सबसे पहले हमें प्रो. अली खान महमूदाबाद की गिरफ़्तारी में पुलिस की तत्परता पर ध्यान देना चाहिए। रात 8 बजे रिपोर्ट दर्ज की जाती है और कुछ ही समय में, अगली सुबह पुलिस दूसरे राज्य में "आरोपी" के दरवाज़े पर खड़ी होती है। क्या आपने आम तौर पर किसी अपराध के मामले में भारतीय पुलिस की इस तरह की तत्परता देखी है? क्या भारतीय पुलिस थानों में एफ़आईआर दर्ज करवाना इतना आसान है? रविवार की सुबह-सुबह पुलिस द्वारा की गई इस कार्रवाई का एक और मतलब है। राहत के लिए या गिरफ़्तारी को रोकने के लिए किसी अदालत से संपर्क करना संभव नहीं था क्योंकि यह रविवार था। इसका मतलब था कि महमूदाबाद कम से कम एक पूरे दिन हिरासत में रहेगा। भारतीय पुलिस को लोगों की आज़ादी छीनने में यही मज़ा आता है। हरियाणा पुलिस की कार्रवाई की निगरानी कर रहे वकीलों ने इस लेखक को बताया कि पुलिस ने ट्रांजिट रिमांड हासिल किए बिना ऐसा किया, जिसे सुप्रीम कोर्ट समेत कई अदालतों ने कानून के तहत ज़रूरी माना है। इसने पुलिस की कार्रवाई को अपहरण का एक रूप बना दिया - एक अवैधानिक कृत्य। लेकिन पुलिस को इससे क्या फ़र्क पड़ता है? लगभग सभी राज्यों के भारतीय पुलिस की ऐसी अवैध कार्रवाइयों से परिचित हैं और अक्सर इसके शिकार भी हुए हैं। फिर महमूदाबाद को अलग व्यवहार की उम्मीद क्यों करनी चाहिए? क्या उन्हें सिर्फ इसलिए उच्च स्थान दिया जाना चाहिए क्योंकि वे अशोका विश्वविद्यालय जैसे प्रतिष्ठित संस्थान में प्रोफेसर हैं? साथ ही, क्या वे भूल गए हैं कि वे मुसलमान हैं? कहा गया कि उनके पोस्ट से समुदायों के बीच नफरत भड़काने या किसी धार्मिक समूह की भावनाओं को ठेस पहुंचाने की संभावना है? और साथ ही उनकी टिप्पणियों से भारत की संप्रभुता को खतरा है? लेकिन कोई भी व्यक्ति, अगर वह समझदार है, यह कैसे निष्कर्ष निकाल सकता है कि उनकी टिप्पणियां देशद्रोही हैं? दरअसल महमूदाबाद ने जो लिखा है, पिछले तीन-चार हफ्तों में अनगिनत लोगों ने इसे दोहराया है। लोग तब चौंक गए जब उन्होंने मंच पर भारत का प्रतिनिधित्व करने वाले एक मुस्लिम अधिकारी को देखा। क्या इस शासन में कोई मुसलमान भारत का प्रवक्ता बन सकता है? नियुक्ति इतनी असाधारण मानी गई कि सभी ने इस पर ध्यान दिया। मुस्लिम बुद्धिजीवियों को जो संकेत दिया जाना था, वह स्पष्ट है: अगर वे सरकार की आलोचना करते हैं तो उनकी अभिव्यक्ति की स्वतंत्रता का अधिकार समाप्त हो जाता है!!

First we must pay attention to the promptness of the police in Prof. Ali Khan Mahmudabad's arrest. A report is registered at 8 pm at night and, within no time, the very next morning, the police are standing at the door of the “accused” in another state. Have you generally seen this level of promptness by the Indian police in any crime case? Is it even so easy to get an FIR registered in Indian police stations? This action by the police early Sunday morning carries another meaning. It was not possible to approach any court for relief or to stop the arrest because it was a Sunday. It meant that Mahmudabad would remain in custody for at least one full day. That is the pleasure the Indian police take in depriving people of their liberty. Lawyers monitoring the Haryana police’s action told this writer that the cops did so without obtaining a transit remand, which courts including the Supreme Court have noted is required by law. This made the police action a form of kidnapping – an illegal act. But how does that matter to the police? Indians across nearly all states are familiar with such illegal actions of the police and have often been victims of them. Then why should Mahmudabad expect different treatment? Should he be placed on a higher pedestal just because he is a professor at Ashoka University, an elite institution? Also, has he forgotten that he is a Muslim? It was said that his post has the potential to incite hatred between communities or hurt the sentiments of any religious group? And also his comments threatened India’s sovereignty? But how can anyone, if they are reasonable, conclude that his comments are seditious? Actually Mahmudabad wrote has been echoed by countless others over the past three to four weeks. People were shocked when they saw a Muslim official on stage representing India. Can a Muslim serve as a spokesperson for India under this regime? The appointment was considered so extraordinary that everyone took note of it. The signal sought to be sent to Muslim intellectuals is clear: their right to free expression disappears if they criticise the government!!
