Community Update: Urgent Action Taken Against Alleged Unlawful Land Auction by Mooi Mpofana Municipality
Dear Residents of Mooi Mpofana,
This is an important update regarding the ongoing issue of the municipal land auction. As many of you know, the Mooi Mpofana Municipality has proceeded with an online auction of land that was specifically earmarked for vital housing development projects. This has been done despite repeated demands for meaningful public consultation from residents, business owners, ratepayers' associations, and the farmers' association.
What has happened so far:
β’ Community Mobilization: On 15 February 2026, residents met at Bruntville Hall to consolidate concerns. This was followed by a peaceful, multi-racial march on 16 February 2026, led by a committee representing Black, Indian, and White residents.
β’ Memorandum Submitted: A memorandum was delivered to the municipal offices. Unfortunately, neither Mayor Cllr Thembi Magubane nor Municipal Manager Mr. Hlula Dlala were present to receive it. While residents were gathered, it was discovered that the online auction had already begun.
β’ Projects at Risk: The land being auctioned is linked to several pending Integrated Development Plan (IDP) housing projects, including the Riversdale, Phumlasi, Townview, and Lake View projects, which together account for over 1,400 units and beneficiaries. It also affects approved plans for middle-income housing along Greytown Road and the 80 Bruntville residents registered under the halted Cregburn Housing Project.
Official Request for Intervention:
On 19 February 2026, former Councillor, Speaker, and Mayor, Mr. Xolani Magnificent Duma, submitted a formal request for urgent intervention to the Premier of KwaZulu-Natal, the MEC for COGTA, the MEC for Human Settlements, the Public Protector, and the Provincial Commissioner of SAPS.
This letter outlines the legal and constitutional concerns, including alleged inconsistencies with the Constitution of South Africa, the Municipal Systems Act, and the Municipal Finance Management Act. The community has resolved to open a criminal case on grounds of alleged fraud, corruption, and maladministration.
The Key Demands Are:
1. Immediate suspension of the land auction process.
2. A forensic investigation into the disposal of municipal land.
3. A review of compliance with approved IDP commitments.
4. Provincial oversight intervention by the Premier's Office, COGTA, Human Settlements, SAPS, and the Hawks.
