Day 11 of charcha at Aminabaad Police Station

This police station is situated in the heart of city and caters to hundreds of people on an everyday basis. This was one of the busiest station we witnessed. Among the noises and sales pitch voices from the market, we found an acoustic space within station to begin our discussion.
One question was raised on children in conflict with the law. What happens if the individual caught is 17 years or only one month short of being 18 years? Do we treat him or her as a child or an adult? The answer is simple, Juvenile Justice Act, 2016 mandates that every individual who has no completed eighteen years of age on the date of commission of the offence shall be treated as a child only.

Day 10 of charcha at Alambagh Police Station

In our charcha, one of the police personnel shared the story of a 6 years old boy lost in Lucknow mela, who was brought to the police and how scared he was to see the police. It took sometime to calm down the child. They offered biscuits, water and asked where his parents were, their name & if he knew his house contact number. The child managed to find his parents within 2 hours but what this police personnel trying to share was the image child had of police and the fear of uniform. In the law, it is a mandate for the child welfare police officer to be in plain clothes but in this particular case, the immediate contact was the police in uniform. It depicts the fear of police in common public's eyes and among children too. How can we create a bridge between the children, common public, and police department in order to remove this fear?

After the discussion, a question was raised to clarify the process of what happens after the apprehension of child alleged to be in conflict with the law? The answer is- the child should be placed under charge of the special juvenile police unit (SJPU) or the designated Child Welfare Police Officer (CWPO). The SJPU or CWPO shall produce the child in front of the juvenile justice board within 24 hours of apprehending the child. The guardian or the parents of the child shall be informed (if they can be found) asap by the designated CWPO of the police station or the SJPU to which the child is brought. This process can be hectic for the child. How do you think we can help the child? Should police be trained to counsel the children?

The discussion took a different turn here, in Aliganj. The significance of trust, patience, and yoga came into light in healthy development of the child. There was a unison in need of care and protection even for the children in conflict with the law. Even though we've received receptive audience in other police stations, a special shoutout to Aliganj station for their spirit and hope in these children. They actually gave example if their own children and children around them, who've been a part of traumatic environment. These examples were given to acknowledge the impact tauma may have on children's decision making capacity and emotional intelligence.

"We cannot blame family for the juvenile act all the time. What about children of good private and public schools who steal or smoke? They come from an economically well built background." This was a question raised by one of the constables at Mahanagar police station in response to the significance of social background report for the child who comes to the station due to his or her alleged act of criminal offence. For our online community, social background report is Form 1 from the Juvenile Justice (Care & Protection of Children) Act, 2015 that takes into the family details, child's physical and mental ability, habits of the child, education details, reasons for leaving the school, etc. of the apprehended child, alleged to be in conflict with the law. The logic is to have a humble understanding of where the child is coming from in order to provide the right help.

Though we cannot deny the economic background of the child but we cannot generalize it as well. Economy is not always the cause for alleged criminal act by a child, there could be n number of other factors, such as peer influence, observational learning via media or everyday instances, physical or sexual assault (direct or indirect), non availability of parental care and protection, etc. This is important to understand because by one stereotype and biased opinion, we can change a child's future. That's why we began this discussion. We may not like his question but the beauty of it is the initiative. An initiative to ask and understand.

The addiction problem among the teens was one of the reasons raised for the increasing number of children in conflict with the law. Our police personnel shared a story of a 15 years old child who used to sniff markers a lot. The child had family but the child was so addicted that he would go back to sniffing. In such cases, police says, they want to help but don't know how. They understand that this child stole mobile phones to get money to buy more markers. These markers are easily available in the market too. Another case was that of an inspector's child. A 16 years old, only child in the family, loved and taken care of but still ended up stealing. Not once but many times.

Both the children tried stealing but for very different reasons. One did it because he was addicted and the other because his friends asked him to. This shows that we can never generalize the idea of a child who commits crime. It is important to look at their Psycho-social backgrounds to be able to truly help them. In the two cases, the addicted child needed an emergency de-addiction intervention and in the other case, an immediate intervention to eliminate the bad peer influence. To help them further, a good child counsellor or a psychologist could help them not go back to the same space.

During the charcha, following was discussed in length:

Impact of trauma on brain. It has been shown in many studies that high level of stressors hormones effect the development of connections to and within the prefrontal cortex of the brain. Prefrontal cortex is responsible for decision making and is involved in emotional responses. This stays under development process for children as it becomes fully functional around the age of 25. This is significant to understand because we often assume a child in conflict with the law as a mature individual who knew what he or she did and deserves severe punishment too.

The fourth day was met with a lot of appreciation for a discussion on effect of trauma on child's psyche. By the end of this charcha, one of the police personnel shared a story of a heinous murder commited by a child. While handling this case, he was shocked to see the details with which this child had planned the muder and that changed his perspective towards the child in conflict. For this police personnel, it is difficult to see a child in conflict with the law as a child in need of care and protection and as a facilitator, team understands this. This is where the challenge lies. How do we shift this perspective? Through discussions we managed to reach a point where he was okay to see every child through a new perspective. We don't know if his changed perspective will sustain but hope is the key. What would you say to this police personnel?

Day 3 of charcha with police personnel of Lucknow, Uttar Pradesh. The third day of our charcha began with Gautam Palli police station.

Gautam Palli saw influx of questions about how to change public's opinion of a child who breaks the law. For example, there are times when public beats the child for stealing. Mob numbers are larger than the cop numbers and thus, it becomes very difficult to rescue the child. In such situations, fighting the public becomes an unsafe act for the police. Many a times, police is blamed for supporting a criminal child. Third day brought the element of listening and jotting down the challenges faced by the police department. Apart from mob beating, challenge of unavailability of accomodation in child care institutions was also brought into light.
