اقوامِ متحدہ کے کمیشن برائے بھارت و پاکستان کی طرف سے 13 اگست 1948 کو منظور کی جانے والی قرارداد (دستاویز نمبر 1100 پیرا 75 ۔ تاریخ 9 نومبر 1948) ۔

اقوامِ متحدہ کے کمیشن برائے بھارت و پاکستان نے ریاست جموں و کشمیر کی صورتحال سے متعلق بھارت اور پاکستان کے نمائیندگان کے بیان کیئے گئے نقطہ نظر پر محتاط غور کرتے ہوئے اور اس رائے کے پیشِ نظر کہ جنگ وجدل کے فوری خاتمے اور حالات کی بہتری کہ جس کے بغیر جاری صورتحال عالمی امن و سلامتی کے لیئے ممکنہ خطرہ ہے، یہ لازم ہے کہ صورتحال کی حتمی بہتری کی خاطر ایسی کاوشوں کو بروئے کار لایا جائے جن کے ذریعے بھارت اور پاکستان کی حکومتوں کی معاونت کی جا سکے، چنانچہ طے کیا گیا ہے کہ بیک وقت بھارت اور پاکستان کی حکومتوں کو درج ذیل تجویز دی جائے:
حصہ I
جنگ بندی کا حکم
[A]
بھارت اور پاکستان کی حکومتیں اتفاق
کرتی ہیں کہ ان کی متعلقہ مقتدر طاقتیں ریاست جموں و کشمیر میں اپنے زیرِانتظام
فوجوں کو اس تجویز کے دونوں حکومتوں کی جانب سے قبول کیئے جانے کے چار دن کے اندر اندر باہمی طور پر متفقہ اولین قابلِ عمل تاریخ یا تواریخ پر الگ الگ اور بیک وقت جنگ بندی کا حکم دیں گی ۔

بھارتی اور پاکستانی افواج کی ہائی کمان اتفاق کرتی ہیں کہ وہ ایسے اقدامات سے گریز کریں گی جن سے ریاست جموں و کشمیر کے اندر موجود ان کے کنٹرول میں فوجوں کی طاقت میں اضافہ ہو ۔ (ان تجاویز کے مقصد کے لیئے "ان کے کنٹرول میں فوجوں" سے مراد وہ تمام باقاعدہ اور بے ضابطہ فوجیں ہیں جو ہر دو فریقین کی جانب سے لڑ رہی ہیں یا جنگ میں شریک ہیں) ۔

بھارت اور پاکستان کی فوجوں کے کمانڈر ان چیف فوری طور پر فوجوں کی تعیناتی میں ان تمام ضروری مقامی تبدیلیوں کی نشاندہی کریں گے جو جنگ بندی میں ممد و معاون ہوں ۔

اپنی صوابدید کے مطابق اور جب بھی قابلِ عمل تصور کرے کمیشن ایسے فوجی مبصرین تعینات کرے گا جو کمیشن کے احکامات اور دونوں فوجی کمانوں کے تعاون سے جنگ بندی احکامات پر عملدرآمد کی نگرانی کریں گے ۔

حکومتِ بھارت اور حکومتِ پاکستان اتفاق کرتی ہیں کہ وہ اپنے لوگوں سے اپیل کریں گی کہ وہ ایسا ماحول پیدا کرنے اور برقرار رکھنے میں معاونت کریں جو مزید مذاکرات کے لیئے سازگار ہو ۔
حصہ II
عارضی صلح کا معائدہ
جنگ و جدل کے فوری خاتمے کے لیئے حصہ I میں دی گئی تجویز کی بیک وقت قبولیت کی صورت میں دونوں حکومتیں ایسے اصولوں کو عارضی صلح کی تشکیل کی بنیاد کے طور پر تسلیم کرتی ہیں جن کی تفصیلات ان کے نمائیندگان اور کمیشن کے مابین گفت و شنید کے ذریعے طے کی جائیں گی ۔

