FIDAC CONDEMNS THE UNLAWFUL ARREST OF FORMER KANO ANTI-CORRUPTION BOSS, BARR. MUHUYI MAGAJI RIMINGADO

The Fiscal Discipline and Development Advocacy Centre (FIDAC) expresses deep concern and unequivocally condemns the reported forceful and irregular arrest of the former Executive Chairman of the Kano State Public Complaints and Anti-Corruption Commission, Barrister Muhuyi Magaji Rimingado, by operatives of the Nigerian Police Force on Friday. The alleged arrest without warrant, without disclosure of grounds, and accompanied by threats of violence, stands as a direct affront to the rule of law, human dignity, and civil liberties. FIDAC views this as a dangerous trend capable of weakening public trust in law enforcement institutions.

Eyewitness accounts reveal that heavily armed officers stormed his law firm on Zaria Road, Kano, allegedly without presenting a warrant of arrest or stating any legal basis for the operation. Such an action, executed in a manner likened to a militarized assault, flagrantly violates due process and constitutes a breach of constitutional safeguards guaranteed to every Nigerian citizen.

This development stands in clear contradiction to the provisions of the 1999 Constitution of the Federal Republic of Nigeria (as amended), which guarantees the right to personal liberty under Section 35(1), mandates that an arrested person must be promptly informed of the reason for the arrest as stated in Section 35(3), requires that such a person be charged to court within a reasonable period in accordance with Section 35(4), and upholds the presumption of innocence until proven guilty by a competent court under Section 36(5).

FIDAC’s Position
FIDAC, as a civic accountability and public finance advocacy organization, firmly believes that no democratic state should tolerate intimidation of anti-corruption champions or weaponization of state security agencies against reform advocates.

Barrister Muhuyi Magaji remains one of Kano’s most prominent figures in public accountability, renowned for his courageous stance during the administration of Dr. Abdullahi Umar Ganduje, CON, and his continued support to the current government of H.E. Abba Kabir Yusuf. His proactive intervention during the 2019 fuel scarcity crisis and COVID-19 Era when commodity hoarding surged, restored order and protected citizens from exploitative market practices. His track record underscores his unwavering commitment to integrity and public interest.

Our Demands
FIDAC hereby:
1. Demands the immediate and unconditional release of Barr. Muhuyi Magaji, except where a lawful court order justifies the contrary.
2. Calls on the President and Commander-in-Chief to intervene promptly to preserve justice, uphold human rights and safeguard democratic institutions.
3. Urges the Inspector-General of Police to initiate an impartial investigation into the conduct of the arresting officers.
4. Calls on the Kano State Government, civil society, media, traditional leaders, activists, lawyers, student bodies and citizens to stand in firm solidarity with Barr. Muhuyi Magaji.
5. Demands strict adherence to the Administration of Criminal Justice Act (ACJA) and constitutional arrest procedures to prevent the re-emergence of unlawful detentions.

Should Barr. Muhuyi Magaji remain in custody beyond 24 hours, FIDAC will have no option but to seek legal redress in a competent court to challenge what appears to be an arbitrary and unconstitutional abuse of power.

Final Call to Nigerians
We remind all Nigerians that democracy thrives when citizens defend justice, but collapses when people remain silent in the face of oppression. The battle against corruption and abuse of authority is a collective duty, not the responsibility of a single individual.

Nigeria must remain a nation governed by law, not intimidation, force or impunity.

FIDAC Urges Nigerian Businesses to Take 14 Critical Actions to Avoid Penalties and Maximize Benefits Under the Nigerian Tax Acts, 2025

The Fiscal Discipline and Development Advocacy Centre (FIDAC) has called on businesses across Nigeria to immediately begin adapting their operations to meet the requirements of the newly enacted Nigerian Tax Acts, 2025. The Centre warns that failure to comply before enforcement begins in January 2026 will expose businesses—small, medium, and large—to avoidable penalties, disputes, and financial risks.

In a statement signed by its Executive Director, Dr. Abdussalam Muhammad Kani, Ph.D., FCFA, FIDAC noted that the 2025 reform package introduces significant changes across Personal Income Tax, Corporate Income Tax, Value Added Tax (VAT), Capital Gains Tax, Stamp Duties, Withholding Tax, and the newly established Fossil Fuel Surcharge.

