Court Update.

Republic v Kwabena Adu Boahene & 2 Ors (Cybersecurity software case)

Lawyer Samuel Atta Akyea, Counsel for the accused persons is present in Court.

The Court has rejected prayer by Counsel for the accused persons to stay proceedings to wait for the outcome of a Review application filed by Mr Kojo Oppong Nkrumah in the injunction decision delivered last Friday by the Supreme Court.

Counsel has just begun cross examination of the 4th and last prosecution witness after a further prayer for adjournment was also refused.

Court Update.

For the third time, the High Court, Accra has granted a further extension to the accused persons in Republic v Solomon Asamoah & Another (Skytrain Case) to file their defence if they wish to do so.

On July 2, the Court dismissed the two accused persons’ submissions of no case, and directed them to, within 21 days, file their respective defences if they wish to.
At the expiration of the 21 days none of the accused persons filed their defence. On July 30, the Court gave the accused persons another 21 days within which to file their defences.

The Court then adjourned to today, Monday August 24 to conduct case management conference for the defence but the accused persons again failed to file their defence prompting the Court to give them a further extension to Wednesday, September 23 to file their defence.

The two accused persons are standing trial for allegedly paying $2million for a Skytrain project without board approval.

The Republic v Solomon Asamoah & Prof Ameyaw-Akumfi (Skytrain Case)

On July 2, the trial Court dismissed the two Accused Persons’ submissions of no case, and directed them to, within 21 days, file their respective defences if they wish to. On the 21st day of the directive, none of the two Accused Persons had filed a defence. Rather, they filed an application for stay of proceedings. On July 30, the Court gave the 2 Accused Persons another 21 days within which to file their defences, making a total of 42 days.

The Court, then, adjourned the case to Monday, August 24, to conduct case management conference.

Yesterday, August 21, a day after the extra 21 days, however, Accused Solomon Asamoah’s lawyers filed two applications at the Supreme Court. The first application is for an order of certiorari to quash the dismissal of the submission of no case and the variation of Solomon Asamoah’s bail conditions. The second application is for an order of interlocutory injunction pending the determination of the certiorari application. The two gentlemen have still not filed a defence.

The interlocutory injunction application will be heard on August 27.

Court Update.

Supreme Court dismisses Kojo Oppong Nkrumah’s application seeking to injunct two vacation Courts (Specialised Court 1 and 2) from sitting pending the determination of his writ challenging the warrant given to these judges to sit during the legal vacation.

Justice Gabriel Scot Pwamang (JSC) sitting as a single Justice of the Court delivered a full Ruling this morning in open Court after arguments had been heard yesterday on the application.

Republic v Bernard Antwi Boasiako aka Chairman Wontumi & 2 Ors (Samreboi Illegal Mining Case)

Prosecution team were in Court to oppose the motion for bail pending appeal which was to be heard this morning.

However, both Counsel and prisoner (Chairman Wontumi) did not show up in Court to move their motion.

Adjourned to Thursday, October 15, 2026.

Republic v Hanan Abdul Wahab Aludiba & Another (Buffer Stock Case)

The Presiding Judge has given a short adjournment to Monday 17th August 2026 at 12 noon for Lawyers on both sides to adress the Court on the effect of the stay of proceedings application filed at the Court of Appeal by the 1st accused.

This follows the absence of Defence Lawyers who the accused persons say are unwell.

The Deputy Attorney General drew the Court’s attention to the fact at that at the last adjourned date Counsel for 1st accused had openly indicated that he wasn’t going to attend Court during the legal vacation and has followed up with a letter to the Chief Justice protesting the scheduling of dates during the legal vacation.

This the Deputy AG said, shows that he had already pre determined not to be in Court and therefore the sickness excuse which is unsupported by any medical report or letter, even if true at all, is not the reason for his absence.

Republic v Bernard Antwi Boasiako aka Chairman Wontumi & 2 Ors (Samreboi Illegal Mining Case)

The Attorney General has this morning filed an affidavit in opposition to the motion filed by Mr Bernard Antwi Boasiako aka Chairman Wontumi, asking the Court to grant him bail pending his appeal.

In a 13-paragraph affidavit in opposition, the Attorney General argues that Wontumi’s appeal discloses no reasonable chance of success and that no special circumstances exist to admit Wontumi to bail pending appeal.

The motion will be heard next week Wednesday, 19th August 2026 at 9 o’clock on the forenoon.

The rules are clear.

The High Court’s observance of legal vacation is SUBJECT to the power of the Chief Justice to appoint any day, including vacations, for the hearing of cases.

See Rule 1 of Order 79 of the High Court Civil Procedure Rules, 2004 (C.I. 47) and Rule 4 of same Order.

The Chief Justice has given warrants for designated Judges to sit in the period and the team shall be in court for all the sittings.
