ADVISERS TARGETED IN OFF SHORE TAX EVASION

Earlier this year the ATO stated that as part of its focus on offshore tax evasion it has visited several times involved in advising our offshore arrangements and has contracted more than 100 parents who had their children’s school fees paid from overseas bank accounts.
The ATO has compiled a list of advisers and promoters operating global and locally that have a direct link with people who may have eroded taxes.
The Commissioner of Taxation said.
“The intelligence picture we know have has been built from information taxpayers disclosed under PROJECT DO IT about the adviser who put them into offshore arrangements, data mining and client records seized from advisers in transit.”
“We’ll be visiting Australian advisers, including tax agents, legal advisers, financial institutions and stockbrokers to obtain their full client lists and identify those who have failed to come forward and clean up their tax arrangements under PROJECT DO IT.”
The information obtained under PROJECT DO IT relating to school fees paid to private schools around Australia revealed that the fees had been paid from an offshore account or related offshore entity.
The ATO compared this information against income tax returns and is following up discrepancies with parents who may have failed to disclose offshore interest.

The Commissioner said.
“There is nothing wrong with having an offshore account, but you need to pay tax on the interest or earnings”

TRUST AND COMPLIANCE AND ANTI AVOIDANCE

In February 2016 the ATO announced that it would be reviewing selected trusts compliance in conjunction with sections 100AA and 100AB of the Income Tax Assessment Act 1936.

The anti- avoidance provisions contained in these sections have been implemented to prevent Trustees using entities that are tax exempt to protect the trust’s net income.

The ATO is targeting instances where a tax exempt entity is entitled to income of trust estate has not been paid of notified of that entitlement within two months of the end of the financial year and the share of the trust net income is disproportionate to the entities entitlement to the trust income.

If you are selected you or your accountant will receive a letter from the ATO.

If I change my mind, can I alter my Will?

You are free to alter your Will at any time, but to do so you must make a new Will or Codicil.

If you circumstances change in any way you must alter your Will. You should consult your Lawyer who can assist you with the necessary changes.

What is a Codicil?

It is a document used to make a minor change to a Will. Witnesses need not be the same as the original Will, but reference to the original Will is necessary.

How can a Lawyer help me?

• A lawyer can help to make sure you have made adequate provision for your spouse and children;
• Make sure your wishes are clearly expressed in the Will;
• Make sure it is valid, signed and correctly witnessed;
• Advise you regarding tax implications.

Can I make my own Will ?

Yes, in most cases you can make your own Will or you can ask someone else to prepare it for you.
However it is recommended to have your Will prepared by a Lawyer. This way the Lawyer can make sure that your Will is valid so that the people you want to receive your assets benefit from your Will being prepared correctly.

What will happen to my property if I don’t make a Will?

The law provides a rule/policy which sets out who is entitled to the property of a deceased person who does not have a Will. But…..the policy may not distribute the assets as you may have wanted it to be. It is also not true that the Government takes the deceased persons property if there is no Will. The Government will only take the deceased persons property if the relatives listed in the rules/policy do not exist. This event is unlikely.

What is a Will?

A Will is a legal document that outlines who you would like to receive your “assets” when you pass this may include your house, land, shares, jewellery, furniture, cars etc. The people who receive your assets under your Will are called “beneficiaries” these could be your family, friends, charities or schools. A Will can also be used as a Trust or to set up Guardianship of Children.

Do I have to make a Will?

No, but if you would like “your” belongings or assets to be distributed as per your wishes then it is advisable to make one.

Dogs:
What Laws apply to the keeping of dogs?

Generally all dogs over the age of 3 months MUST be registered.

The owner of the dog is liable for any damage or injury caused by the dog, and there are also extensive fines for a wide range of offences such as allowing the dog to bark excessively.

If you are injured or your property is damaged by a dog, seek our legal advice as you may have a right to compensation!