Dr. Kani emphasized that “This is the most far-reaching tax reform in Nigeria’s recent history. Every business must understand its obligations and take proactive steps to avoid penalties and position itself for incentives embedded in the Act.”

According to FIDAC, 14 smart actions have become essential for Nigerian businesses under the new fiscal regime:
1. Strengthen Financial Record-Keeping
FIDAC urges businesses to improve daily documentation of sales, expenses, inventory, payroll, and all supporting evidence such as receipts, invoices, contracts, bank statements, and supplier payments. Accurate records, the Centre noted, remain the strongest protection during tax audits.
2. Understand What Is Taxable
The new law does not tax capital, stock, or bank balances. Instead, tax applies strictly to income and profit, including benefits-in-kind, grants, prizes, and compensation above ₦50 million. Corporate tax now applies even to service-based enterprises.

3. Take Advantage of Tax Incentives
Individuals earning below ₦800,000 annually will pay no personal income tax. Companies with turnover below ₦50 million are exempt from Corporate Income Tax. Start-up expenses within six years are now deductible, and simplified accounts are acceptable for small firms.
4. Formalize and Structure Business Operations
FIDAC encourages all operators to register their businesses, obtain Tax Identification Numbers (TIN), and separate personal funds from business finances to reduce exposure to penalties.
5. Transition to Digital Accounting and Reporting
Businesses are advised to adopt digital tools such as POS systems, electronic receipts, and simple accounting applications to track VAT, WHT, and income. Digital footprints reduce disputes with tax authorities.
6. Ensure VAT Compliance
VAT remains at 7.5%, with reforms allowing claims on input VAT for services and fixed assets. Returns must be filed monthly, including zero-return months.
7. Deduct Withholding Tax Correctly
The Act mandates timely deduction and remittance of WHT at 5% for individuals and 10% for companies on contracts, rent, consultancy, and professional services.
8. Prepare for the New 5% Fossil Fuel Surcharge
Businesses dependent on fossil fuels—such as logistics firms, manufacturers, and fuel distributors—must adjust their pricing and cost structures accordingly.
9. Comply with Updated Stamp Duty Regulations
FIDAC highlights those agreements below ₦1 million are now exempt, while some documents attract a fixed ₦1,000 duty. Businesses must ensure proper stamping of contracts, loans, and corporate documents.
10. Use the Office of the Tax Ombud
The new law establishes the Tax Ombud to address unfair assessments, harassment, delayed refunds, and administrative misconduct. Businesses are advised to report all irregularities.
11. Engage Competent Professionals
FIDAC recommends consulting tax experts, conducting annual tax health checks, and training staff to ensure compliance.

12. Pay Taxes Early
Businesses are reminded that late filings attract penalties, interest charges, account freezes, and in extreme cases, closure of premises.
13. Avoid Common Operational Mistakes
These include mixing personal and business finances, failure to issue receipts, ignoring VAT and WHT obligations, poor stock records, and undocumented transactions.
14. Start Preparing Now
FIDAC stressed that early preparation ahead of January 2026 will significantly reduce risk, improve tax efficiency, and prevent disputes with authorities.

Dr. Kani concluded by reaffirming FIDAC’s commitment to supporting businesses through advocacy, public enlightenment, and capacity-building initiatives. He encouraged business owners to reach out to FIDAC for guidance and compliance support.

participated in the Northern States Tax Readiness Conference, held in Kano from 4th-6th November, 2025. The landmark event, convened under the auspices of the Kano Internal Revenue Service (KIRS), brought together Executive Chairmen, Directors, and technical officers from the 19 Northern States Boards of Internal Revenue, including the FCT-IRS, alongside representatives from the Federal Inland Revenue Service (FIRS), Joint Tax Board (JTB), Civil Society Organizations (CSOs), and private sector partners.

The summit was organized in response to the following four new Nigerian Tax Reform Acts, 2025, signed into law by President Bola Ahmed Tinubu:

FIDAC HAILS AUDITOR-GENERAL FOR LOCAL GOVERNMENT COUNCILS, KANO STATE, FOR PIONEERING THE MAIDEN CITIZENS’ ACCOUNTABILITY REPORT (CAR): A NEW ERA OF TRANSPARENCY AND FISCAL DISCIPLINE

The Fiscal Discipline and Development Advocacy Centre (FIDAC) commends the Office of the Auditor-General for Local Governments, Kano State, for pioneering the maiden Citizens’ Accountability Report (CAR) — a landmark achievement in subnational transparency, fiscal discipline, and participatory governance across the State’s 44 Local Government Councils (LGCs).

