The European Network of Councils for the Judiciary (ENCJ), the Association of the Councils of State and Supreme Administrative Jurisdictions of the European Union (ACA-Europe), the International Association of Judges (IAJ) and the Network of the Presidents of the Supreme Judicial Courts of the European Union (NPSJCEU) issued a joint statement on 12 August 2026 on measures affecting the independence of the International Criminal Court.
Responding collectively to recently announced measures directed against the International Criminal Court (ICC), the four networks recall that the rule of law requires respect for both national and international legal orders and for the judicial institutions established to uphold them.
𝐎𝐧 𝐦𝐞𝐚𝐬𝐮𝐫𝐞𝐬 𝐚𝐟𝐟𝐞𝐜𝐭𝐢𝐧𝐠 𝐭𝐡𝐞 𝐢𝐧𝐝𝐞𝐩𝐞𝐧𝐝𝐞𝐧𝐜𝐞 𝐨𝐟 𝐭𝐡𝐞 𝐈𝐂𝐂
The work of the International Criminal Court is of critical importance. It involves the investigation and, where appropriate, the bringing to justice of persons suspected of genocide, war crimes, crimes against humanity and the crime of aggression.
For the rule of law to exist, it is crucial that there is respect for both national and international legal orders and the judicial institutions established to uphold them. States should respect the independence of courts established under international treaties. The independence of the judiciary is not a privilege granted to judges, but a fundamental guarantee of the rule of law and the protection of human rights. Judges must be able to perform their functions free from external influence. In particular, measures designed to prevent the ability of a court to operate are incompatible with the principles of the rule of law and judicial independence.
On 13 July 2026, the US Secretary of State announced a campaign against the ICC, which included threats of additional sanctions. The actions stated to be under consideration included visa revocations and travel bans for ICC personnel, increased sanctions against the ICC and affiliated organisations, and diplomatic efforts to urge other Member States to withdraw from the ICC.
This development follows sanctions on individual judges, prosecutors and deputy prosecutors of the ICC by the Government of the USA in 2025. The sanctions have been condemned by the judicial community, not least by a joint statement of the ENCJ, the European Association of Judges and ACA-Europe in January 2026. Both measures undermine the operation of the International Criminal Court.
The European Network of Councils for the Judiciary, ACA-Europe, the International Association of Judges and the Network of Presidents of the Supreme Judicial Courts of the European Union reaffirm our support for the independence of the International Criminal Court, including its judges, prosecutors and staff.
We are united in our condemnation of this most recent initiative by the US Government against the International Criminal Court.

𝟐𝟎𝟐𝟔 𝐑𝐮𝐥𝐞 𝐨𝐟 𝐋𝐚𝐰 𝐑𝐞𝐩𝐨𝐫𝐭

The European Commission has published its seventh annual Rule of Law Report. The 2026 Rule of Law Report examines developments across all Member States, both positive and negative, in four key areas for the rule of law: the justice system, the anti-corruption framework, media pluralism and freedom, and other institutional issues related to checks and balances.

As it did in previous years, the Report does not only cover 27 Member States but also includes four country chapters dedicated to developments in Albania, Montenegro, North Macedonia and Serbia.

Since 2022, the Report includes concrete recommendations to all Member States. The Network of the Presidents of the Supreme Judicial Courts of the European Union held its Conference on Friday, 12 June 2026, in Lemesos (Limassol), Cyprus. Hosted by the Supreme Court of Cyprus, in collaboration with the Secretariat of the Cyprus Presidency of the Council of the EU 2026, the Conference brought together the Members, Associate Members and Observers of the Network, as well as representatives of the Court of Justice of the European Union, the European Court of Human Rights and the Supreme Court of Canada. The Conference was structured around two working sessions, addressing matters of ongoing importance for the highest courts.
𝐅𝐢𝐫𝐬𝐭 𝐰𝐨𝐫𝐤𝐢𝐧𝐠 𝐬𝐞𝐬𝐬𝐢𝐨𝐧 “𝐑𝐮𝐥𝐞 𝐨𝐟 𝐋𝐚𝐰: 𝐂𝐡𝐚𝐥𝐥𝐞𝐧𝐠𝐞𝐬 𝐢𝐧 𝐭𝐡𝐞 𝟐𝟏𝐬𝐭 𝐂𝐞𝐧𝐭𝐮𝐫𝐲”
The Conference opened with a working session on “Rule of Law: Challenges in the 21st Century” moderated by Mr Donal O’Donnell, Chief Justice of Ireland and President of the Network. Introductory presentations were delivered by Dr Tatu Leppänen, President of the Supreme Court of Finland; Dr Síofra O’Leary, Hauser/Remarque Fellow at NYU and former President of the European Court of Human Rights; Mr Maciej Szpunar, First Advocate General of the Court of Justice of the European Union; and The Right Honourable Richard Wagner, P.C., Chief Justice of Canada. A free discussion involving all Presidents and speakers followed.
The ensuing discussions invited participants to reflect on what they regard as the most significant challenges to the rule of law in Europe and beyond, and to what extent these challenges are reflected in their own jurisdictions. Participants were also invited to consider what role, if any, Supreme Courts should play in responding to challenges to the rule of law beyond deciding individual cases. Finally, the session turned to the lessons that can be learned from jurisdictions that have experienced democratic backsliding or erosion of the rule of law, particularly as regards the restoration of the rule of law and of public confidence in institutions.
𝐒𝐞𝐜𝐨𝐧𝐝 𝐰𝐨𝐫𝐤𝐢𝐧𝐠 𝐬𝐞𝐬𝐬𝐢𝐨𝐧 “𝐏𝐫𝐨𝐭𝐞𝐜𝐭𝐢𝐧𝐠 𝐢𝐧𝐝𝐢𝐯𝐢𝐝𝐮𝐚𝐥𝐬’ 𝐫𝐢𝐠𝐡𝐭𝐬 𝐢𝐧 𝐭𝐡𝐞 𝐝𝐢𝐠𝐢𝐭𝐚𝐥 𝐬𝐩𝐡𝐞𝐫𝐞 – 𝐭𝐡𝐞 𝐢𝐦𝐩𝐚𝐜𝐭 𝐨𝐟 𝐭𝐡𝐞 𝐃𝐢𝐠𝐢𝐭𝐚𝐥 𝐒𝐞𝐫𝐯𝐢𝐜𝐞𝐬 𝐀𝐜𝐭”
The afternoon session, “Protecting individuals’ rights in the digital sphere – the impact of the Digital Services Act,” was moderated by Dr Danguolė Bublienė, President of the Supreme Court of Lithuania, who delivered an introductory presentation alongside Dr Savvas S. Papasavvas, Vice-President of the General Court of the European Union. A free discussion involving all Presidents and speakers followed.
President Bublienė presented the introductory report she had prepared on the judicial application of the Digital Services Act (DSA) and its impact on the protection of individuals’ rights online. The report traced the evolution of the EU’s regulatory framework from the e-Commerce Directive to the DSA and its more protective, user-oriented approach. Drawing on responses to a questionnaire circulated to Members, Associate Members and Observers of the Network, it addressed the broad notion of “illegal content” and how it is understood across jurisdictions, the distinction between “illegal” and merely “harmful” content and its implications for freedom of expression, and the question of whether a prior criminal conviction is required before content may be treated as illegal.
The discussions that followed invited participants to reflect on whether a uniform interpretation of the DSA, particularly as regards the concept of illegal content, can be expected throughout the European Union, and on what role national supreme courts should play in shaping common DSA standards across Europe. Participants were also invited to consider whether the practical convergence of harmful and illegal content could lead to excessive restrictions on lawful content. Finally, the session turned to how the judicial system should respond when illegal or harmful information concerning the courts is published, and what measures courts themselves might take to address such content effectively.