(1) چونکہ ریاست جموں و کشمیر میں پاکستانی فوجی دستوں کی موجودگی جیسا کہ حکومتِ پاکستان کی جانب سے سیکورٹی کونسل کے سامنے بیان کیا گیا ہے، علاقے کی زمینی صورتحال کی تبدیلی کا سبب ہے، اس لیئے حکومتِ پاکستان تسلیم کرتی ہے کہ وہ ریاست میں سے اپنے فوجی واپس بلائے گی ۔
(2) حکومتِ پاکستان بھرپور کوشش کے ذریعے اس عمل کو یقینی بنائے گی کہ وہ ریاست جموں و کشمیر میں سے اپنے ان شہریوں اور قبائلیوں کو واپس بلائے گی جو عمومی طور پر وہاں رہائشی پزیر نہیں ہیں اور جو ریاست میں لڑنے کی غرض سے داخل ہوئے ہیں ۔
(3) صورتحال کے حتمی حل تک وہ علاقے جنہیں پاکستانی فوج خالی کرے گی کمیشن کی نگرانی میں مقامی حکومتوں کے زیرِانتظام رہیں گے ۔
B
1- جب کمیشن بھارتی حکومت کو اس امر کی تصدیق کر دے گا کہ وہ قبائلی اور پاکستانی شہری جن کا یہاں پارٹ II A2 میں ذکر کیا گیا ہے واپس چلے گئے ہیں، اور یوں اُس صورتحال کا خاتمہ ہو گیا ہے جس کی بنیاد پر بھارتی حکومت نے سیکورٹی کونسل میں ریاست جموں و کشمیر کے اندر بھارتی افواج کی موجودگی کا جواز پیش کیا تھا، اور مزید برآں، جب پاکستانی افواج کا ریاست جموں و کشمیر میں سے واپسی کا عمل شروع ہو جائے تو بھارتی حکومت ریاست جموں و کشمیر میں سے کمیشن کی رضامندی کے ساتھ مرحلہ وار اپنی زیادہ تر افواج واپس بلانے پر اتفاق کرتی ہے ۔
2- جب تک ریاست جموں و کشمیر کی صورتحال کے حتمی تصفیے کی خاطر شرائط کو تسلیم نہیں کیا جاتا، بھارتی حکومت جنگ بندی لائن کی موجودہ پوزیشن کے اندر مقامی حکومت کی امن و امان برقرار رکھنے میں معاونت کی غرض سے کمیشن کی رضامندی کے ساتھ اپنی کم سے کم درکار افواج کو موجود رکھے گی ۔ کمیشن جہاں ضروری سمجھے گا اپنے مبصرین تعینات کرے گا ۔
3- بھارتی حکومت اس امر کو یقینی بنانے کا عہد کرے گی کہ حکومتِ جموں و کشمیر اپنے دائرہ اختیار میں دستیاب تمام وسائل کو بروئے کار لا کر عوام کو یقین دہانی کرائے گی کہ امن و امان اور قانون کی پابندی کو یقینی بنایا جائے گا اور یہ کہ تمام انسانی اور سیاسی حقوق کی ضمانت دی
جائے گی ۔
C-
1- عارضی جنگ بندی کے معاہدے کا مکمل متن یا دستاویز جس پر دونوں حکومتوں اور کمیشن کا اتفاق ہو گا، دستخط ہو جانے کے بعد عوام کے سامنے لایا جائے گا ۔
Part III
حکومتِ ہند اور حکومتِ پاکستان اپنی اس خواہش کا ازسرِنو اعادہ کرتی ہیں کہ ریاست جموں و کشمیر کے مستقبل کا تعین عوام کی خواہشات کے مطابق طے کیا جائے گا اور اس ضمن میں دونوں حکومتیں جنگ بندی کا عارضی معائدہ تسلیم کرتے وقت اس امر پر اتفاق کرتی ہیں کہ وہ کمیشن کے ساتھ صلاح مشورے کے عمل کے ذریعے اس بات کو یقینی بنائیں گی کہ ایسا غیرجانبدارانہ اور مساویانہ ماحول پیدا کیا جائے گا جس میں لوگوں کے اظہارِ رائے کی آزادی کو یقینی بنایا جا سکے ۔
اقوام متحدہ کے کمیشن برائے بھارت و پاکستان نے اس قرارداد کو متفقہ طور پر 13 اگست 1948 کو قبول کیا ۔

Resolution adopted by the United Nations Commission for India and Pakistan on 13 August 1948.

