Day 7: Right to Full & Timely Restitution and Attorney General Victim Compensation Fund

Under Marsy’s Law, you have the right to seek restitution—money the offender may be ordered to pay for losses caused by the crime.

📌 Restitution can cover out-of-pocket expenses if supported by documentation
📌 It can be requested at a plea hearing or sentencing
📌 A separate hearing may be needed if the amount is disputed

An offender can be ordered to pay restitution for crimes that
were dismissed as part of the negotiated plea, as long as the defendant agrees to do so as part of the plea.

✨ Another option:
Victims may also seek reimbursement through the Ohio Attorney General’s Crime Victim Compensation Program.

This state program may reimburse up to $50,000 for certain out-of-pocket expenses related to a violent crime. Administered by the Ohio Attorney General, with review through the Ohio Court of Claims. Under Marsy’s Law, you have the right to be informed if subpoenas, motions, or other requests t access victim personal, confidential, or privileged information.

📄 You can request notice of subpoenas, motions, or requests for your information by completing a Victims’ Rights Request Form (VRRF).

You can object to requests for:
• Medical or counseling records
• School or employment records
• Personal devices or online accounts
• Other private information

⏰ These requests require a timely response—so it’s important to act quickly!

You can:
• Ask the prosecutor to respond
• Hire an attorney
• Contact OCVJC for free legal assistance.

You can:
• Attend any public hearing—including trial.
• Speak directly to the judge about your concerns, safety, or privacy.
• Be heard at key stages like arraignment, release, pleas, and sentencing.

If you requested notice but didn’t receive it—or were told you couldn’t attend or speak, contact OCVJC for guidance or free legal assistance.

📅 If you request notice, prosecutors must inform you of upcoming hearings at least 7 days in advance.

Day 2: Right to Privacy - Redaction

Under Marsy’s Law, you have the right to privacy.

Redaction means you can request to have your name, address, and identifying information removed from public records.

📄 Use the Victims’ Rights Request Form (VRRF) to make this request with law enforcement, prosecutor, and court records, as this right must be requested in writing.

If your information is already in a police report or court record, OCVJC can help you take steps to have it removed.
