/❤️ Due to the doubts that seem to arise around who has the obligation to ensure that our school, CEIP Daidín, is in perfect safety and operational condition to receive its students, we would like to inform our citizens and remind our politicians in the Town Hall what the local, regional and national legislation says:
- Article 8 of the Property Regulation of Local Entities, Decree 18/2006, dated 24 January, reads as follows: "Public buildings intended for state pre-schools, primary schools and special education systems are owned by the local authorities. They are responsible for their conservation, maintenance and surveillance".
- Article 171.1 of the Education Act of Andalusia 17/2007 says: "The conservation, maintenance and surveillance of buildings intended for state pre-schools, primary schools and special education dependent of the educational administration lies with their respective municipality".
- Organic Law 3/2020 of 29 December reads as follows: "The conservation, maintenance and surveillance of buildings used as state pre-schools, primary or special education are the responsibility of the respective municipality".
The responsibility the Town Hall of Benahavís has is even more evident with the new law “Ley de Impulso de Sostenibilidad of the Andalusian Territory (LISTA)” coming into force, which in Article 144(1) gives greater precision as to this responsibility determining the following: "Owners of land, installations, constructions, buildings have the duty to maintain its safety, functionality, universal accessibility and any other way required by law by carrying out the necessary works to preserve or rehabilitate them".
There has been time and there is money. It is difficult to understand why the very serious safety and operational deficiencies have still not been corrected by at CEIP Daidín, and even more so when THE JUNTA DE ANDALUCÍA HAS DIRECTLY INFORMED US THAT THOSE REPAIRS ARE THE EXCLUSIVE RESPONSIBILITY OF OUR TOWN HALL.
Our politicians continue trying to wriggle out of it, defending that it is none of their responsibility, instead of acknowledging their negligence and laziness in providing solutions to all the problems we face on a daily basis.
Apart from the rest of the year, haven't they had at least a whole summer to deal with the necessary repairs? Don't you think it is appropriate to spend the money needed to do so? Ladies and gentlemen of the municipal government, as usual, you are late. Start moving and fix each and every one of the school's deficiencies, immediately.
Our children deserve it.
