In lawsuits, there are two very different types of questionings — and the distinction matters.

Part 5 – Questioning for Discovery
• Conducted before trial.
• Transcripts belong to the party asking the questions.
• That party decides if they want to use any of that evidence.

Part 6 – Cross-Examinations on Affidavit Evidence
• Transcripts from the questioning must be filed with the Court.
• Transcripts become part of the record the Court considers for the application.
• The answers are treated as your client’s evidence.

Why it matters:
Part 6 evidence can help your case — or hurt it. You have to be surgical, and ensure your questioning is consistent with your overall strategy.