The CAR presentation, held from 30th October to 2nd November 2025 in Kaduna, brought together a wide spectrum of stakeholders, including representatives from the Ministries for Local Government and Chieftaincy Affairs, Finance, Planning and Budget, the Office of the State Auditor-General, academia, civil society organizations, and community-based groups. The forum served as a reflective platform for knowledge sharing and reaffirmed collective commitment to strengthening accountability and fiscal responsibility at the grassroots level.

A Citizens’ Accountability Report (CAR) is a reform-oriented governance instrument designed to bridge the information gap between citizens and their government. By translating complex fiscal data into simplified and accessible information, the CAR empowers citizens to understand government spending, assess performance, monitor progress, and hold duty bearers accountable for the use of public resources. Typically, the CAR provides concise insights on financial performance, capital projects, programme outcomes, challenges, and remedial actions — making local governance measurable, transparent, and reviewable in the public domain.

The presentation of Kano State’s first-ever CAR represents a watershed moment in grassroots accountability. It demonstrates the readiness of all 44 LGAs to institutionalize transparency, entrench fiscal prudence, and rebuild citizens’ trust in governance. This initiative aligns with the principles of the Open Government Partnership (OGP) and mirrors international standards in participatory budgeting, open contracting, and performance-based reporting.

FIDAC also commends the local governments for their ongoing reform efforts, including the adoption of the National Chart of Accounts (NCoA) and the integration of local development planning frameworks across the 44 councils. These reforms illustrate a deliberate, structured, and coordinated approach to public financial management and evidence-based decision-making at the subnational level.
While celebrating this milestone, FIDAC urges the Ministry for Local Government to ensure the annual conduct of the Medium-Term Expenditure Framework (MTEF) and Medium-Term Revenue Target (MTRT) exercises in line with the Kano State Public Financial Management Law, 2020. This will promote fiscal predictability, coherence, and transparency across all LGAs while strengthening the State’s fiscal governance system.

Furthermore, FIDAC calls on the Kano State House of Assembly Public Accounts Committee to ensure that all audit queries raised in the report are diligently resolved in accordance with the provisions of the law. The Centre also appeals to the House of Assembly to draw the attention of both the Commissioner, Ministry of Finance, and the Chairman, Kano State Internal Revenue Service (KIRS) to the statutory requirement that 10% of the State’s Internally Generated Revenue (IGR) be earmarked and disbursed monthly to the 44 LGAs, as stipulated in the Kano State and Local Government Revenue Administration (Consolidation and Codification) Law, 2021.

FIDAC further emphasizes the need for broader stakeholder engagement — including women, youth, traditional institutions, private sector actors, grassroots networks, and the media — in the dissemination and validation of subsequent CAR editions. Such inclusivity will deepen public participation, foster collective ownership, and reinforce the accountability ecosystem in Kano State.

The Centre expresses hope that, in the near future, each Local Government Council (LGC) in Kano State will independently prepare and present its Citizens’ Accountability Report annually. Likewise, FIDAC urges the Office of the Auditor-General for Local Governments to expedite the translation of the CAR into Hausa for wider public access and understanding, ensuring that all citizens — regardless of literacy level — can engage meaningfully with the report.

FIDAC commends the Kano State Government, under the visionary leadership of His Excellency, Alhaji Abba Kabir Yusuf, for fostering an enabling environment that promotes innovation, probity, and citizen-centered governance. The Centre acknowledges the administration’s continued support for reforms that strengthen local accountability and bring the dividends of democracy closer to the people.

Once again, FIDAC extols the Auditor-General for Local Governments, Kano State, for his visionary leadership, technical diligence, and unwavering commitment to promoting transparency and fiscal responsibility. The Centre encourages him to sustain this momentum and continue deepening citizen participation and stakeholder engagement in subsequent accountability processes.

In conclusion, the Citizens’ Accountability Report (CAR) symbolizes more than a document — it represents a social contract between government and citizens, a replicable model of open governance and fiscal citizenship worthy of emulation across Nigeria.
