What happens when a notary loses control of a document package?

Whether documents are misplaced, left behind, or stolen, the first priority is to act immediately and protect the information involved.

Contact the hiring or responsible party, document what happened, follow applicable state requirements, and if theft is suspected, contact law enforcement as appropriate.

A notary handles more than paper—we may be entrusted with signatures, identification information, financial documents, healthcare documents, and other sensitive records.

HOW MANY NOTARIZATIONS CAN BE PERFORMED IN ONE APPOINTMENT?

One document? Five? Twenty? Fifty?

The important issue isn't simply the size of the document package. Each required notarial act must be performed correctly under the applicable state's law.

Multiple documents may be handled during the same appointment, but one appointment doesn't turn multiple required notarial acts into one.
More documents don't change the standard—each notarization still has to be done correctly.

A verbal oath or acknowledgment must be performed for each individual signature, all signers have to be physically present, properly identified, acting of their own accord and every single notarial act must be entered, according to state law.

When working online platforms or technology may have capacity limitations which would have to be verified on an individual basis.

DID YOU KNOW? NOTARY HISTORY GOES WAY BACK.

Long before electronic signatures, online platforms, digital certificates, and modern notary stamps, notaries were already serving an important role in documenting transactions and preserving the integrity of official records.

In 1639, Thomas Fugill was appointed to serve as a notary in the New Haven Colony—an appointment commonly recognized in American notary history as one of the earliest milestones of the profession.

Think about that for a moment

No printers
No scanners
No RON platforms
No electronic journals

No ink stamps as we know them today.

Just handwritten records, quill and ink, seals—and a responsibility to properly document important acts and transactions.

Nearly four centuries later, the tools have changed dramatically.

The responsibility behind the work has not changed at all.

From parchment and quill to electronic signatures and remote online notarization, notaries continue a profession built around identity, authenticity, documentation, and trust.

History changes the tools. Professional responsibility carries the tradition forward.

CAN A NOTARY PUBLIC BE SUED?

Yes. A notary public can potentially face civil liability when an improper notarization contributes to financial loss, fraud, or another person's damages.

Some situations that can create liability include:
Failure to require personal appearance: Performing a notarization without the signer appearing as required by the applicable state's law.

Improper identification: Failing to properly identify the signer using an identification method permitted by state law.

Notarizing an incomplete document: Proceeding when the document contains blanks or missing information that makes the notarization improper under applicable law.

Ignoring signs that the signer isn't acting willingly or knowingly: A notary should not proceed when there are reasonable concerns that the signer is being coerced or does not appear aware of what they are signing. The notary is not making a medical determination of mental capacity.

Improper recordkeeping: Failing to maintain a journal or other notarial records when required by the commissioning state's law, or failing to properly document a transaction when records are maintained.

Conflict of interest: Performing a notarization when the notary has a prohibited financial or beneficial interest in the transaction.

False or improper certificates: Completing a notarial certificate containing information the notary knows is false, or certifying that a required act occurred when it did not.

Exceeding the notary's authority: Giving unauthorized legal advice, selecting legal documents or certificates for a signer when prohibited, or otherwise acting outside the authority granted to a notary.

A Notary Stamp Is More Than Ink

A notarization may look like a signature, certificate, and stamp—but the notary's actions can carry real legal and financial consequences.

That's one reason notaries should know their state's laws, follow proper procedures, document their work appropriately, and maintain suitable Errors & Omissions (E&O) insurance.

Know your authority. Follow your state's law. Protect the signer—and protect your commission.
