The Court emphasised that the plaintiff’s rights in the sound recordings were prima facie demonstrated from the documents appended to the plaint. The Court observed that as the exclusive licensee, the plaintiff was entitled to grant licences for public performance and opined that the defendant’s actions on 19 October 2025 and 31 December 2025 amounted to violation of copyright.

In Commercial IP Suit (L) No. 4398 of 2026, the Bombay High Court restrained the owner of The Coffee Next Door from communicating music from PPL’s repertoire at its premises.
The Court observed that Defendant’s Section 60 suit would not bar the Court from granting ad interim relief.
Importantly, the Court rejected the Defendant's contention that the event was a private gathering exempted under Section 52(1)(za) and went on to observe that the, the event was ticketed, and the religious exemption does not extend to such commercial events.
The Court Prima Facie recognised PPL’s rights in its repertoire of sound recordings based on assignment deeds and exclusive agreements, and recorded that such documents are available on PPL’s website and appended to the plaint (in CD form).
