The Government of Tamil Nadu, through Letter No.5444598/LD4(1)/2023-5 dated 29.08.2024, has issued detailed instructions to address the issue of illegal occupation of public lands using forged government documents. This action follows the directive of the Hon'ble High Court of Madras in its judgment dated 20.06.2024 in Writ Appeal Nos. 866 & 933 of 2013, arising from W.P. No.14507 of 2012 filed by Thiru P. Mohanakrishnan and others. The Court directed the Revenue Department to issue consolidated guidelines to all officials handling government lands, emphasizing the need to identify government properties, verify the authenticity of assignment orders and documents, and take appropriate action against forged, bogus, or illegal claims. Accordingly, the government has instructed all concerned departments to register criminal cases against offenders, immediately resume encroached lands for public use, and maintain updated registers of land assignments. Committees at Divisional, District, and State levels are to monitor eviction efforts, with priority given to water bodies and objectionable poramboke lands. The Commissioner of Land Administration is tasked with overseeing the implementation and progress of these measures.
போலியான அரசு ஆவணங்களைப் பயன்படுத்தி பொது நிலங்களை சட்டவிரோதமாக ஆக்கிரமிப்பதில் உள்ள பிரச்சினையைத் தீர்க்க, தமிழ்நாடு அரசு, 29.08.2024 தேதியிட்ட கடிதம் எண்.5444598/LD4(1)/2023-5 மூலம் விரிவான வழிமுறைகளை வெளியிட்டுள்ளது. திரு. பி. மோகனகிருஷ்ணன் மற்றும் பலர் தாக்கல் செய்த 2012 ஆம் ஆண்டின் W.P. எண்.14507 இலிருந்து எழும், 2013 ஆம் ஆண்டின் Writ மேல்முறையீட்டு எண். 866 & 933 இல் 20.06.2024 தேதியிட்ட தீர்ப்பில், மாண்புமிகு சென்னை உயர்நீதிமன்றத்தின் உத்தரவைப் பின்பற்றி இந்த நடவடிக்கை எடுக்கப்பட்டுள்ளது. அரசு நிலங்களைக் கையாளும் அனைத்து அதிகாரிகளுக்கும் ஒருங்கிணைந்த வழிகாட்டுதல்களை வெளியிடுமாறு நீதிமன்றம் வருவாய்த் துறைக்கு உத்தரவிட்டது, அரசாங்க சொத்துக்களை அடையாளம் காண வேண்டியதன் அவசியத்தையும், ஒதுக்கீட்டு உத்தரவுகள் மற்றும் ஆவணங்களின் நம்பகத்தன்மையை சரிபார்க்க வேண்டியதன் அவசியத்தையும், போலியான, போலியான அல்லது சட்டவிரோத உரிமைகோரல்களுக்கு எதிராக உரிய நடவடிக்கை எடுக்க வேண்டும். அதன்படி, குற்றவாளிகள் மீது குற்றவியல் வழக்குகளைப் பதிவு செய்யவும், ஆக்கிரமிக்கப்பட்ட நிலங்களை உடனடியாக பொது பயன்பாட்டிற்கு மீண்டும் கொண்டு வரவும், நில ஒதுக்கீட்டுப் பதிவேடுகளைப் புதுப்பிக்கவும் அரசாங்கம் அனைத்து துறைகளுக்கும் அறிவுறுத்தியுள்ளது. நீர்நிலைகள் மற்றும் ஆட்சேபனைக்குரிய புறம்போக்கு நிலங்களுக்கு முன்னுரிமை அளித்து, வெளியேற்றும் முயற்சிகளை கோட்ட, மாவட்ட மற்றும் மாநில அளவில் உள்ள குழுக்கள் கண்காணிக்க வேண்டும். இந்த நடவடிக்கைகளை செயல்படுத்துதல் மற்றும் முன்னேற்றத்தை மேற்பார்வையிடுவது நில நிர்வாக ஆணையரின் பணியாகும்.
