Namaskar. ONLY A STRONG JUDICIARY CAN ENSURE A HEALTHY DEMOCRACY. Growth and stability of any Nation is determined mainly by its strong judiciary and delivery of speedy justice, without which any statistics of GDP etc makes no sense. This mail comes to you to highlight few current facts, suggestions, and concerns by the writer.
1) 1) The backlog and arrears in
several courts are growing like our population. Officially it is estimated over 300 lakh cases pending in various courts across the country, and still growing, which may take over 40 years to clear. Do we taxpayers and voters of the largest democracy in the world deserve this?
1) 2) Why only one supreme court for such a large country, whereas our neighboring country Pakistan has Two Supreme Courts benches. It is our strong suggestion to establish four more benches of Supreme Courts in the East, West, South and Central India.
1) 3) As compared to any other nation, our judiciary as such is grossly under staffed and this calls for atleast 5 fold increase in the number of judges, which is still not implemented inspite of supreme courts directives. To add to this even the existing vacancies are not filled up for a long time. The actual fact is there are presently 607 judges in the High Courts as against the sanctioned strength of 895, thus a clear vacancy of 288 judges which is 32% of the total strength. This is a clear case of lack of concern and accountability.
1) 4) India Today, the largest circulated weekly of the country in its May 23, 2011 issue, has glorified the image of the Chief Justice of India, the Hon’ble Justice Shri. Kapadia and all 28 Judges his leadership, within one year of assuming office as CJI and for restoring the Supremacy of the Supreme Court. It is a very interesting, enlightening article and this article serves as a revival of our hopes and aspirations. ( I am attaching herewith 8 pages of this article, which makes interesting reading ).
1) 5) The above article only highlights the achievements at the Apex Court level, but What has been achieved at the Supreme Court level, it is everyone’s desire that similar transformation must occur at all High Courts and subordinate courts, where the real problem lies and nothing has changed at these courts, and many of you may have your own pathetic experience to narrate.
1) 6) The undersigned has already written letter to Hon. Union Minister Dr. Veerappa Moily of his personal experiences, struggles at his advanced age, which clearly explains the current scenario existing at the courts. ( copy of my above letter is also attached herewith for your purusal )
2) The time has come for some strong movement and achieve our objective of total judicial reforms and thus save this great nation from turning into a rogue country.
