Namaskar. ONLY A STRONG JUDICIARY CAN ENSURE A HEALTHY DEMOCRACY. Growth and stability of any Nation is determined mainly by its strong judiciary and delivery of speedy justice, without which any statistics of GDP etc makes no sense. This mail comes to you to highlight few current facts, suggestions, and concerns by the writer.

1) 1) The backlog and arrears in

several courts are growing like our population. Officially it is estimated over 300 lakh cases pending in various courts across the country, and still growing, which may take over 40 years to clear. Do we taxpayers and voters of the largest democracy in the world deserve this?

1) 2) Why only one supreme court for such a large country, whereas our neighboring country Pakistan has Two Supreme Courts benches. It is our strong suggestion to establish four more benches of Supreme Courts in the East, West, South and Central India.

1) 3) As compared to any other nation, our judiciary as such is grossly under staffed and this calls for atleast 5 fold increase in the number of judges, which is still not implemented inspite of supreme courts directives. To add to this even the existing vacancies are not filled up for a long time. The actual fact is there are presently 607 judges in the High Courts as against the sanctioned strength of 895, thus a clear vacancy of 288 judges which is 32% of the total strength. This is a clear case of lack of concern and accountability.

1) 4) India Today, the largest circulated weekly of the country in its May 23, 2011 issue, has glorified the image of the Chief Justice of India, the Hon’ble Justice Shri. Kapadia and all 28 Judges his leadership, within one year of assuming office as CJI and for restoring the Supremacy of the Supreme Court. It is a very interesting, enlightening article and this article serves as a revival of our hopes and aspirations. ( I am attaching herewith 8 pages of this article, which makes interesting reading ).

1) 5) The above article only highlights the achievements at the Apex Court level, but What has been achieved at the Supreme Court level, it is everyone’s desire that similar transformation must occur at all High Courts and subordinate courts, where the real problem lies and nothing has changed at these courts, and many of you may have your own pathetic experience to narrate.

1) 6) The undersigned has already written letter to Hon. Union Minister Dr. Veerappa Moily of his personal experiences, struggles at his advanced age, which clearly explains the current scenario existing at the courts. ( copy of my above letter is also attached herewith for your purusal )

2) The time has come for some strong movement and achieve our objective of total judicial reforms and thus save this great nation from turning into a rogue country. इतने सालो में आज पहली बार ये पता चला है कि गंगा के प्रदूषण को साफ़ करने वाला सीवेज ट्रीटमेंट प्लांट भी अडानी की कंपनी चला रही हैं, और मोदी सरकार ने उससे ऐसा समझौता किया है कि किसी समय प्लांट में क्षमता से अधिक गंदा पानी आया तो शोधित करने की जवाबदेही अडानी की कंपनी नहीं होगी

यह जानकारी कल देश की जनता को इलाहाबाद हाईकोर्ट के माध्यम से मिल पाई जब एक जनहित याचिका पर सुनवाई हो रही थी नमामि गंगे परियोजना के महानिदेशक ने कोर्ट को यह जानकारी दी कि सीवेज ट्रीटमेंट प्लांट तो अडानी जी चला रहे हैं

इलाहाबाद हाईकोर्ट के सामने जब सीवेज ट्रीटमेंट प्लांट के कांट्रेक्ट की शर्तो का खुलासा हुआ तो जजों ने अपना माथा पीट लिया क्योंकि अदानी से किए कांट्रेक्ट में यह प्रावधान किया गया है कि किसी समय प्लांट में क्षमता से अधिक गंदा पानी आया तो शोधित करने की जवाबदेही उसकी नहीं होगी.

इलाहबाद हाईकोर्ट ने इस तथ्य पर बेहद तल्ख टिप्पणी करते हुए कहा कि ऐसे करार से तो गंगा साफ होने से रही. कोर्ट ने कहा ऐसी योजना बन रही है जिससे दूसरों को लाभ पहुंचाया जा सके और जवाबदेही किसी की न हो. ऐसा करार कर लिया गया है. कि कंपनी बिना ट्रीटमेंट किए पैसे ले रही है

इलाहाबाद हाईकोर्ट की पूर्णपीठ मुख्य न्यायाधीश राजेश बिंदल, न्यायमूर्ति एम के गुप्ता तथा न्यायमूर्ति अजित कुमार ने कहा कि जब आपने कांट्रेक्ट ही ऐसा किया है है तो ट्रीटमेंट करने की जरूरत ही क्या है ?

