In this week’s Medical Brief…

The arrest of a key player in the Tembisa Hospital procurement fraud scandal six years after whistle-blower Babita Deokaran was assassinated for flagging irregular tenders, could finally move the slow-paced investigations forward. Stefan Govindraju's arrest on Friday – as part of a plea bargain deal with the state and following negotiations over three years – is the first of an alleged kingpin behind the Health Department tender fraud.


Documents from a case that was settled out of court, with a non-disclosure agreement, have revealed the toxic situation that developed at a practice at Medicross Randburg, where a doctor was thrown out amid claims of threatening to shoot his colleagues, sexual harassment and breaking a cupboard door.

And a plan to tighten regulation of scientists, which will force some scientists to register with a professional body, has drawn mixed responses, with some seeing the move as affording protection for people and the environment, but others concerned about the lack of clarity.

A South African judge has barred deportations of undocumented foreign nationals, while the UN has called for vigilante groups in the country to be banned, and the African Union has formally been urged to act on the ongoing illegal immigrant sentiment in SA to preserve solidarity on the continent. The Gauteng High Court (Johannesburg) has been inundated with urgent applications from undocumented foreign nationals challenging their deportations, a surge Judge Mandlenkosi M***a described as the 'aftershock' of civil society anti-immigrant campaigns. The ruling follows the Constitutional Court’s July decision that asylum seekers cannot be deported before accessing the asylum system.

In Uganda, military chief Muhoozi Kainerugaba has announced plans to run for President in 2031, signalling a possible bid to succeed his father, President Yoweri Museveni. Kainerugaba said he expected to win 90% of the vote with the support of his father

And Tanzania’s ruling Chama Cha Mapinduzi party has picked the Energy Minister as its nominee for the new Vice-President after the incumbent announced his resignation less than a year into the job. Outgoing Vice-President Emmanuel John Nchimbi’s resignation followed criticism from some in the party for remarks about the Constitution last month that they considered unnecessary.

SETTLEMENT REACHED OUTSIDE LITIGATION CANNOT BE MADE AN ORDER OF COURT

In CV Projects (Pty) Ltd v Adaptfin (Pty) Ltd and Others the Eastern Circuit Local Division (Thembalethu) held that for a settlement agreement to be made an order of court it must relate – directly or indirectly – to a lis between the parties. CV Projects and Adaptfin concluded a settlement agreement on 20 March 2026 and CV Projects sought, under Rule 41(4) of the Uniform Rules of Court, to have it made an order of court. Rule 41(4) permits judgment on a settlement agreement relating to "proceedings" that have not been carried out. Relying on Eke v Parsons 2016 (3) SA 37 (CC) para 25, Valor IT v Premier, North West Province 2021 (1) SA 42 (SCA) para 52, and Ekurhuleni City v Rohlandt Holdings CC 2025 (1) SA 1 (CC) paras 48–50, the court held that an order must be "competent and proper," relating directly or indirectly to a lis between the parties; agreements concluded outside litigation cannot be converted into court orders merely for enforcement convenience. The founding and replying affidavits disclosed no pending proceedings, no forum and no case number, and the settlement itself recorded only that the first respondent "had commenced" proceedings, with a jurisdiction clause suggesting none were pending. Counsel's argument for a wide reading of "indirectly," drawing on Ex parte Le Grange, was rejected as inconsistent with binding Constitutional Court authority.

The application to have the settlement agreement of 20 March 2026 made an order of court was dismissed.

Dr Bongiwe ‘Bee’ Nhlangulela wants to feel like a winner every day. It was this mentality which took her from government practice – where she started by doing 35-50 extractions everyday in a monotonous routine with little opportunity to expand her skills – to starting Dr Bee Inc Family Dentists with practices in Sandton and Constantia Kloof, Johannesburg.

In the latest episode of Why Did I Become A Doctor?, in partnership with MedicalBrief, Nhlangulela talks about her need to feel stimulated and rewarded, which pushed her forward. She shares how her own dental struggles, and the jaw surgery that followed, changed the way she saw herself, and how shadowing her childhood dentist showed her the impact a smile can have on a person's confidence. It was enough to make her turn down a full scholarship to study medicine and choose dentistry instead.
