زائف لتجميل وجه منظومةٍ غارقةٍ في الفساد والسلاح.
لكن الحقيقة أنّ المنظومة الحالية تمتلك مناعة كاملة ضد أي تغيير جوهري، لأنها بُنيت لحماية مصالحها لا لخدمة الشعب.

أيّ حديثٍ عن التغيير من داخلها هو خداعٌ سياسيّ يهدف لإطالة عمر سلطةٍ فاشلةٍ تحكمها شبكات الولاء والسلاح والمال.
فالنظام الذي ينتج الفساد لا يمكن اصلاحه من داخله .

إنّ التغيير الحقيقي لا يأتي من داخل المنظومة
بل من إرادةٍ مستقلة تكسر حدودها وتعيد بناء الدولة على أسس المواطنة والعدالة والسيادة.

The Illusion of Change from Within the System

In Iraq, the ruling elite promotes the idea of "reform from within" as a false hope to polish the image of a system drowning in corruption and weapons.
But the truth is that the current system has complete immunity against any genuine change, as it was built to protect its own interests, not to serve the people.

Any talk of change from within is a political deception aimed at prolonging the life of a failed authority governed by networks of loyalty, weapons, and money.
A system that produces corruption cannot be reformed from within.

True change does not come from within the system,
but from an independent will that breaks its boundaries and rebuilds the state on the foundations of citizenship, justice, and sovereignty.

لماذا نعارض الانتخابات؟

نقف اليوم بوضوح إلى جانب الدستور والإرادة الشعبية، ونعلن معارضتنا للانتخابات القادمة لأنها تجري في ظل خروقات دستورية و قانونية وهيمنة السلاح السياسي، ما يجعلها بعيدة عن معايير العدالة والمنافسة النزيهة.
موقفنا ليس عزوفًا عن المشاركة بل احتجاجآ -وفق المسار القانوني والدستوري - على واقع انتخابي مشوَّه يفقد معناه عندما تتحكم به الاحزاب المسلحة.
ندعو إلى إصلاح شامل للمسار الانتخابي يضمن صون الدستور و سيادة القانون وجوهر الديمقراطية وحق المواطن في اختيارٍ حرّ.

Why We Oppose the Elections
We stand today firmly on the side of the Constitution and the people’s will, declaring our opposition to the upcoming elections, which are being held amid constitutional and legal violations and under the domination of armed political forces—conditions that strip the process of fairness and genuine competition.

Our stance is not a withdrawal from participation, but rather a lawful and constitutional act of protest against a distorted electoral reality that loses its meaning when armed parties control it.

We call for a comprehensive reform of the electoral process that safeguards the Constitution, the rule of law, the essence of democracy, and the citizen’s right to a free choice.

كفعلٍ احتجاجي تجاه الخروقات الدستورية والقانونية، نوضح من خلال هذا الفيديو موقفنا المعارض للانتخابات، وبيان الفرق بين معارضة الانتخابات ومقاطعتها.
إنّ موقفنا هذا من الانتخابات القادمة بسبب ما تتضمنه من انتهاكات خطيرة تمسّ الدستور.

رسالة إلى المفوضية العليا المستقلة للانتخابات ودائرة الأحزاب والتنظيمات السياسية

نطالبكم اليوم، باسم الدستور والقانون وحق المواطن العراقي في انتخابات عادلة، بأن تؤدوا واجبكم الدستوري وتتحركوا فورًا نحو حلّ الأحزاب المسلحة ومنعها من المشاركة في الانتخابات المقبلة.

لقد بات واضحًا أن استمرار هذه الأحزاب في المشهد السياسي يشكّل انتهاكًا صارخًا للدستور وإخلالًا بمبدأ تكافؤ الفرص ويحوّل العملية الانتخابية إلى ساحة تحت هيمنة الس..لاح والتهديد.

إن واجب المفوضية ودائرة الأحزاب ليس الحياد أمام خرق القانون، بل تنفيذ القانون دون تردد وحماية إرادة العراقيين من الابتزاز المس..لح ومن التزوير السياسي المغلف بالديمقراطية.

إن الشعب يتابع والتاريخ يسجل، ولن يُغفر لمن يتقاعس عن واجبه في حماية الدولة والقانون.

الأستاذ حسن سرحان / القيادي في تجمع الاستقلال العراقي
يؤكد بالأدلة القانونية أن حركة "حقوق" — المسجّلة رسميًا بالإجازة رقم (47) — ترتبط ارتباطًا مباشرًا بـ كـتـائـ*ب حـ.ـز.ب الـلـه، وهي قوة مسلّحة تعمل خارج إطار القوات المسلحة العراقية.

هذا الارتباط يُعدّ انتهاكًا صريحًا للدستور والقانون، إذ:

يخالف المادة (9/ب) من الدستور العراقي التي تنص على:

"يحظر تكوين ميليشيات عسكرية خارج إطار القوات المسلحة."

كما يخالف المادة (8/ثالثًا) من قانون الأحزاب والتنظيمات السياسية رقم (36) لسنة 2015 التي تنص على:

"أن لا يكون تأسيس الحزب وعمله متخذًا شكل التنظيمات العسكرية أو شبه العسكرية، كما لا يجوز الارتباط بأية قوة مسلّحة."

وبناءً على ذلك، فإن استمرار حركة "حقوق" في العمل السياسي بصيغتها الحالية يستوجب الحلّ قانونًا.

هذه ليست مجرد مطالبة قانونية، بل صرخة من أجل العدالة والدستور، وخطوة لتحرير القضاء من الضغوط السياسية، وتمهيد الطريق نحو عراق تُحكم فيه القوانين لا البنادق.

Mr. Hassan Sarhan / Leader in the Iraqi Istklal Assembly

Confirms, with clear legal evidence, that the “Huquq Movement” — officially registered under license No. (47) — has a direct affiliation with Kata*ib Hezbo*llah, an armed group operating outside the framework of the Iraqi Armed Forces.

This affiliation represents a blatant violation of the Iraqi Constitution and the Political Parties Law, as it:

Contradicts Article 9(b) of the Iraqi Constitution, which explicitly states:

“The formation of military militias outside the framework of the armed forces is prohibited.”

And violates Article 8(Third) of the Political Parties and Organizations Law No. (36) of 2015, which stipulates:

“The establishment and work of a party shall not take the form of military or paramilitary organizations, and it is prohibited to be linked with any armed force.”

Accordingly, the continued activity of the Huquq Movement in its current form legally necessitates its dissolution.

This is not merely a legal demand, but a call for justice and constitutional integrity, and a step toward liberating the judiciary from political pressure — paving the way for an Iraq governed by laws, not by guns.

نبدأ اليوم مرحلة جديدة من المواجهة السلمية عبر الحملة القانونية لتقرير مصير العراق ( حل الأحزاب المسلحة وحماية الديمقراطية )، دفاعًا عن حق المواطن في دولة خالية من سطوة السلاح ومن هيمنة الأحزاب المسلحة.

في 27 آب 2025، تحركنا رسميًا بتقديم شكاوى ودعاوى أمام المفوضية العليا المستقلة للانتخابات والمحكمة الاتحادية، ضد من حوّل العمل السياسي إلى غطاء لتشكيلات مسلّحة، وضد قانون انتخابي يُكرّس نفوذها.

هذه ليست مجرد خطوة قانونية، بل صرخة من أجل العدالة والدستور، وتحرير القضاء من الضغوط السياسية وخطوة أولى نحو عراق تحكمه القوانين لا البنادق.
