MEHRAJ MALIK'S APPLICATION LISTED TODAY BEFORE THE HON’BLE HIGH COURT OF J&K AND LADAKH AT JAMMU.

HC RECORDS GOVT OF J&K'S STATEMENT TO ENSURE THAT THE DETENUE, SHALL BE ALLOWED TO CAST HIS VOTE FOR THE UPCOMING RAJYA SABHA ELECTION.

HC TO HEAR THE SECOND PRAYER FOR PARTICIPATION IN THE UPCOMING ASSEMBLY SESSION ON THE 27TH OF OCTOBER 2025.

Today Justice Rajesh Sekhri of High Court of J&K and Ladakh at Jammu, heard the application filed by the detenue, seeking permission to participate in the upcoming assembly session of J&K and to cast his vote for the Rajya Sabha election, which is scheduled to be held on 24th of October 2025.

When the above-mentioned application, was taken up for hearing, Sr. Advocate Rahul Pant with Advocates S.S. Ahmed, Muzaffar Iqbal Khan, Appu Singh Slathia, Tariq Mughal and M. Zulkarnain Chowdhary submitted that they have filed an application seeking permission for the detenue to participate in the upcoming assembly session of J&K and to cast his vote for the Rajya Sabha election, which is scheduled to be held on 24th of October 2025.

Furthermore, they emphatically put forth that the application is required to be considered today itself, due to the urgency involved in the matter.

Senior Advocate Sunil Sethi with Senior AAG Monika Kohli appeared for the government of J&K and apprised the esteemed Court that they have filed the reply to the application, yesterday, to which the court responded that the same is not on record. Moreover, Senior Advocate Sunil Sethi submitted that they have already sent the postal ballot paper to the competent authority for the needful with respect to the casting of the vote by the detenue.

It is pivotal to mention that the Hon'ble Court after considering the submissions made by both the parties, directed the government to ensure that the detenue shall be allowed to cast his vote as per the mandate of law. However, the Hon'ble Court directed the registry to place on record the objection to the application and further directed to list this application again on 27th of October 2025 at top of the list for consideration of the second prayer, with respect to the detenue's participation in the upcoming assembly session, which commences on the 23rd of October 2025.

HC DIRECTS GOVT OF J&K TO FILE RESPONSE BY OR BEFORE THE 18TH OF OCT 2025 IN AN APPLICATION FILED BY THE DETENU, SEEKING PARTICIPATION IN THE UPCOMING ASSEMBLY SESSION AND PERMISSION TO CAST HIS VOTE FOR THE RAJYA SABHA ELECTION.

HC ALSO GRANTS TIME TO THE GOVERNMENT OF J&K TO FILE THE REPLY IN THE MAIN HABEAS CORPUS PETITION, BY OR BEFORE THE 11TH OF NOVEMBER 2025.

Today Justice Sanjay Dhar of High Court of J&K and Ladakh at Jammu, directed the Government of J&K to file their reply in an application filed by the detenue, seeking permission to participate in the upcoming assembly session of J&K and to cast his vote for the Rajya Sabha election, which is scheduled to be held on 24th of October 2025.

When the above-mentioned petition along with applications, were taken up for hearing, Sr. Advocate Rahul Pant with Advocates S.S. Ahmed, Muzaffar Iqbal Khan, Appu Singh Slathia, Tariq Mughal, M. Zulkarnain Chowdhary and Joginder Singh Thakur submitted that they have filed an application seeking permission for the detenue to participate in the upcoming assembly session of J&K and to cast his vote for the Rajya Sabha election, which is scheduled to be held on 24th of October 2025. Furthermore, they emphatically put forth that the replies in the main petition have not been filed till date. It was humbly and vociferously submitted that the applications are of emergent nature, therefore should be considered expeditiously so that the detenue can participate in the upcoming assembly session of J&K and can cast his vote for the Rajya Sabha election, which is scheduled to be held on 24th of October 2025.

Senior Advocate Sunil Sethi with Senior AAG Monika Kohli appeared for the government of J&K and sought time to file reply in the applications as well as the main petition.

After considering the pleas of both the parties, Honorable Justice Sanjay Dhar grated time to the government of J&K to file the reply in the application by or before the 18th of October 2025 and to file reply in the main petition by or before the 7th of November 2025 with further direction to keep record available on the 7th of November 2025 for consideration of the matter.

Aam Aadmi Party Jammu & Kashmir Launches Statewide Signature Campaign for Repeal of PSA and Release of Mehraj Malik

The Aam Aadmi Party (AAP) Jammu and Kashmir has launched a statewide signature campaign demanding the repeal of the Public Safety Act (PSA) from Jammu and Kashmir and the immediate release of Mehraj Malik, who has been unjustly detained under this draconian law.

Speaking to the media, Muddasir Hassan, Spokesperson AAP J&K, said that the campaign, which was launched recently, has now entered its second phase. In this phase, the party will reach out to all political parties across Jammu and Kashmir to seek their support.

> “We will take this signature campaign to every political party, including the Chief Minister of J&K, Omar Abdullah, and all present MLAs, to seek their signatures and solidarity for this cause,” said Muddasir Hassan.

He emphasized that the Aam Aadmi Party is determined to work for the youth of Jammu and Kashmir, ensuring that no black laws like the PSA are allowed to suppress their democratic rights. The party remains committed to building a Jammu and Kashmir that is defined by peace, prosperity, and progress.

Criticizing the double standards of the ruling Bharatiya Janata Party (BJP), Muddasir Hassan remarked, “On one hand, the BJP claims that peace has been restored in Jammu and Kashmir, yet on the other, they continue to enforce laws like the Public Safety Act that are used to silence the youth and curb dissent.”

He further pointed out that the PSA was originally intended for use against forest offenders, but its current application against civilians and youth is unjust and unacceptable.

In conclusion, the Aam Aadmi Party Jammu and Kashmir reiterated its demand for the immediate repeal of the Public Safety Act and the release of Mehraj Malik. The party also reaffirmed its commitment to contest the upcoming elections with full strength and determination to bring real governance, accountability, and justice to the people of Jammu and Kashmir.
