A RESOLUTION URGING THE BUREAU OF FISHERIES AND AQUATIC RESOURCES (BFAR), THE DEPARTMENT OF AGRICULTURE (DA), THE DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES (DENR), AND OTHER CONCERNED NATIONAL GOVERNMENT AGENCIES TO IMMEDIATELY ADDRESS THE UNITED STATES BAN ON PHILIPPINE BLUE SWIMMING CRAB FISHERIES AND TO PROVIDE ASSISTANCE TO AFFECTED FISHERMEN, WORKERS, AND COMMUNITIES

WHEREAS, the United States National Marine Fisheries Service (NMFS) issued a negative comparability finding against Philippine blue swimming crab fisheries under the Marine Mammal Protection Act (MMPA);

WHEREAS, the report stated that the Philippines failed to establish adequate marine mammal bycatch monitoring, reporting systems, and sufficient mitigation measures involving endangered Irrawaddy dolphins;

WHEREAS, the blue swimming crab industry provides livelihood and income to thousands of small fishermen, crab pickers, plant workers, traders, and transport workers in coastal communities throughout the country;

WHEREAS, the continued implementation of the ban may result in reduced exports, declining crab prices, closure or reduced operations of processing plants, and loss of livelihood among affected communities;

WHEREAS, there is an urgent need for the national government to implement corrective actions, establish effective monitoring systems, and provide economic assistance to affected sectors;

RESOLVED, as it is hereby resolved, to strongly urge the Bureau of Fisheries and Aquatic Resources (BFAR), the Department of Agriculture (DA), the Department of Environment and Natural Resources (DENR), and all concerned national government agencies to immediately address the compliance issues cited by the United States National Marine Fisheries Service regarding Philippine blue swimming crab fisheries;

RESOLVED FURTHER, to urge the immediate implementation of a comprehensive marine mammal bycatch monitoring and reporting program consistent with international standards;

RESOLVED FURTHERMORE, to request the national government to provide financial assistance, alternative livelihood support, and economic interventions for affected fishermen, workers, and communities dependent on the crab industry;

RESOLVED FINALLY, that copies of this Resolution be furnished to the Office of the President, BFAR, DA, DENR, concerned Congressional Offices, and other relevant agencies for their appropriate action.

Good day everyone.

As a member of this Sanggunian Bayan, I rise today on a matter of urgent public concern regarding the recent decision of the United States National Marine Fisheries Service (NMFS) denying the Philippinesโ€™ comparability finding for blue swimming crab fisheries under the Marine Mammal Protection Act.

This issue is not only about exports. This is about the lives and livelihood of thousands of Filipino fishermen, crab pickers, plant workers, traders, transport workers, and small businesses that depend on the crab industry.

The NOAA report clearly stated that the Philippines failed to establish an adequate marine mammal bycatch monitoring and reporting program, particularly involving the protection of Irrawaddy dolphins. Because of this, Philippine blue swimming crab fisheries were declared โ€œnot comparableโ€ to U.S. standards, resulting in restrictions that now threaten one of the countryโ€™s important seafood export industries.

Mrs. Presiding Officer, the impact of this ban is severe.

In many coastal communities, especially in Igbon, Tambaliza, Bagongon, Malangabang, Polopina, Dungon and other Island Barangayโ€™s small fishermen rely on crab fishing as their primary source of income. Many families now fear reduced buying prices, loss of market access, reduced operations of crab processing plants, and possible unemployment.

This is not only an environmental issue. It has become an economic and social issue affecting ordinary Filipinos who are already struggling with rising fuel prices, inflation, and unstable income.

What is painful is that the report itself recognized that the Philippines only recently started pilot monitoring programs and still lacks sufficient nationwide implementation. This shows that government action came too late despite earlier warnings and previous findings issued as early as 2025.

We support marine conservation and the protection of endangered species such as the Irrawaddy dolphin. However, environmental protection and protection of livelihood must go hand in hand.

Therefore, we call upon BFAR, DENR, DA, and all concerned national agencies to act immediately and decisively by:
1. Fast-tracking the implementation of a nationwide marine mammal bycatch monitoring program;
2. Providing immediate assistance and financial support to affected fishermen and workers;
3. Strengthening coordination with exporters, local governments, and fishing communities;
4. Establishing clear compliance measures and timelines to regain access to the U.S. market; and
5. Ensuring that small fishermen are not left carrying the burden of government shortcomings.

Mrs. Presiding Officer, our fishermen should not suffer because of delayed compliance and lack of preparation.

This representation stands in solidarity with our coastal communities and urges the national government to take urgent corrective measures before more livelihoods are lost and further economic damage is done to the Philippine crab industry.

The 21st Regular Session of the 12th Sangguniang Bayan formally commenced with the Privilege Speech of Mark Ruffin C. Villaruz, focusing on the growing concern over the United States ban on Philippine Blue Swimming Crab fisheries and its possible impact on local fishermen, crab workers, processing plants, and coastal communities dependent on the industry.

During the privilege speech, emphasis was given on the urgent need for immediate intervention from the Bureau of Fisheries and Aquatic Resources (BFAR), Department of Agriculture (DA), Department of Environment and Natural Resources (DENR), and other concerned national government agencies to address compliance issues involving marine mammal protection and fisheries monitoring standards.

As part of the session, a proposed resolution was introduced urging the national government to:

โ–ช๏ธ Implement corrective and environmental protection measures
โ–ช๏ธ Provide financial assistance and alternative livelihood support to affected sectors

Following the privilege speech, the Sanggunian proceeded with the discussion of various resolutions and committee reports concerning civil society accreditation, SK budget validation, fuel agreements for LGU operations, barangay ordinances on public safety and sanitation, infrastructure measures, and agricultural and environmental initiatives including the Bamboo Nursery Establishment Project.
