প্রতিহিংসাপরায়ণ রাজনীতি শুরু করেছে রাজ্যে সদ্য আসীন বিজেপি সরকার। বেআইনি বাড়ি ভাঙার নাম করে বেআইনিভাবে তারাই বুলডোজার চালিয়ে মানুষকে পথে বসাচ্ছে বলে মন্তব্য করেছেন আইএসএফ চেয়ারম্যান তথা বিধায়ক নওসাদ সিদ্দিকী। তিনি আজ তিলজলায় এলাকায় গিয়েছিলেন যেখানে সম্প্রতি একটি কারখানায় আগুন লেগেছিল। সেই কারখানটিকে ভেঙে ফেলার জন্য তড়িঘড়ি নির্দেশ দেওয়া হয়। ঐ কারখানার মাধ্যমে কমপক্ষে ৫০ জন মানুষের পরিবারের সংসার চলত। কারখানার জিনিসপত্র সহ অন্যান্য আনুষঙ্গিক উপকরণ সরানোর সময় দেওয়া হয়নি বলে অভিযোগ। এমনকি ভেঙে ফেলার নোটিশও দেখানো হয়নি। তাছাড়া, এটা দেখা যাচ্ছে যে অগ্নি বীমা পুনর্নবীকরণ শংসাপত্র ছাড়া অন্যান্য আনুষঙ্গিক কাগজপত্র আইন মাফিক ঠিক আছে। যা নথিপত্র আমাদের হাতে এসেছে সেটি থেকে এটা সুস্পষ্ট যে ১৯৯২ সালের নভেম্বর মাসে এই সম্পত্তি কেনা হয়েছে। তখন থেকেই নিয়মিতভাবে কলকাতা কর্পোরেশনকে ট্যাক্স দেওয়া হচ্ছে। কারখানা চালানোর লাইসেন্স প্রদান করা হয়েছে। সেটি বহাল আছে আগামী ২০২৯ সাল পর্যন্ত। সুতরাং কারখানা চালানোর 'ফিট সার্টিফিকেট' রয়েছে। অগ্নি নির্বাপক ব্যবস্থা সংক্রান্ত বিষয়েও দেখা যাচ্ছে যে সরকারী গড়িমসি এর জন্য দায়ী। ঐ এলাকায় ২০২৪ সাল থেকে এই ব্যাপারে কোন আবেদনপত্র নেওয়া হচ্ছে না। অথচ, এগুলিকে যাচাই করার সময়টুকুও সরকারের হয়নি। ২৪ ঘন্টা কাটতে না কাটতেই বুলডোজার চালিয়ে দেওয়া হল। এলাকায় আরো অনেক বাড়িতেও এই বুলডোজার চালানো হবে বলে অভিযোগ আসছে।
উল্লেখ্য, ২০২৪ সালের ১৩ ই নভেম্বর সুপ্রিম কোর্টের প্রধান বিচারপতি বি আর গাভাই এবং বিচারপতি কে ভি বিশ্বনাথনের বেঞ্চ 'বুলডোজার অ্যাকশন' সংক্রান্ত একটি গাইডলাইন দেন। যেখানে প্রথমেই উল্লেখ করা হয়েছে যে ভাঙার আগে নোটিশ দেওয়া বাধ্যতামূলক। তাছাড়া অভিযুক্তকে শুনানি ও আদালতে যাওয়ার পর্যাপ্ত সুযোগ দিতে হবে। সুপ্রিম কোর্ট স্পষ্টভাবে জানিয়েছে যে 'রুল অফ ল' বা আইনের শাসনের বাইরে গিয়ে কোন সরকার বুলডোজারকে শাস্তির হাতিয়ার হিসেবে ব্যবহার করতে পারেনা।
নওসাদ সিদ্দিকী এদিন সরেজমিনে এলাকা ঘুরে দেখেন। তিনি বলেন, ঐ বাড়ির মানুষদের সঙ্গেও কথা হয়েছে। এলাকার মানুষও ক্ষোভে ফুঁসছে। তারা সুবিচার চাইছেন। স্থানীয় কাউন্সিলরও এদের পাশে নেই। প্রয়োজনে আইনী সাহায্য নিতে হবে। এতগুলি অসহায় পরিবারের পুনর্বাসনের ব্যবস্থা সরকারকে করতে হবে। তারা বেআইনি নির্মাণের ক্ষেত্রে জিরো টলারেন্স বলছেন বটে। কিন্তু নিজেরাই বেআইনি কাজ করছেন। তিনি বলেন, বাড়ি খালি করতে হলে, সরকারকে একটা নির্দিষ্ট সময় দিতে হবে বাসিন্দাদের। এত অসহিষ্ণুতা দেখানোর কারণ কি? তারা তো কর্পোরেশনকে কর দিচ্ছেন। জল ও বিদ্যুৎ অত্যাবশ্যকীয় পরিষেবার মধ্যে পড়ে। এই পরিষেবা থেকে পরিবারগুলিকে বঞ্চনা করে রাখার মানে হচ্ছে মানবাধিকার লঙ্ঘনের করা হচ্ছে। এগুলি চালু রাখতেই হবে। তাছাড়া জল ও বিদ্যুতের সংযোগ কাটতে গিয়ে আশপাশের বাড়িগুলিরও সংযোগ ব্যবস্থা কেটে দেওয়া হয়েছে। এটা অন্যায়। যত শীঘ্র সম্ভব এই সংযোগগুলিকে চালু করতে হবে। অবশ্যই বেআইনি বাড়ি ভাঙতে হবে, কিন্তু সেটি আইন মেনেই করতে হবে বলে ভাঙড়ের বিধায়ক মন্তব্য করেন। তিনি এদিন এই বিষয়ে প্রবীণ আইনজীবী বিকাশরঞ্জন ভট্টাচার্যের সঙ্গেও কথা বলেন। প্রয়োজনে আইনী সহায়তা দেওয়া নিয়ে কথা হয়।

