NET combines a number of enforcement functions for Bristol City Council including – StreetScene; Pollution control (noise, light, dust,); Licensing ( bars, clubs, taxi licencing); Highways:

The teams aim is to assist in the delivery of sustainable “safe, clean and green” outcomes for Bristol’s neighbourhoods through a combination of prevention, education, partnership and enforcement action to ac

hieve lasting behaviour change in the city. When issues are reported to the city council via the call centre (0117 922 2100) or on a web form ( www.bristol.gov.uk ) this is the team that takes action.

Yesterday, our Neighbourhood Enforcement Team seized a van under Section 34b of the Environmental Protection Act 1990 after it was used to illegally dump waste in the Avonmouth and Lawrence Weston areas.

***CASE UPDATE***

A council tenant today pleaded guilty for breaching a Community Protection Notice and was ordered to pay £520 & forfeit all noise making equipment that was seized back in September.

Following ongoing complaints relating to loud music being played, the occupant was served with a Community Protection Warning, which was followed up with a Community Protection Notice (CPN).

Breaches of the CPN were evidenced through reporter using The Noise App.

Waste Enforcement Officers have been carrying proactive commercial waste inspections on High streets across Bristol in 2024.

82x businesses have received £300 Fixed-Penalty-Notices for failure to provide copies or evidence of Waste Transfer Notes or a valid commercial waste contract.

A business in Shirehampton was on Monday prosecuted for failing to produce documentation and not discharging their liability for the offence by paying the FPN.

The business failed to attend court and was ordered to pay £346 Fine, a victim surcharge of £138 and full costs £537.01 for a total of £1,021.01

Neighbourhood Enforcement this week executed a warrant to seize noise making equipment from an address in St George (BS5)

Following ongoing complaints relating to loud music being played, the occupant was served with a Community Protection Warning, which was followed up with a Community Protection Notice (CPN).

Breaches of the CPN were evidenced by officers witnessing the noise on a weekend and further submissions by reporters using the The Noise App.

NET will be applying for a Forfeiture Order of the items, following successful prosecution.

A van seized last month for use in fly-tipping has now been crushed.

Since April 2023, NET has seized & disposed of 8x vans used in fly-tipping. Details of all seizures can be found at https://www.bristol.gov.uk/residents/streets-travel/report-a-street-issue/flytipping/vehicle-seizures

Make sure your waste is disposed of properly. Follow the S.C.R.A.P code to keep yourself safe from prosecution and help to protect our environment:
• Suspect all waste carriers. Don't let them take your rubbish until they provide proof of registration. Note their vehicle's registration plate.
• Check that a waste carrier is registered on the Environment Agency's website.
• Refuse any unexpected offers to have your rubbish taken away.
• Ask how your rubbish will be disposed of - seek evidence of this.
• Paperwork must be obtained: a proper invoice, waste transfer note or receipt, including a description of the waste being removed and the waste carrier's contact details.

Last month (30th September) the owners of Aqua, Welshback (BS1) pleaded guilty to not complying with a Community Protection Notice for a noise nuisance and ordered to pay over £8K & required to complete works within 3 months of landlord removing scaffolding.

Aqua Restaurants, Welsh Back location, is a restaurant operating at Telephone House Ground Floor, 30-31 Welsh Back, Bristol, BS1 4RR.

Reports sent to the Neighbourhood Enforcement Team of an excessively loud extraction fan unit as well as smoke from the unit and late-night glass disposal from the address was received June 2022.

Evidence of this was gathered through Officer site visits. Despite the issuing of a Notice, numerous engagement visits and correspondence, and reminders from Officers, the noise disturbance from the extraction fan unit has been persistent and continual throughout the investigation - with no apparent change made.

Breach of the Community Protection Notice was witnessed by officers on the 16th of February 2024.

Following a guilty plea, Magistrates fined the business £5,000, ordered them o pay a victim surcharge of £2,000, full costs of £1,416 and to complete the required works within 3 months of landlord removing scaffolding that had since been erected.

A fly-tipper who illegally dumped large piles of waste across Bristol has been found guilty ordered to pay over £5,000 in fines and costs.

On Monday 16 September 2024, David Mullalley pleaded guilty to waste offences and was ordered to pay £5,280 in fines and costs to Bristol City Council. Operating under the business name Two Magpies Clearance, Mullalley was found to have deposited large amounts of fly tipped waste in the St Philips, Bedminster and Hotwells areas between September – October 2023.

Following visits to fly tipping sites on George Jones Road, Queen Ann Road and Silverthorne Lane, Neighbourhood Enforcement Officers were able find to evidence linking to various commercial and domestic properties in Bristol that had paid Mullalley’s Two Magpie’s Clearance sums ranging from £250 - £600 to dispose of their waste. It was also discovered that Mullalley was illegally selling waste on to a buyer.

During the proceedings held at Bristol Magistrates Court, judges treated the several instances of waste disposal as one, with Mullalley pleading guilty to three charges of breaching duty of care, and one charge of failing to produce waste transfer notes.

Mullalley has since been fined £3,060, with further compensation costs of £1600 awarded to Bristol City Council towards the cost of clearing up the sites and prosecution costs of £630.

Councillor Martin Fodor, Chair of the Environment and Sustainability Committee, said: “Fly tipping is a crime which Bristol City Council takes very seriously. Not only does it make our streets and public spaces look unsafe and untidy, but it can also have serious, detrimental effects on our local environment.

“Our residents deserve to live in a tidy and safe city, which is why we will always take strong action against those who illegally dispose of waste, and remain committed to keeping our streets and neighbourhoods clean.”

Two offenders in the past week have received £1,000 FPNs for fly-tipping following investigations by Neighbourhood Enforcement.

- A resident from Frome Vale (BS16) admitted to fly-tipping on Goodneston Road

- A resident from St Pauls (BS2) admitted to fly-tipping an old TV, along with packaging for the new TV they had recently purchased
