π NOTARY EDUCATION
π¨ Never give legal advice. Your role is to witness signatures.
This line gets crossed every day β usually with the best intentions. Let's look at REAL scenarios so you know exactly where the boundary is.
π SCENARIO 1: The Confused Signer
Client asks: "Is signing this deed going to affect my taxes?"
β Wrong: "This type of transfer usually doesn't trigger taxes β you should be fine."
β
Right: "That's beyond my role as a notary. Please speak with a tax professional or attorney before we proceed."
π SCENARIO 2: The Pressured Signer
An elderly woman whispers, "I'm not sure I want to do this" while her son urges her to sign.
β Wrong: Staying silent and proceeding.
β
Right: Pause. Ask privately, "Are you signing of your own free will?" If there's any doubt β do not notarize.
π SCENARIO 3: The Document Question
Client asks: "Which is better for me β a living trust or a will?"
β Wrong: Sharing your opinion based on what you've seen.
β
Right: "That's a question for an estate planning attorney. I can notarize once you've made that decision with proper guidance."
π SCENARIO 4: The Casual Question
After the signing: "Can I get out of this contract if I change my mind?"
β Wrong: "Well, there's usually a rescission period..."
β
Right: "Contract questions are outside my lane β an attorney can help you with that."
π YOUR ROLE AS A NOTARY:
β
Verify identity
β
Confirm willingness & awareness
β
Witness the signature
β
Apply your seal
Everything else? Refer it to the right professional. Holding this boundary confidently is not a weakness β it's the mark of a true professional who protects their commission and their clients. πΌ