The newly-elected BJP government in West Bengal has started vindictive politics. In the name of demolishing illegal houses, they are illegally driving bulldozers and putting people on the road, said ISF Chairman and MLA Nawsad Siddiqui. Today he went to the Tiljala area of Kolkata where a leather factory had recently caught fire. Hasty orders were given to demolish that house. The factory was used to support at least 50 families. It is alleged that no time was given to remove the factory equipment and other ancillary products. Even the demolition notice was not shown. Moreover, it appears that documents, except for the fire insurance renewal certificate, are in order as per the law. From the documents that have come to our hands, it is clear that the property was purchased in November 1992. Since then, taxes have been paid regularly to the Kolkata Municipal Corporation. A license to run the factory has been issued. It is valid until 2029. So there is a 'fit certificate' to run the factory. It is also seen that government delay is responsible for this in the matter of fire extinguishing system. No applications are being received in this regard in that area since 2024, we are told. However, the government has not even had time to verify these documents. Within 24 hours, the bulldozer was put into use. There are allegations that bulldozers will be used on many more houses in the area as well.
It is worth noting that on November 13, 2024, a bench of Chief Justice B R Gavai and Justice K V Vishwanathan of the Supreme Court issued a guideline on 'Bulldozer Action'. The first point is that, it is mandatory to give notice before any demolition takes place. Moreover, the accused must be given adequate opportunity to be heard and go to court. The Supreme Court has clearly stated that no government can use bulldozers as a tool of punishment beyond the 'rule of law'.
Nawsad Siddiqui visited the spot today and spoke to the affected people. He said, the people of the area are fuming with anger. They are seeking justice. The local councilor is not on their side either. If necessary, legal help will have to be sought. The government will have to make arrangements for the rehabilitation of so many helpless families. The Chief Minister said zero tolerance for illegal construction. But they themselves are doing illegal work. He further said if at all the houses are to be vacated, the government should give the residents a specific time. Why is there so much intolerance? They are paying taxes to the Municipal Corporation. Water and electricity are essential services. Depriving families of these services is a violation of human rights. These services must be kept running. Moreover, while cutting off water and electricity connections, the connections of the surrounding houses have also been cut off. This is unfair. These connections should be made operational as soon as possible. Of course, illegal houses should be demolished, but it should be done according to the law, said Siddiqui. He also consulted senior lawyer Bikash Ranjan Bhattacharya on this issue later in the evening. They talked about providing legal assistance if needed.
