🤔WHAT IS THE DIFFERENCE BETWEEN 📄POWER OF ATTORNEY AND 🔖LASTING POWER OF ATTORNEY?

A POA is for decisions about your 💷 money management and is still valid when you have mental capacity. This is useful for when you still have mental capacity, but you need help and support for a shorter time, like a 🏥hospital stay.
A LPA can deal with decisions on your 💷finances, 🩺health, and 🛌🏻care. This power comes into effect when you lose capacity or if you decide you do not want to make decisions on your own anymore.

1. Act in a way or 🤔decide that you cannot normally do yourself.
2. 🖋️Consent to a deprivation of liberty being imposed on you, without a court order.
3. Make a decision that conflicts with a decision of your guardian, which they have the 💪🏻power to make, such as where you will live, if you are under guardianship.
4. 👩🏼‍⚕️Make a decision that goes against any treatment refusals you set out in your advance decision

1. You can make a will at any age
2. You can’t leave your estate to your cat
3. Your debts do not die with you
4. A well-planned will can help reduce care home fees & inheritance tax
5. A person cannot inherit from the person they kill
6. If you gift a UK charity in your will it will be free of inheritance tax
7. 54% of adults do not have a will
8. Anonymous donation to clear the national debt can be made

🩺What if I lose mental capacity and don’t have a Health & Welfare LPA?
Your family members and❤️ loved ones are likely to not have a say in how you live or are cared for:

👩🏼‍⚕️Social Services may have to take the lead in making decisions about where you should live and what care you will receive.
Only your legal next of kin would be consulted about decisions regarding resuscitation and life sustaining treatment. And even though they are talked to, it still does not mean they will have the final say.

Decisions may have to be made by the ⚖️💪🏻Court of Protection, rather than by the people you would choose. This will be an 💷expensive and ⏰time-consuming process.

📄 LASTING POWER OF ATTORNEY

A healthcare attorney can only make decisions for you when you’re unable to make these decisions for yourself. They can also decide about:
• your daily routine ( 🍏eating and what to 👕 wear)
• routine 🩺medical care – when and where this should happen
• moving into a care 🏠 home
• life-saving or life-sustaining treatment.

You can give your healthcare attorney power to refuse certain treatments for you:
• cardiac resuscitation after a heart attack
• blood transfusions
• medication
electroconvulsive therapy (even if you are sectioned and your responsible clinician or approved clinician prescribes this treatment).

But your healthcare attorney will not be able to refuse treatment for you if:
You are sectioned under the Mental Health Act in the future, and your treatment is prescribed by the responsible clinician or approved clinician in charge of your treatment at that time. Your attorney will have no legal power to refuse the treatment unless it is electroconvulsive therapy.

It is life-saving in an emergency situation (unless you have stated very clearly on your lasting power of attorney form that they can refuse life-saving treatment for you).
You have the capacity to refuse the treatment for yourself.

📄 5 FACTS OF A LASTING POWER OF ATTORNEY

Fact 1. 📄 LPAs Are Not Just for the Elderly 👨🏻‍🦳
A common misconception about LPAs is that you do not need one until you start to lose your mental faculties. However, if you wait until this point in your life, you may not be able to set an LPA up. People lose mental capacity for many different reasons including:
• Strokes
• Accidents
• Heart Failure
• Dementia
• Contracting a virus which attacks the brain (such as meningitis)

Fact 2. There are Two Types of LPAs
LPAs come in two forms, a 💷 Financial and 🏠 Property LPA and a 🩺 Health & Welfare LPA.
💷 Financially & 🏠 Property:
• Pay your mortgage and bills
• Sell your property
• Collecting pensions, wages, or benefits
• Manage your investment portfolio
🩺 Health & Welfare:
• Decide where you live
• Administer medication
• Manage your diet, clothes, and day to day schedule
You can select to have one or both types of LPA and the extent of the attorney’s powers is entirely up to you. You may also select different attorneys for each type of LPA.

Fact 3. The 🧑🏻‍💼 Attorney for Your Health & Welfare LPA Can Decide Whether to Continue with Life-sustaining Treatment
When you and your solicitor draft your health & welfare LPA you will be asked whether you wish the person you appoint as your attorney to have the power to accept or refuse life-sustaining treatment on your behalf.

Fact 4. You Can Choose Anyone Over the Age of 18 years to be Your 🧑🏻‍💼 Attorney
One of the most comforting things about having an LPA in place is that you have had the chance to select a person you know and trust to look after your affairs and act in your best interests. If you do not have an LPA and subsequently become mentally incapacitated, then your relatives (who you may or may not get along with) will have to apply to the Court of Protection to gain the power of Deputyship to manage certain aspects of your life.

Fact 5. An LPA Saves Your Family and Friends a lot of Stress and Anxiety
By having an LPA you take away this stress and anxiety from your loved ones and give them the confidence of knowing that they are managing your affairs as per your instructions. Like a Will, an LPA is an important document that too few of us have had drafted. They can save both you and your loved ones a lot of stress and insecurity and give you all the peace of mind that no matter what happens to you, your life will continue to be run the way you want it to.
