ANTI-TOPLESS OR HALF-NAKED ORDINANCE SA PAGADIAN CITY, approved na sa third and final reading

Usa ka public hearing ang gipatawag sa Committee on Laws nga natahasan mu-review sa Draft Ordinance No. 039 entitled: “An Ordinance Prohibiting the Act of Being Topless or Half-Naked in Public Places”. Through the representatives from national agencies and Non-Government Organizations (NGOs), nahisgutan ang Ordinansa para sa hapsay nga implementation puhon diri sa atong syudad.

📌 WHAT IS TOPLESS?
- the act of being without upper clothing, or wearing of clothing that does not sufficiently cover the chest.

📌 WHAT IS HALF-NAKED?
- the act of being without upper clothing, or the wearing of clothing that does not sufficiently cover the buttocks, and/or ge****ls such that the lower body is exposed inappropriately.

📌 EXCEPTIONS (dili apil sa coverage sa balaod):

1. Exception as to age – All persons aged 0-15 years old shall be excepted from this ordinance.

2. Exception as to venue – public places where it is necessary or one is expected to be topless or in undergarments such as swimsuits:
(a) resort, beach, swimming pool, rivers, streams, etc.;
(b) official sporting events or exercise;
(c) approved theatrical or cultural performances;
(d) medical emergency, those by reason of mental health or situations requiring immediate medical attention; and
(e) all other emergencies or situations that could justify the act of being naked, topless or half naked.

3. Exception as an expression of one’s fashion, culture and arts – where one is in a clothing which appears to have exposed intimate body parts in public but is considered a cultural tradition, an expression of one’s fashion, or arts.

4. Exception as necessarily required by their livelihood – those by reason of livelihood would necessarily be topless, such as but not limited to the aqua-culture or agricultural workers and fisherman.

PENALTIES:
❎ 1st Violation: Penalty of P1000
❎ 2nd Violation: Penalty of P3000
❎ 3rd and succeeding violations: Php 5,000.00 fine or imprisonment for a period not exceeding one (1) year, or both at the discretion of the court

Prior to the implementation of this Ordinance, the PNP-Pagadian City Police Station led by PLTCOL. LEE ERIC HUMPA expressed his commitment to properly disseminate the Ordinance and apprise the public sa mga ginadili sa Ordinansa.
