Under the Ease of Doing Business and Efficient Government Service Delivery Act of 2018 (Republic Act No. 11032), which amended the original Anti-Red Tape Act (ARTA), the penalties for public officials and employees who cause bureaucratic delays or violate service standards are strict and follow a tiered system.

Here are the specific penalties:

First Offense

Administrative Liability: Six (6) months suspension from service without pay.

Note: This applies to general delays or negligence. If the violation involves corruption, authorities can escalate charges under the Anti-Graft and Corrupt Practices Act.

Second Offense

A second violation is treated with zero tolerance and carries both administrative and criminal liabilities:

Administrative Dismissal: Permanent removal from government service.

Perpetual Disqualification: Forever barred from holding any public office.

Forfeiture of Benefits: All retirement benefits are forfeited (except for accrued leave credits).

Imprisonment: A jail term ranging from one (1) year to six (6) years.

Criminal Fine: Ranging from ₱500,000 to ₱2,000,000.

The "Fixing" Exception

There is a strict exception to the tiered system: the act of fixing (facilitating speedy completion of transactions for a fee or personal gain) or colluding with fixers.

Penalty: Fixing is punishable by dismissal from service and criminal prosecution on the very first offense. ---

What Constitutes a Violation?

The above penalties can be triggered by any of the following actions:

Refusal to Accept: Rejecting an application or request that has complete requirements without due cause.

Extortion / Hidden Rules: Imposing additional requirements or costs that are not explicitly stated in the agency's Citizen’s Charter.

Failure to Notify: Failing to give the applicant a written notice explaining why an application or request was disapproved.

Missing the Deadline: Failing to process an application within the prescribed 3-7-20 working days rule (3 days for simple, 7 for complex, 20 for highly technical transactions) without justifiable reason.

Ignoring Applicants: Failing to attend to applicants who are within the premises prior to the end of official working hours or during the lunch break.

Fixing: Taking money or other advantages to speed up processes.