Mr Donal O’Donnell, Chief Justice of Ireland and President of the Network, said:
“The objective for creating the Network back in 2004 was nothing less than “to form a homogenous community”. We now face issues that dwarf anything that would have engaged the founding members of the Network in 2004 – the rule of law is under express and explicit challenge around the world. It is precisely in this climate that the exchange between our highest courts is so valuable. I want to thank all the speakers of today, and indeed all participants, for the frank and engaged dialogue. My sincere thanks go also to President Stamatiou and the Supreme Court of Cyprus for their kind hospitality in welcoming us to Lemesos and for all the work done in organizing this Colloquium.”

The main theme of this year's conference, ‘Rule of Law: Challenges in the 21st Century’, is one of particular significance. The Members of the Network are the Presidents of the Supreme Judicial Courts of the EU Member States. In addition, Iceland, Liechtenstein, Norway and the United Kingdom have been admitted as Associate Members, and Albania, Montenegro, Serbia and Ukraine participate as Observers.

The General Assembly of the Network, which convened on 14 November 2025 at the occasion of The Hague Colloquium, elected the new Board and President of the Network.

The new President of the Network is 𝐌𝐫 𝐃𝐨𝐧𝐚𝐥 𝐎’𝐃𝐨𝐧𝐧𝐞𝐥𝐥, Chief Justice of Ireland.

The new members of the Board of the Network are Mr Eric de Formanoir de la Cazerie, First President of the Belgian Cour de cassation, Ms Katerina Stamatiou, President of the Supreme Court of Cyprus, Mr Petr Angyalossy, President of the Supreme Court of the Czech Republic, Mr Tatu Leppänen, President of the Supreme Court of Finland, Mr Christophe Soulard, First President of the French Cour de cassation, Ms Bettina Limperg, President of the Federal Court of Justice of Germany, Mr Pasquale D’Ascola, First President of the Supreme Court of Cassation of Italy, Ms Danguolė Bublienė, President of the Supreme Court of Lithuania, Mr Thierry Hoscheit, President of the Cour supérieure de justice of Luxembourg, Ms Dineke de Groot, President of the Supreme Court of the Netherlands and Mr Anders Eka, President of the Supreme Court of Sweden.

The Network of the Presidents of the Supreme Judicial Courts of the European Union holds its Colloquium on 13 and 14 November 2025 in The Hague, the Netherlands.

The event starts off on 13 November with a joint meeting between the Network and The Hague Judicial Club which brings together international courts and tribunals based in The Hague. The theme of the joint meeting is “𝐓𝐡𝐞 𝐂𝐨𝐧𝐭𝐫𝐢𝐛𝐮𝐭𝐢𝐨𝐧 𝐨𝐟 𝐈𝐧𝐭𝐞𝐫𝐧𝐚𝐭𝐢𝐨𝐧𝐚𝐥 𝐚𝐧𝐝 𝐍𝐚𝐭𝐢𝐨𝐧𝐚𝐥 𝐂𝐨𝐮𝐫𝐭𝐬 𝐚𝐧𝐝 𝐓𝐫𝐢𝐛𝐮𝐧𝐚𝐥𝐬 𝐭𝐨 𝐭𝐡𝐞 𝐑𝐮𝐥𝐞 𝐨𝐟 𝐋𝐚𝐰” and the keynote speeches of the session are delivered by Mr Yuji Iwasawa, President of the International Court of Justice, Ms Tomoko Akane, President of the International Criminal Court, Mr Mattias Guyomar, President of the European Court of Human Rights and Lord Robert Reed, President of the Supreme Court of the United Kingdom. The sessions is moderated by Ms Dineke de Groot, President of the Supreme Court of the Netherlands.
