Public Notice Issued by the RWA in the Public Interest
As per Hon'ble Supreme Court's judgment dated 19th May '26 in Suo Moto WP(C) 5/2025, to control the stray dog menace, citizens may note the following:
1. All applications filed by NGOs for the modification of Hon'ble SC orders dated 22nd Aug & 7th Nov '25 for removal of stray dogs, have been dismissed.
2. Stray dogs do not have the right to occupy any public or private premises. Safety from stray dogs and the fundamental and Article 21 rights of people cannot be compromised in any way by authorities.
3. All stray dogs are to be immediately & permanently removed from public places like schools/colleges, hospitals, train/bus stations, highways, airports, tourist spots, religious premises, sports stadia, public parks, or any area with high footfall of people, with no scope for release anywhere.
4. Any student-led body keen to feed stray dogs in educational institutions, shall file an affidavit with the Head of the Institution, accepting all tortious liability and culpability for stray dog attacks, failing which no such activity of maintaining or feeding stray dogs is permitted in the premises.
5. Stray dogs that have bitten/attacked a person for any reason or are exhibiting aggressive behaviour or are demonstrably dangerous, may be euthanised by authorities.
6. Stray dog feeding on the streets or any premises is prohibited. Stray dogs can only be fed in designated spots identified by the municipality in municipal wards.
7. Any NGO/feeder/activist or govt authority obstructing or violating the SC directions is liable for penal & contempt action.
8. These directions do not allow any involvement, interpretation or action by any NGO/activist nor application of provisions of the ABC rules and Hon'ble Supreme Court orders are not to be diluted in any way by any entity, authority or court.
9. A lack of funds or infrastructure cannot be used as an excuse by authorities to not implement court orders for removal of stray dogs.
*What you can do:*
a. Document the stray dog menace, bites, illegal feeding and/or non-compliance or obstruction of court orders by any person or entity, lodge a complaint with the Municipal/Police Commissioner and copy the same to the Chief Secretary of your State and ask for the permanent removal of stray dogs as per SC orders.
b. Do not engage with NGOs and stray dog feeders/activists. Taking pictures of anyone feeding in public places or violating the SC directions in any way, is not an offence.
c. File a petition in your State High Court with regard to non-compliance or violation of the Hon'ble Supreme Court judgment or any related stray dog issue.

माननीय सुप्रीम कोर्ट के 19 मई '26 के फ़ैसले के अनुसार (Suo Moto WP(C) 5/2025), आवारा कुत्तों की समस्या को नियंत्रित करने के लिए, नागरिक निम्नलिखित बातों पर ध्यान दें:
1. आवारा कुत्तों को हटाने के लिए माननीय SC के 22 अगस्त और 7 नवंबर '25 के आदेशों में बदलाव के लिए NGOs द्वारा दायर सभी आवेदन खारिज कर दिए गए हैं।
2. आवारा कुत्तों को किसी भी सार्वजनिक या निजी जगह पर रहने का अधिकार नहीं है। आवारा कुत्तों से सुरक्षा और लोगों के मौलिक तथा अनुच्छेद 21 के अधिकारों से अधिकारी किसी भी तरह से समझौता नहीं कर सकते।
3. सभी आवारा कुत्तों को स्कूलों/कॉलेजों, अस्पतालों, ट्रेन/बस स्टेशनों, हाईवे, हवाई अड्डों, पर्यटन स्थलों, धार्मिक स्थलों, खेल स्टेडियमों, सार्वजनिक पार्कों, या जहाँ लोगों की बहुत ज़्यादा आवाजाही होती है, जैसी सार्वजनिक जगहों से तुरंत और हमेशा के लिए हटा दिया जाए; उन्हें कहीं भी वापस छोड़ने की कोई गुंजाइश नहीं है।
4. कोई भी छात्र-संगठन जो शिक्षण संस्थानों में आवारा कुत्तों को खाना खिलाना चाहता है, उसे संस्थान के प्रमुख के पास एक हलफ़नामा (affidavit) जमा करना होगा, जिसमें वह आवारा कुत्तों के हमलों से होने वाली सभी कानूनी देनदारियों और दोषों को स्वीकार करेगा; ऐसा न करने पर, परिसर में आवारा कुत्तों को रखने या खाना खिलाने की ऐसी कोई भी गतिविधि की अनुमति नहीं होगी।
5. जिन आवारा कुत्तों ने किसी भी कारण से किसी व्यक्ति को काटा/हमला किया है, या जो आक्रामक व्यवहार दिखा रहे हैं, या जो साफ़ तौर पर खतरनाक हैं, उन्हें अधिकारी दया-मृत्यु (euthanasia) दे सकते हैं।
6. सड़कों या किसी भी परिसर में आवारा कुत्तों को खाना खिलाना मना है। आवारा कुत्तों को केवल नगर निगम के वार्डों में, नगर निगम द्वारा तय की गई जगहों पर ही खाना खिलाया जा सकता है।
7. कोई भी NGO/खाना खिलाने वाला व्यक्ति/कार्यकर्ता या सरकारी अधिकारी जो SC के निर्देशों में रुकावट डालता है या उनका उल्लंघन करता है, वह दंडात्मक और अवमानना की कार्रवाई का हकदार होगा।
8. ये निर्देश किसी भी NGO/कार्यकर्ता द्वारा किसी भी तरह की दखलंदाज़ी, व्याख्या या कार्रवाई की अनुमति नहीं देते हैं; न ही ABC नियमों के प्रावधानों को लागू करने की अनुमति देते हैं। माननीय सुप्रीम कोर्ट के आदेशों को किसी भी संस्था, अधिकारी या अदालत द्वारा किसी भी तरह से कमज़ोर नहीं किया जा सकता।
9. आवारा कुत्तों को हटाने के लिए अदालत के आदेशों को लागू न करने के बहाने के तौर पर अधिकारी फंड या बुनियादी ढांचे की कमी का इस्तेमाल नहीं कर सकते।
*आप क्या कर सकते हैं:*
a. आवारा कुत्तों की समस्या, उनके काटने की घटनाओं, उन्हें अवैध रूप से खाना खिलाने, और/या किसी भी व्यक्ति या संस्था द्वारा अदालत के आदेशों का पालन न करने या उनमें रुकावट डालने के मामलों का दस्तावेज़ीकरण करें। म्युनिसिपल/पुलिस कमिश्नर के पास शिकायत दर्ज कराएं और उसकी एक प्रति अपने राज्य के मुख्य सचिव को भी भेजें, तथा सुप्रीम कोर्ट के आदेशों के अनुसार आवारा कुत्तों को स्थायी रूप से हटाने की मांग करें।
b. NGOs और आवारा कुत्तों को खाना खिलाने वालों/कार्यकर्ताओं के साथ किसी भी तरह की बहस या बातचीत में न पड़ें। सार्वजनिक स्थानों पर किसी को भी खाना खिलाते हुए, या किसी भी तरह से सुप्रीम कोर्ट के निर्देशों का उल्लंघन करते हुए किसी व्यक्ति की तस्वीरें लेना कोई अपराध नहीं है।
c. माननीय सुप्रीम कोर्ट के फैसले का पालन न करने या उसके उल्लंघन के संबंध में, अथवा आवारा कुत्तों से जुड़े किसी भी अन्य मुद्दे पर, अपने राज्य के हाई कोर्ट में एक याचिका दायर करें।