हाईकोर्ट ने योगी सरकार के कामकाज पर उंगली उठाते हुए उत्तर प्रदेश प्रदूषण नियंत्रण बोर्ड को भी आड़े हाथो लिया और कहा कि बोर्ड साइलेंट इस्पेक्टेटर बना हुआ है, इसकी जरूरत ही क्या है, इसे बंद कर दिया जाना चाहिए.ऐक्शन लेने में क्या डर है? कानून में बोर्ड को अभियोग चलाने तक का अधिकार है ?

आपकी जानकारी के लिए बता दूं कि नमामि गंगे' परियोजना की डेडलाइन 2020 थी, लेकिन 2022 में अब तक इसके 10 फ़ीसदी प्रोजेक्ट भी ठीक से पूरे नहीं हुए है

ऐसा नहीं है कि कोर्ट के सामने पहली बार यह मामला आया है 2019 में भी इलाहाबाद हाईकोर्ट के तीन जजों की पूर्ण पीठ ने केंद्र सरकार से नमामि गंगे प्रॉजेक्ट कार्य के प्रगति की जानकारी मांगी थी कोर्ट ने पूछा कि जितने भी एसटीपी स्थापित किए गए हैं, वे ठीक से कार्य कर रहे हैं या नहीं? उनकी क्या स्थिति है और गंगा में नाले का गंदा पानी सीधे कैसे जा रहा है? उन्हें रोकने का इंतजाम क्यों नहीं किया गया है और गंगा में न्यूनतम जल प्रवाह रखने की क्या योजना है?

लेकिन उस वक्त आम चुनाव होने थे लिहाजा सुनवाई टलती गई..... और 2022 आ गया

2016 में नमामी गंगे परियोजना का बजट 20,000 करोड रुपए का बनाया गया था साफ़ दिख रहा है कि 20 हजार करोड़ भ्रष्ट्राचार की भेट चढ़ गए हैं

मीडिया पिछ्ले कई दिनों से पश्चिम बंगाल में हुए 20 करोड के भ्रष्टाचार की खबरे सुबह शाम जनता को परोस रहा है लेकिन 20 हजार करोड़ के भ्रष्टाचार पर कोई बात नही हो रही ?........

जब एक शख्स लगभग पैंतालीस वर्ष के थे तब उनकी पत्नी का स्वर्गवास हो गया था। लोगों ने दूसरी शादी की सलाह दी परन्तु उन्होंने यह कहकर मना कर दिया कि पुत्र के रूप में पत्नी की दी हुई भेंट मेरे पास हैं, इसी के साथ पूरी जिन्दगी अच्छे से कट जाएगी।

पुत्र जब वयस्क हुआ तो पूरा कारोबार पुत्र के हवाले कर दिया। स्वयं कभी अपने तो कभी दोस्तों के आॅफिस में बैठकर समय व्यतीत करने लगे।

पुत्र की शादी के बाद वह ओर अधिक निश्चित हो गये। पूरा घर बहू को सुपुर्द कर दिया।

पुत्र की शादी के लगभग एक वर्ष बाद दोहपर में खाना खा रहे थे, पुत्र भी लंच करने ऑफिस से आ गया था और हाथ–मुँह धोकर खाना खाने की तैयारी कर रहा था।

उसने सुना कि पिता जी ने बहू से खाने के साथ दही माँगा और बहू ने जवाब दिया कि आज घर में दही उपलब्ध नहीं है। खाना खाकर पिताजी ऑफिस चले गये।

थोडी देर बाद पुत्र अपनी पत्नी के साथ खाना खाने बैठा। खाने में प्याला भरा हुआ दही भी था। पुत्र ने कोई प्रतिक्रिया नहीं दी और खाना खाकर स्वयं भी ऑफिस चला गया।

कुछ दिन बाद पुत्र ने अपने पिताजी से कहा- ‘‘पापा आज आपको कोर्ट चलना है, आज आपका विवाह होने जा रहा है।’’

पिता ने आश्चर्य से पुत्र की तरफ देखा और कहा-‘‘बेटा मुझे पत्नी की आवश्यकता नही है और मैं तुझे इतना स्नेह देता हूँ कि शायद तुझे भी माँ की जरूरत नहीं है, फिर दूसरा विवाह क्यों?’’