THE UNITED NATIONS COMMISSION FOR INDIA AND PAKISTAN
Having given careful consideration to the points of view expressed by the Representatives, of India and Pakistan regarding the situation in the State of Jammu and Kashmir, and Being of the opinion
that the prompt cessation of hostilities and the correction of conditions the continuance of which is likely to endanger international peace and security are essential to implementation of its endeavours to assist the Governments of India and Pakistan in effecting a final settlement of the situation,
Resolves to submit simultaneously to the Governments of India and Pakistan the following proposal:
PART I
CEASE-FIRE ORDER
[A] The Governments of India and Pakistan agree that their respective High Commands will issue separately and simultaneously a cease-fire order to apply to all forces under their control in the State of Jammu and Kashmir as of the earliest practicable date or dates to be mutually agreed upon within
four days after these proposals have been accepted by both Governments.
[B] The High Commands of Indian and Pakistan forces agree to refrain from taking any measures that might augment the military potential of the forces under their control in the State of Jammu and Kashmir. (For the purpose of these proposals '-forces under their control" shall be considered to include all forces, organised and unorganised, fighting or participating in hostilities on their respective sides).
[C] The Commanders-in-Chief of the Forces of India and Pakistan shall promptly confer regarding
any necessary local changes in present dispositions which may facilitate the cease-fire.
[D] In its discretion, and as the Commission may find practicable, the Commission will appoint military observers who under the authority of the Commission and with the co operation of both Commands will supervise the observance of the cease-fire order.
[E] The Government of India and the Government of Pakistan agree to appeal to their respective peoples to assist in creating and maintaining an atmosphere favourable to the promotion of further negotiations.
PART II
TRUCE AGREEMENT
Simultaneously with the acceptance of the proposal for the immediate cessation of hostilities as outlined in Part I, both Governments accept the following principles as a basis for the formulation of a truce agreement, the details of which shall be worked out in discussion between their Representatives and the Commission.
A.
(1) As the presence of troops of Pakistan in the territory of the State of Jammu and Kashmir
constitutes a material change in the situation since it was represented by the Government of Pakistan before the Security Council, the Government of Pakistan agrees to withdraw its
troops from that State.
(2) The Government of Pakistan will use its best endeavour to secure the withdrawal from the
State of Jammu and Kashmir of tribesmen and Pakistan nationals not normally resident therein who have entered the State for the purpose of fighting.
(3) Pending a final solution the territory evacuated by the Pakistan troops will be administered by the local authorities under the surveillance of the Commission.
B.
(1) When the Commission shall have notified the Government of India that the tribesmen and
Pakistan nationals referred to in Part II A2 hereof have withdrawn, thereby terminating the situation which was represented by the Government of India to the Security Council as having
occasioned the presence of Indian forces in the State of Jammu and Kashmir, and further, that the Pakistan forces are being withdrawn from the State of Jammu and Kashmir, the Government of India agrees to begin to withdraw the bulk of their forces from the State in
stages to be agreed upon with the Commission.
(2) Pending the acceptance of the conditions for a final settlement of the situation in the State of Jammu and Kashmir, the Indian Government will maintain within the lines existing at the moment of cease-fire the minimum strength of its forces which in agreement with the
Commission are considered necessary to assist local authorities in the observance of law and order. The Commission will have observers stationed where it deems necessary.
(3) The Government of India will undertake to ensure that the Government of the State of Jammu and Kashmir will take all measures within their power to make it publicly known that
peace, law and order will be safeguarded and that all human and political rights will be guaranteed.
C.
(1) Upon signature, the full text of the Truce Agreement or communique containing the
principles thereof as agreed upon between the two Governments and the Commission, will be
made public.
PART III
The Government of India and the Government of Pakistan reaffirm their wish that the future status of the State of Jammu and Kashmir shall be determined in accordance with the will of the people and to that end, upon acceptance of the Truce Agreement both Governments agree to enter into consultations with the Commission to determine fair and equitable conditions whereby such free
expression will be assured.
The UNCIP unanimously adopted this Resolution on 13-8-1948.
