A 29-year-old man has been sentenced to three months in prison after admitting sexually assaulting another man near the River Bann in Portadown.
The man whose address was given as no fixed abode in the Armagh City, Banbridge and Craigavon area, appeared at Craigavon Magistratesโ Court by video link from Maghaberry Prison.
The court heard that police were called to the River Bann area on August 3 following a report that a man had been sexually assaulted.
According to the prosecution, the man approached the victim, who was unknown to him, and asked for a cigarette. After the man gave him one, he allegedly followed him and made an unwanted sexual proposition.
When this was refused, he continued to follow the man before grabbing his buttocks with both hands without his consent.
The victim provided police with a description of his attacker, including that he had been wearing a white puffer jacket. Officers subsequently located a man matching that description a short distance away in the Castle Street area.
Defence solicitor Philip Reid described the incident as โobviously shockingโ, although he argued that it fell at the lower end of the scale for this type of offence.
The court was told that the man, who is originally from Yemen, had been in the country for only 10 days when the assault occurred and had been staying with a friend. Mr Reid said his client had come to seek employment but was experiencing difficulties relating to his visa.
He added that his client had consumed alcohol and another substance before the incident. While this may have affected his behaviour, the solicitor acknowledged that it offered no justification for what happened.
District Judge Michael Ranaghan stressed the seriousness of the offence, stating that any sexual assault would undoubtedly be distressing for the victim.
Raimi, who had remained in custody since the offence, was sentenced to three monthsโ imprisonment.