पुत्र ने कहा ‘‘ पिता जी, न तो मै अपने लिए माँ ला रहा हूँ न आपके लिए पत्नी, मैं तो केवल आपके लिये दही का इन्तजाम कर रहा हूँ।

कल से मै किराए के मकान मे आपकी बहू के साथ रहूँगा तथा आपके ऑफिस मे एक कर्मचारी की तरह वेतन लूँगा ताकि आपकी बहू को दही की कीमत का पता चले।’’

माँ-बाप हमारे लिये तो ,हम उनके लिए , Aadhar Card ATM Card तो बन ही सकते है.

Brilliant And Exceptional Activism Shown by A Bench of Honorable Justices DY Chandrachud and MR Shah . Citizens Must Salute the Honorable Justices for Expressing Rather Unpleasant And Sour But Advantageous Truth For Public At Large.

That is why Phrase Expression "Take it as a bitter pill; in the right spirit" is Used At Court proceedings .

Any And All Kinds of Abatement of An Offence , Illegal Activities , Unlawful - Violations Acts fall within jurisdiction of National Human Rights Commission - vis a vis state Human Rights Commissions.

Abetment basically means the Action of instigating , encouraging ,. , Promoting A Person/s , Organisations into committing an offence . It also means aiding the offender/s while committing a Crime . When More than One Person , Organisations Contribute to Committing
a Crime - unlawful Activities , each of their
involvement may Vary as
Decided by Court.

So Any And All Government Servants , Private parties , Individuals , Housing Societies Managing Committee Would be Accountable for Abatement of Crimes.

Further. India has Ratified International Treaties for Convention Against Corruption , Malpractices , Environmental Protection Treaty Other Treaties.

Hence Any Acts of Abetment of Crime , Violations of Environmental Rules , Convention Against Corruption , Senior Citizen's Protection Treaty etc .. .fall within Jurisdiction of Human Rights Commissions to Initiate Appropriate Criminal proceedings at Supreme Court or High Court by Registering FIR.

SUO MOTU Cognisance , FIR And Criminal proceedings are mandatorily required by NHRC And State Human Rights Commissions.

Citizens need not approach any Court. All Courts proceedings will be initiated by Human Rights Commissions .

Precautions to be taken before buying property And Signing Agreement .

Please contact

1. the Secretary/ M. Committee of the society and collect the details of the outstanding on the particular flat. Also will get to know about any defects of title/ membership.

2. Give 15 days prior notice to the society before executing the agreement.

3. Once you desired to purchase it, ask your seller to provide the Xerox copy of chain agreements ( all agreements from builder to the seller)

4. If the flat is under any housing loan, collect a NOC letter from the said bank.

5. Execute an Agreement for Sale ( MOU) describing the mode payment terms and conditions. It must mention the time frame of payment and handing over of possession.

6. For the preparation of all the legal documents you must consult a good civil lawyer. He will manage all your work including the registration of Sale Deed in a proper manner.

7. As a purchaser if you are planning for loan facilities, ensure that you are entitled for such amount of loan. Don't burden yourself if loan is not possible.

TERRACE RIGHTS LAW :-

A developer does not have the legal right to sell an area which is shared by all members of the housing society.

Similarly, some flat- owners of top floors claim ownership of the terrace and deter other owners from using the same. Both these actions do not conform to the prescribed Laws.

1) terrace forms part of common area for benefit of all flat owners

2) no construction ...
Common Roof Rights Cannot Be Sold By Developers -

A terrace that is not accessible from the common areas

as well as counted in Total FSI consumed by Builder

and is attached exclusively to a flat can only be sold to a flat owner but all other terraces are for the common usage.

It is for the same reason a terrace is not included in the Floor Space Index (FSI) of an apartment.
What Is Common Terraces In Housing Societies? -

Common Rooftop , Terraces are Constructed Free of FSI . And all Society Residents have lawful Rights over such Terraces.

A developer does not have the legal right to sell an area which is shared by all members of the housing society.

Similarly, some flat- owners of top floors claim ownership of the terrace and deter other owners from using the same.

A developer does not have any right to sell or lease terrace of the housing society to any particular owner or owners of the properties in the society or anyone else.

Precautions to be taken while purchasing a terrace flat - -

So make sure that before purchasing a terrace flat a copy ... The Agreement should also specify the carpet area clearly along with the Terrace .

If you want to be sure about terrace rights, just file an RTI .... member that reveals an individual's legal name, address, ...
