Falls officials: Spring court date likely in Elcon appeal

A hearing between Falls and Elcon Recycling Services likely will take place in Bucks County Court of Common Pleas this spring, a township official said this week.
The battle to build a controversial waste treatment facility in Falls isn’t over yet.

Before the two sides head to court, Elcon will have 30 days to submit a brief, township solicitor Mike Clarke said during Monday’s supervisors meeting. Falls will have 30 days to submit its brief before Elcon gets 10 days to submit a rebuttal, Clarke said.
Once the briefs are submitted, oral arguments will be scheduled in court, said Clarke, who estimated this would occur in April or early May.
The proposal has been a hot topic in the region since first floated in 2015, with residents and environmental groups expressing a wide range of pollution and human health concerns, and the company saying the facility would use advanced technology to ensure it is operated safely.
A few weeks after supervisors voted down the plan, it hit another setback when the Pennsylvania Department of Environmental Protection issued a draft “intent to deny” notice for the company’s primary application on May 15.
But a mandatory public comment process left the door open for Elcon to try again, and the company submitted more than 200 pages of changes to its application on July 15, the last day for public comment. The response is detailed and technical, but it appears to try to correct some of the issues DEP highlighted in its draft denial.
For example, the DEP in May requested Elcon conduct quarterly groundwater sampling to “provide the best assurance of the earliest detection” of any spills, instead of only testing in the event of a spill, as Elcon had initially proposed. In its new materials, Elcon appears to state it would sample quarterly with no argument.

The Falls Township Supervisors denied Elcon application on April 30, 2019.
The Pennsylvannia Department of Environmental Protection (PA DEP) issued a Temporary DRAFT Denial of Elcon ‘s Waste Permit on May 15, 2019.

The PA DEP states that a Notice of Intent to Deny is NOT FINAL. After completing a 10-month technical review of materials submitted by Elcon, the DEP has found a number of outstanding deficiencies that remain unaddressed to the DEP’s satisfaction. Elcon is correcting the deficiencies.
On June 13th, Elcon filed an appeal to The Bucks County Common Pleas Court after the township's supervisors voted to reject their land development application.

(There are two other pending applications for air quality and stormwater. These applications do not have a deadline)

A lot of progress has been made! We must continue to encourage our Delaware Valley residents friends,neighbors, families and our Elected Officials to continue to Oppose Elcon by writing to the Pa DEP.

Stop Fracking! Just received this email from the Delaware River Keepers....CALL IN Monday, Tuesday and Wednesday – June 3, 4 and 5 - to stop (DRBC) Delaware River Basin Commission Takeover Bill!

PA Senate Committee to vote on SB305 and House of Representatives to take floor vote on HB827 - bills that would subject a DRBC fracking ban to eminent domain payments.

Please make a call MONDAY to your Representative in the PA House asking for a NO vote on HB827, legislation cited as “Designating certain activity by the Delaware River Basin Commission (DRBC) as the exercise of the power of eminent domain that entitles the owners of the property in question to appropriate and just compensation.”

The Senate Environmental Resources & Energy Committee has also scheduled a vote on Tuesday, June 4 at 9:30 am on SB305, the Senate version of HB827. Senator Lisa Baker’s MEMO on the bill claims that a ban on fracking is a “taking” and property owners are due compensation, which is not legally correct, is inflammatory, and wrong-headed on its face. We all know banning fracking protects property and land rights, providing lasting and deep benefits.

SB305 and HB827 are dangerous attempts to undermine reasonable government efforts to protect the health, safety and environment from the destruction caused by fracking. A duly adopted ban on fracking benefits peoples’ health and the environment, it’s an important preservation of our environmental rights, and it’s not an exercise of eminent domain.

After the April 30, 2019 vote denying Elcon’s Application, Supervisor Chairman Robert Harvie, Jr. stated Elcon’s application is still pending before the PA Department of Environmental Protection (DEP). Specifically, the PA DEP may not follow Falls Townships denial. Mr. Harvie stated that he hoped the DEP would.

April 30th is the Falls Supervisors Special Meeting to vote on Elcon building at 100 Dean Sievers Place (formerly US Steel) in Fairless Hills, Pa. The meeting will be held at Pennsbury High School WEST 608 Hood Blvd. Fairless Hills, Pa (Keller Hall) at 7pm. They are going to vote on opposing or approving Elcon building in Falls Township.
